SHOPPING VILLAGE IN THE CITY OF COLLEGE STATION, TEXAS.
ITEM SUMMARY: Joe Fontana has filed an Application for the
Abandonment of a portion of the dedicated alleyway that runs be-
hind his property in the College Hills Estate Shopping Village at
the corner of Texas Avenue and Walton Drive.
FINANCIAL SUMMARY: N/A
STAFF RECOMMENDATIONS: Staff has reviewed this Application for
Abandonment and has denied the request for the following reasons:
1. Water and Wastewater state there is a sewer line
located in the alley.
2. Public Services states that solid waste collection
service is provided through the alley and if it were
abandoned, the trash trucks would have no way to pro-
vide trash services to the other property owners be-
cause the trucks could not turn around. Currently, the
trucks drive through this alley.
3. Lone Star Gas stated that there is a gas line located
in the alley.
Neither Fire nor Police would be negatively affected by the
abandonment.
CITY ATTORNEY RECOMMENDATION: There has been an implied
dedication of a part of the alley.
COUNCIL ACTION DESIRED: Denial

SHOPPING VILLAGE IN THE CITY OF COLLEGE STATION, TEXAS.
ITEM SUMMARY: Joe Fontana has filed an Application for the
Abandonment of a portion of the dedicated alleyway that runs be-
hind his property in the College Hills Estate Shopping Village at
the corner of Texas Avenue and Walton Drive. This application
was on the last Council Agenda, but Mr. Fontana was inadvertently
advised of the wrong meeting time and, consequently, was not at
the meeting to state his case. He has requested that this be
placed on the agenda again so that he can be heard.
FINANCIAL SUMMARY: N/A

The undersigned hereby make application for the vacation of that
portion of the above alley particularly described in Exhibit No.
1, attached.. In support of this application, the undersigned
represent and warrant the following:
1. The undersigned will hold the City of College Stati6harmless,
and indemnify it against all suits, costs, expenses, and damages
that may arise or grow out of such vacation.
2. Attached, marked Exhib'.t No. 1, is a legal description of the
alley, to to vacated, prepared by a Registered Public Surveyor.
3. Attached, marked ExhiLit No. 2, Ls a plat or sketch of that
portion of the alley to be vacated and the
surrounding area to the nearest streets in all directions, showing
the abutting lots and block, and the subdivision in which the above
described alley is situated, together with the record
owners of such lots;
4. Attached, marked Exhibit No. 3, is the consent of all public
utilities to the vacation;
