The following is a timeline of actions I have taken regarding the Mudlot (02-150)
since it was considered by the Planning and Zoning Commission on October 17,
2002:
November 5: Stamped the site plan approved.
November 12: Sent a letter (enclosed) to Culpepper Family, Inc. regarding
the decision made by the Planning and Zoning Commission
(delivered 11/13).
December 3: Called Jack Culpepper (left a message).
December 5: Called Jack Culpepper and left a detailed voice message
regarding the site plan requirement that the Church St.
entrance be removed.
December 9: Jack Culpepper left me a voice mail that he is working on
removing the entrance, but that he is delayed by the
weather.

Dear Mr. Culpepper:
This letter is to notify you that, as per the action taken by the Planning and Zoning Commission at
their meeting on October 17, 2002, the above property may function as a temporary parking lot
built to the standards on the approved site plan dated November 2002. The Commission
determined that the temporary parking lot must cease existence by August 31, 2003. By this date,
in accordance with Section 9.2.G of the Zoning Ordinance:
The lot must be brought up to full compliance with the parking lot standards applicable to
the use as required by the Zoning Ordinance, or the lot, including all paving material,
must be removed and the area no longer used for the parking of vehicles. If the lot is
removed, the area must be sodded, seeded, or hydromulched with grass within 10 days of
removal. Driveway access shall be removed and curb and gutter replaced.
If the property owner and/or a lessee determines they would like to continue the parking lot use
on a permanent basis, proper approvals and permits must be obtained from the City of College
Station and a Certificate of Completion issued by the City by the determined date of August 31,
2003.

AGENDA ITEM NO. 9: Consideration, discussion, and possible action on a Site Plan for a
temporary commercial parking lot on Lot 1-R of the Ramparts Subdivision. (02-150)
(Molly Hitchcock) Good evening. I'm Molly Hitchcock, Staff Planner. Staff recommends approval
of this request with the condition that the owner provide security lighting in the
parking lot. A new site plan did come in after the staff report was written and
that's the site plan you received in your packets and it has addressed Staff Review
Comments #3. The property and those around it are zoned NG2, Commercial
Northgate. The adjoining property to the north is the shopping center that the
applicant has stated requires temporary overflow parking. The adjoining
property to the southwest is the site of the old Mud Lot. From 1985 through
1990 that parking lot was allowed to be constructed to a temporary standard
through a development agreement. Earlier this year, the property was re-plated
and that site, the old Mud Lot site, was sold to St. Mary's Catholic Church who
has received an approved site plan for a perm church parking lot that will also
double as a paid parking lot, and that lot is temporarily under construction. To be
eligible for temporary status, this lot would have to be used for overflow parking.
That does not preclude the use of the lot as a paid parking lot in times when it is
not needed for overflow. As you can see on the site plan behind Commissioner
Williams, the lot will have room for 250-plus cars and access to the lot will be
through the back isle of the shopping center, and a curb cut on church that will be
closed after St. Mary's completes construction of their shared access easement.
When considering the temporary parking use, the Commission should consider
traffic control and handling, pedestrian safety, public utility and emergency
vehicle access, runoff drainage and flood control, impacts on adjacent land uses
and the lots affect on public health, safety and welfare. You have the final
authority over the permitting of a temporary parking lot and its associated site
plan. You can approve, approve with conditions, deny, table or defer action. If
you approve the temporary lot, you need to set a beginning date for the 12-month
period that the temporary condition will be allowed to continue. And, the
applicant is here and would like to address the Commission and I would be happy
to answer any questions after he's had an opportunity to speak.
(Commissioner Floyd) I'd like to ask some questions before that.
(Molly Hitchcock) Yes sir.
(Commissioner Excuse me, Mr. Chairman, I'd like to excuse myself from discussion of this
McMath) agenda item.
(Commissioner Floyd) Thank you. Commissioner McMath has asked to abstain, so he will remove
himself from this discussion.
(Commissioner Floyd) When you look at the set of questions that you put here before us, I think eight,
right before this; the items that you; right, we need to find; you have.
(Board Secretary) We can't hear you.
(Commissioner Floyd) Well I'm right in front of the mike. What's wrong? People don't normally tell me
they can't hear me. Thank you.
(Commissioner Floyd) When you went down through that list, you did that as a Staff and you found no
reasons to deny. I mean, you've recommended approval, so I'm assuming you
found reasons to recommend approval.
(Molly Hitchcock) With the condition with security lighting.
(Commissioner Floyd) Okay, and when you said there was an agreement that ran to 1990;
(Molly Hitchcock) Yes sir.
(Commissioner Floyd) What happened between 1990 and 2002?
(Molly Hitchcock) The applicant no longer came back and asked for an extension of the
development agreement and so Council no longer gave the extension, so that
agreement, in affect, ended, and the lot has not been;
(Commissioner Floyd) Got it.
(Commissioner Floyd) It's not been addressed since that time.
(Commissioner Floyd) Very good. Okay.

(Commissioner Floyd) The applicant, I understand, is here and would like to address the Commission.
Please come forward at this time.
(Jack Culpepper) Hello. My name's Jack Culpepper. I live at 9200 North Lake Forest Court in
College Station. This property was purchased by myself in 1996, and at that time
it was leased to a man that ran it as a parking lot. And, for the last couple of
years I, myself have run it as a parking lot. And I'm representing Culpepper
Family, L. P., which is myself, my wife and our three children. We're the owners
of the property. The property is used by St. Mary's Catholic Church parishioners,
The Texas Federal Credit Union, Hurricane Harry's, A&M students and
employees, A+ Tutoring, which is a business near by as well as Fat Burger. We
have visitors that go to the Aggie football games that utilize it and also First
American Bank occasionally utilizes it. I would certainly be willing to add to
security lights for the parking area. We would like to continue to utilize this
property for parking on a temporary basis. I would much prefer to be talking to
you all about a new development but we do not have that in process at this time,
hopefully within the next 12 months we will and that would be much preferable.
But in the meantime, we would like to continue to utilize this property for
parking. It will benefit citizens and businesses in the area. And I'd be glad to
answer any questions.
(Commissioner Floyd) Commissioners, any questions? Thank you sir, appreciate it.
(Jack Culpepper) Oh, I also have a letter from St. Mary's I'd like to give to you if I could approach.
(Commissioner Floyd) Thank you. It's a letter for support from St. Mary's Catholic Church. I did have
another question of staff. I'm, they, and then, I'm sorry, I didn't mean to cut you
off. You talked about, if we submit this we need to get a starting date.
(Molly Hitchcock) Yes sir.
(Commissioner Floyd) And an ending date.
(Molly Hitchcock) That's correct. Well, the starting date will set the ending date.
(Commissioner Floyd) I guess my question is since this has been done without any request, does the
starting date have to be in the future or can it be moved back?
(Molly Hitchcock) I'm going to defer that to counsel.
(Commissioner Floyd) I knew you would.
(Carla Robinson) You know, I don't think our ordinance addresses that, but I would, hang on just a
minute.
(Commissioner Floyd) We're dong a law review thing right now.
(Carla Robinson) My advice would be that the 12-month period, because it's a 12-month permit,
must begin no sooner than today's date if you grant, if the Commission grants it.
(Commissioner So it would begin today.

(Commissioner Floyd) My question, counselor, is really this; that all of us know that we're in a town that
is really driven, this particular activity, by an academic calendar, the academic
calendar actually, being September 1st. So, it's logical to me that if you're really
talking about something temporary, we don't want someone selling permits to
park there after September 1, of 2003. So, I would have started the clock then,
but my second question will be a very simple one. Are we required to make it a
12-month period?
(Carla Robinson) I knew that was coming. This is the way the ordinance reads; it is not to exceed
12 months.
(Commissioner Floyd) Okay, well that's a simple one to take care of then. Thank you. Now, I had
another gentleman that wanted to speaker.
(Blayne Mozisek) Good evening. My name is Blayne Mozisek and I live at 309 Redmond Drive
#312, College Station, Texas. I am the manager of A+ Tutoring and Java Jitters
Coffee Shop, which are located right there in the shopping center. I'm
representing Ali Cazaroni, the owner of those two businesses. I'd just like to
address the council that the negative affects that it would have closing down the
parking lot. A+ Tutoring depends on that parking lot. On several nights a week,
at least four nights a week, we have an overflow of the available parking in our
parking lot and we direct students to go into the Mud Lot and utilize those
parking facilities. In addition to that, our students utilize other businesses in that
shopping center and bring their products into our classroom, so it also benefits
other businesses around there. I guess that's about it. That's all I have.
(Commissioner Floyd) Thank you. Any questions Commissioners? Thank you. Anyone else who
wishes to address the Commission? Yes sir.
(Clay Riebe) Thank you. My name's Clay Riebe. I live at 13292 IGN road here in College
Station, Texas. I'm here on behalf of First American Bank. We are an adjacent
landowner to this lot and wanted the Commission to know that we have no
objections to what is proposed by Staff.
(Commissioner Floyd) Great. Thank you. Appreciate it. Anyone else?
(Gary Seaback) Gary Seaback, 9215 Timberknoll. I'm the owner of Hurricane Harry's, and just, I
guess the last four or five months we've put some lights back there and made it
real bright directly behind us and Jack, if he adds a few more lights, it's going to
be well lit up. And it's very nice to have that for overflow parking.

(Commissioner Floyd) Good. Thank you very much, sir.
(Greg Baird) It appears that I've come in the nick of time. My name is Greg Baird, 3919 Old
Oaks in Bryan. I'm vice president of Aggieland Credit Union. We operate a full
service branch at Northgate in a rather historic building; the first bank building
ever constructed here in College Station. It's a unique property in that it has two
parking spaces and a staff of, that averages about I 1 employees. So we have a
little bit of problem there. We have I I folks with only two places to park. We
lease spots from the Mud Lot. We considered moving to the city garage,
however, we are a nonprofit cooperative and unfortunately, the spaces over there
in the city garage are a little bit more than the Mud Lot, so we would like to
continue parking over at the Mud Lot at this time. If the Mud Lot is taken away
it will certainly adversely affect our business and our members here in College
Station.
(Commissioner Floyd) Thank you very much. Any questions Commissioners? Thank you. Anyone
else who wishes to address the Commission?
(Kristy Grothues) Hi, I'm Kristy Grothues. I live at 729 Rock Bottom Road, Navasota, and actually
I'm here on behalf of the Texas A&M students. And, our thing is that there is
very little parking as it is now at Texas A&M on University, and so, this lot,
being there is very convenient for us and also it is very affordably priced in that
we can pay per day so we are definitely in favor of keeping it open.
(Commissioner Floyd) Thank you. Anyone else? Anyone else who wishes to address the Commission
on this request? Seeing none, I will close the public hearing and move to the will
of the Commission.
(Carla Robinson) Commissioners, could I mention something? The Staff and I just noticed that
this is not set for a public hearing.
(Commissioner Floyd) That's alright. We like to have public hearings.
(Carla Robinson) I know that. That's why I just made the decision, let everyone speak. I do need
to advise you though, that when you make your decision, you need to base it
upon the information provided by the Staff and the applicant.
(Commissioner Floyd) Oh, I'm certain we will. Thank you counselor. It never hurts to have public
opinion now does it? Do I have a motion for discussion purposes?
(Commissioner I move for approval with Staff Comments #3 for discussion purposes.

(Commissioner Floyd) I have a motion and a second for discussion purposes. We do that sometimes
when we can't' seem to get to a quick motion. Commissioners; comments?
(Commissioner I see the benefit of it, I just question at the end of the year or September 1 or
Trapani) whatever date, is the lot going to get paved or will we be here again?

(Commissioner Floyd) I think that's a concern, a legitimate concern, that all of us have, you know, you
have adjoining this property, you have another property owner who is going to
the expense to meet the standards that the city has, and then you have this
property where you're not doing it. On the other hand, I guess the way I'm
looking at it is, we're in a situation where we've allowed this activity for a very
extended period of time. I realize it's being expanded into a portion of the
property that formally didn't exist. I would have preferred that owner should
have come forward and asked about that prior to doing it, but this is where we
are. So it seems to me that if you put some time limitations, if you have concerns
about security, if you have concerns about landscaping, you put those on it and in
a year's time I think where you are is the temporary is gone, is absolutely gone.
And, you either develop the property then and hopefully something would have
happened between now and then that might even be more exciting than a parking
lot. From all these people that have just now talked to us, I don't know, a parking
lot sounds pretty exciting, right now. So, in the interim, they have the
opportunity to use the facility. I think the city finds itself in a better position
having said the action has been taken appropriately and they know that the clock
is ticking and so I think everybody is well served. I really do believe that
security lighting is an issue. I'd like to see us address that. Landscaping is an
issue to the extent; I drove by it today, and looked at it very carefully. You know
that makes people nervous when you do that and they are building there. They
watch you all they way and think what you're doing is weird. But, it concerns me
that the church is going to all this expense to make something look quite nice and
then you're going to have, and yet, you know, what are you going to do, plant a
tree and dig it up a year later? I mean, I'm kinda torn on that one. And, if you
think about putting a wall in or some of the others things that we normally would
do, that gives you another security risk, because I think the more open it is, the
more you can see people going back and forth, that's safer, so I think it's just one
of those things that you just say, look, we've got a period of time. We need to
work this out and the property owner is going to work with us and he's going to
work it out over that period of time. I've taken good faith. I would limit it
personally, to August 31,2003, and ask for some additional security lighting,
which I think can be done without putting up additional standards or anything,
and they can take it off of the existing building that's there, that's the right height
and everything so it shouldn't' be that costly to do, but I think if that's done,
everybody benefits.
(Commissioner Floyd) Commissioner Hall, you're very quiet.
(Commissioner Hall) Well, I can appreciate everybody's wanting to use the space. It's quite obvious
there's not enough parking space over there. But I've also in past years sat
through this same thing. We had one year, one year, one year - the history shows
it. And, so I don't' have a lot of positive feelings that a year from now it's going
to be a lot different other than waiting for somebody to come in and build a hotel
in that space. I don't think it's going to happen anytime soon. I think the parking
is necessary. I just think the requirements for the parking needs to be upgraded
so that it is more compatible with what's going on in the Northgate area. The city
has spent a lot of time and effort to try to make Northgate something, and to have
a parking space that's not being required to meet the other development around
there on a one year temporary, I think there's gotta be a point in time where we

say I'm sorry you've just gotta come around in getting in compliance with what
everybody else is doing, and somebody's got to pick the time and whether this is
the time or not I don't' know.
(Commissioner Floyd) Let me ask counsel if I may a questions. If we put, is there any way to put a, I
hate to use that phrase, drop dead, you cannot come back and get another
temporary permit. Is there any way to make that a condition of this permit?
(Carla Robinson) The ordinance is pretty explicit and what it tells you is that at the end of the 12-
month period, the lot must be brought up to full compliance with parking lot
standards or it must be removed and the area no longer used for the parking of
vehicles.
(Commissioner Floyd) So, the reason that we've not been able to do that in the past is that we've not
been operating under this type of permit. Is that correct? I mean, from the city's
staff enforcement they simply haven't had this type of agreement in place. So
that nothing happened at the end, they could keep on going because it was out of
compliance.
(Carla Robinson) You know that probably, the continued use like that probably had occurred for a
number of reasons.
(Commissioner Floyd) Okay.
(Commissioner I'd like to amend my motion.

(Commissioner I'd like to move for approval with Staff Comments #3 with the inclusion of
Williams) security lighting as appropriate, working out with staff, and to expire at the end
of August 2003, August 31.

If the property owner and/or a lessee determines they would like to continue the parking lot use
on a permanent basis, proper approvals and permits must be obtained from the City of College
Station and a Certificate of Completion issued by the City by the determined date of August 31,
2003.

SUBJECT: MUDLOT (SP) - Site Plan
Staff does not feel that the proposal meets the intent of Section 9-G, Temporary
Parking Lots, of the College Station Zoning Ordinance. The provision in the Ordinance
for temporary parking lots is intended for unanticipated, additional parking in excess of
what the ordinance requires or what was originally installed for the use, because of
increased patronage and business growth. Since this is a pay parking lot and not
associated with any other use, we do not feel that the intent of the Ordinance is met.
Staff reviewed the above-mentioned site plan as requested. The following page is a list
of staff review comments detailing items that need to be addressed. Please address
the comments and submit the following information for further staff review:
Two (2) revised site and landscaping plans.

THIS IS A STOP REVIEW: Please refer to Section 10 (Site Plan Review
Requirements) of the College Station Zoning Ordinance, including 10.1
Application Procedure and 10.2 Additional Requirements. These items are
required for a full site plan review. The following comments do not constitute a
full site plan review. Please be aware that the subject property is located in the
Northgate District (NG-2) Commercial Northgate and will be required to meet NG-
2 standards. All development in the Northgate District must be reviewed by the
Project Review Committee prior to moving on to the Planning & Zoning
Commission.
1. According to Section 9.2 G Temporary Parking Lots, of the College Station Zoning
Ordinance, site plan approval is required using the site plan review requirements as
outlined in section 10 of the Zoning Ordinance and the standards outlined in 9.2 G.
2. Items required for a full site plan review include, but are not limited to:
• Parking spaces drawn, tabulated, and dimensioned.
• Drive aisles drawn and dimensioned per Section 9.
• Curb cuts and driveway throat length.
• Landscape Reserve. A twenty-four foot setback from the right-of-way to curb
of parking lot is required per Section 9.
• Existing topography lines (2' max spot elevations) and proposed grading (1'
max for proposed or spot elevations) and other pertinent drainage
information.
• Required landscaping and streetscaping as required in the College Station
Zoning Ordinance.
• Required irrigation as required in Section 11.
3. The driveway shown on the site plan was not approved and will not be allowed to
remain in its current location. There is an existing access easement that is to be
shared between the subject property and the St. Mary's Catholic Church. This is the
only approved curb cut that would be allowed.
4. The subject property is located in the Northgate District (NG-2) which will require a
site plan review from the Project Review Committee (PRC) prior to the Planning &
Zoning Commission. The PRC is a recommending body to the Planning and Zoning
Commission.
