I thihft-,we should be very very careful because I have also heard Rox and Harvey say we cannot when we have ex~ng regulations that would apply. Go figure. I think on this case I'd look at the bufferring. I'd make so`re comment about how it does or does not realte to the specific requirement. I'd tell the P&Z what CC directed and what their attorney told them. Then I'd let the P&Z make a recommendation and let the CC hear it and decide. It will be very interesting when legal reviews our staff report what their take will be. Until then, I'm not sure what else we can depend on. I also understood Steve was going to stick with the R-2 (He told the CC he did not want any C-2 here and I don't think they demanded that he have any). The direction I heard was for him to go back to P&Z and let them condition the rezoning to duplex on additional buffering. I guess the question is, is the wood fence and the more intense landscaping a greater standard than just the wall. recall the Raintree / USDA buffer ordeal. Sounds like P&Z has discretion to recommend approval of whatever they like. I'm not necessarily less confused than you guys - just confused in different ways.
