SUBJECT: Agenda Items - #2 & #3 - Revision of Section 8 of
Ordinance No. 1638, the Zoning Ordinance
At the Planning & Zoning Commission meeting on June 18, 1987, the
Commission voted to recommend denial of the proposed ordinance
revising Section 8.12 of Ordinance No. 1638, the Zoning Ordinance
for the City of College Station which would specifically include
"public or private parking lots and any related accessory uses"
to the list of conditional uses "because the frequency of
requests for this type of use in zoning districts where parking
lots are not currently permitted does not warrant a change in the
ordinance at this time". The voting result for the motion to
deny recommendation of the proposed ordinance was 3-2.
The motion which finally passed followed 2 previous motions; one
to deny the recommended ordinance amendment, and one to amend the
ordinance to remove "public parking building or lot for operating
vehicles" from the list of permitted uses in Section 7.12 (A-P
zoning district) and Section 7.13 (C-1 zoning district) and to
include "any site or structure, the primary purpose of which is
to park vehicles" in the list of conditional uses included in
Section 8.12 of Ordinance No. 1638. Both motions resulted in 2-2-1
votes.

ORDINANCE NO.
AN ORDINANCE REVISING SECTION 8.12 OF ORDINANCE 1638, THE ZONING
ORDINANCE FOR THE CITY OF COLLEGE STATION, SPECIFICALLY AFFECTING
CONDITIONAL USES.
WHEREAS, the City Council of the City of College Station, Texas
held a public hearing in the City Hall at 7:00 p.m. on Thursday,
June 25, 1987 on the question of amending Ordinance 1638;
AND WHEREAS, the City Council has determined to amend Ordinance
1638;
THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
COLLEGE STATION, TEXAS:
Section 8.12 of Ordinance 1638 is hereby amended to include the
following use in the list of conditional uses:
Public or private parking lot and any related accessory uses.
This ordinance shall become effective from and after its passage
in accordance with the City Charter of the City of College
Station.

NOTICE OF PUBLIC HEARING:
The College Station Planning and Zoning Commission will hold a
public hearing to consider revising Section 8.12 of Ordinance
1638, the Zoning Ordinance for the City of College Station,
specifically affecting conditional uses by adding public and
private parking lots to the list of conditional uses.
The hearing will be held in the Council Room of the College
Station City Hall, 1101 Texas Avenue at the 7:00 P.M. meeting of
the Commission on Thursday, June, 18, 1987.

RE: Ordinance amendment affecting conditional uses
VO/n May 28, 1987 the staff received direction from the City
Council to present an amendment to the Commission for a
recommendation regarding the addition of public and private
parking lots and any elated accessory uses to the list of
conditional uses. urrently par ing lots are permitted in the
A-P, C-1, C-2, and C-3 zones. By special action of the Council
C-1 uses were allowed on the M-2 tract on the west side of
Welborn from Jersey to Luther.)
A conditional use is defined as a use which may be permitted or
denied in a district, on a case-by-case basis, subject to meeting
certain conditions or procedures set forth in, or imposed under,
the Zoning Ordinance. Requests for conditional uses are
considered and a determination made by the Planning and Zoning
Commission after a public hearing. Requests can be granted when
the Commission finds:
A. That the proposed use meets all the minimum standards
established in the Zoning Ordinance for this type of
use;
B. That the proposed use is in harmony with the purpose and
intent of the zoning ordinance and the plan for physical
development of the district as embodied in the
comprehensive plan for the development of the City;
C. That the proposed use will not be detrimental to the
health, welfare, and safety of the surrounding
neighborhood or its occupants, nor be substantially or
permanently injurious to neighboring property.
/The amendment under consideration would allow public and private
parking lots in any district to be considered by the Commission.
The list of conditional uses is presently quite broad and several
of the uses could have large parking areas associated with them
(ie. Hospital, School, Municipal Buildings). The current
conditional uses listed in the Zoning ordinance are:

COMMUNITY BUILDINGS CONVALESCENT HOMES
MEDICAL CLINICS PHARAMCIES
SCHOOLS TELEPHONE EXCHANGES
HOSPITALS, SANITARIUM OR NURSING HOMES
MUNICIPAL SERVICE FACILITIES AND BUILDINGS
PUBLIC LIBRARIES
Vin the approval of a use permit, the Planning and Zoning
Commission may impose any conditions or "safeguards" that are
reasonable to carry out the spirit of the ordinance and/or to
mitigate any adverse effects of the proposed use. The Commission
is not obliged to grant any request. There is also an appeals
process outlined in Section 14 of the Zoning Ordinance setting
forth that within ten days after consideration of a use permit
any aggrieved party may present an appeal in writing setting
forth that the decision was unjust and/or made in error and must
specify the points of error. This appeal will be heard by the
City Council.
Other Texas cities with zoning have dealt with parking lots in
various ways.
In Austin commercial parking lots are permitted in more intensive
commercial and industrial zones, but are conditional uses in the
downtown and lake front areas.
There is a special. zoning district in Odessa just for commercial
parking lots. The use is also a conditional use in the office
and retail commercial districts and a permitted use in medical
center zones, the CBD, and in industrial zones.
The City of Tyler allows parking lots as special uses in
residential zones only when within prescibed distances from
commercial and industrial uses.
In Lubbock parking lots are permitted in a mixed use type
commercial/apartment zone and in a retail zone.
In Richardson, Irving and Kingsville they are allowed in
commercial and industrial zones only.
Parking lots are permitted in commercial zones only in Corpus
Christi, Fort Worth and San Marcos.
~he consideration of this ordinance amendment by the Commission
is for a recommendation to be made to the City Council. The
Council will make a determination on the ordinance at their June
25th meeting. /~~Z

SUBJECT: Amending list of Conditional Uses to include Parking Lots
Attached is a draft ordinance amending the Zoning Ordinance to
add "Public and private parking lots with related accessory uses"
to the Conditional Uses listed under Section 8.12. The following
schedule has been established for review and consideration of
this amendment:
May 29- Prepare and distribute draft for staff review.
June 3- Notice published for P&Z hearing.
June 10- Notice published for Council hearing.
Draft ordinance finalized for inclusion in P&Z packets.
June 18- P&Z consideration of amendment.
June 25- Council consideration of amendment.
As supporting information staff will identify other cities that
utilize similar mechanisms for authorizing and regulating parking
facilities. We will also identify areas within College Station,
such as Northgate, that would be potential locations for parking
facilities under the Use Permit provisions.
I will meet with the City Attorney to determine if we can
accept an application for the proposed parking lot during the
amendment review and adoption process. If so, it would be
possible for such application to be considered by the Commission
on July 2, provided that the applicant can meet submission
requirements within established deadlines. We will advise
the applicant of potential application dates as soon as a
determination is made.
