The City of College Station is considering an AMENDMENT to the UNIFIED DEVELOPMENT ORDINANCE that affects taxicab operations as home occupations within the City limits. The proposed amendment would limit on the number of commercial taxicabs that can be parked on-street and off-street as part of a home occupation. This amendment would apply to taxicab operations (dispatch or storage) that operate as home occupations in a College Station residence. Businesses operated out of Bryan, or a commercial site, are not impacted by the proposed amendments. The Planning and Zoning Commission will hold a public hearing on Thursday, August 19, 2010, at 7:00 p.m. to consider the amendment. The City Council will also hold a public hearing to consider the amendment and the Commission's recommendation on Thursday, September 9, 2010, at 7:00 p.m. The public hearing(s) will be held in the City Hall Council Chambers located at 1101 Texas Avenue, College Station, Texas. Except while loading or unloading passengers into and from such taxicab or limousine or in an area designated and approved by the city council as a "Taxi/Limo Stand," it shall be unlawful for the holder of any permit issued under the terms of this article or the agent, servant, or employee of such permittee to park or leave standing any taxicab, limousine or shuttle on the streets of the town. City of Allen Home occupations. Home occupations are permitted as accessory uses subject to the following requirements No outside storage of materials, goods, supplies, vehicles, trailers or equipment connected with the home occupation shall be allowed. No traffic or parking of vehicles shall be generated by a home occupation in greater volumes than normally expected in a residential neighborhood and any need for parking must be accommodated within the required off-street parking for the dwelling unit. Any business, occupation, or activity conducted within a dwelling unit and which does not meet these characteristics shall be construed to be a commercial activity and shall be cause for the city to order a cease to all such activity within such dwelling unit. Lewisville Home occupation shall mean a business, occupation, or profession conducted within a residential dwelling unit by the resident thereof, and which shall have the following characteristics: (1) The activity shall employ only members of the immediate family of the resident of the dwelling unit; (2) There shall be no external evidence of the occupation detectable at any lot line, such evidence to include advertising signs or displays, smoke, dust, noise, fumes, glare, vibration, electrical disturbance, storage of materials or equipment, or traffic or parking of vehicles in a manner evidencing the conduct of business; and (3) Such home occupation shall not have a separate entrance for the business and shall not include continual visits by the general public. A business, occupation, or profession conducted within a dwelling unit and which does not meet the aforesaid characteristics shall be construed to be a commercial activity and shall therefore be cause for the city to order a cease to all such activity within such dwelling unit. Longview § 25-2-900 HOME OCCUPATIONS. (A) A home occupation must be conducted entirely within the dwelling unit or one accessory garage. (B) Equipment or materials associated with the home occupation must not be visible from locations off the premises. (C) Parking a commercial vehicle on the premises or on a street adjacent to residentially zoned property is prohibited. . . o a (D) Advertising a home occupation by a sign on the premises is prohibited, except as provided under Section 25-10-156 (Home Occupation Signs). Advertising the street address of a home occupation through signs, billboards, television, radio, or newspapers is prohibited. McKinney Home occupations. A home occupation, in districts where allowed, shall meet the following standards to maintain the residential character of the neighborhood while providing opportunities for home- based businesses. (1) Home occupations shall be conducted entirely within the main building. (2) Home occupations shall not produce any alteration or change in the exterior appearance of the residence which is inconsistent with the typical appearance of a residential dwelling. a. No external evidence of the occupation shall be detectable at any lot line, including advertising, signs, smoke, dust, noise, fumes, glare, vibration, electrical disturbance, or outside storage of materials or equipment. b. The home occupation shall not have a separate entrance. c. Not more than two patron or business related vehicles shall be present at any one time, and the proprietor shall provide adequate off-street parking for such vehicles. d. A maximum of one commercial vehicle, capacity one ton or less, may be used or parked on the property in connection with the home occupation. The commercial vehicle shall not be parked in the street. e. The home occupation shall not require regular or frequent deliveries by large delivery trucks or vehicles in excess of 1%2 tons. f. The home occupation shall not display advertising signs or other visual or audio devices which call attention to the business use. Missouri City 9.16. Home occupation regulations. A. In addition to the requirements of the zoning district in which it is located, a home occupation shall comply with the following restrictions: 1. No home occupation shall cause, by reason of its existence, an increase in the number of vehicles traveling to and from the home or on the public streets surrounding or abutting the home; 2. A home occupation shall in no way destroy, restrict or interfere with the primary use of the home as a place of residence; 3. No merchandise shall be displayed or sold on the premises; 4. The home occupation shall be conducted entirely within the residential building or accessory structure, and in no event shall such use be visible from any adjacent properties or public or private street; 5. There shall be no outdoor storage of equipment or material used in the home occupation; 6. No more than one vehicle shall be used in the conduct of the home occupation; a 7. No mechanical, electrical, or other equipment which produces noise, electrical or magnetic interference, vibration, heat, glare or other annoyance outside the residential building or accessory structure shall be used; 8. No home occupation shall be permitted which is noxious or offensive to a person of ordinary sensitivity or hazardous by reason of vehicular traffic, generation or emission of noise, vibration, smoke, dust or other particulate matter, odorous matter, heat, humidity, glare, refuse, radiation or other objectionable emission or which involves the transportation or storage of hazardous material, as defined by section 38-202, City of Missouri City Code of Ordinances, as amended, or hazardous waste, as defined by section 78-1, City of Missouri City Code of Ordinances, as amended; and 9. No persons other than residents of the premises shall be engaged in the home occupation. B. Notwithstanding the foregoing restrictions, a child care home is a permissible home occupation. Pearland (d) The operator of a taxicab shall not stand or park such vehicle upon any street at any place other than in a taxicab stand so designated as provided herein. This provision shall not prevent the operator of a taxicab from temporarily stopping in accordance with other stopping or parking regulations at any place for the purpose of and while actually engaged in the expeditious loading or unloading of passengers. San Marcos DIVISION 3: HOME OCCUPATION REGULATIONS Section 4.3.3.1 Provisions for Home Occupations (a) Purpose. Standards for controlling home occupations are set forth to minimize annoyance and inconvenience to neighboring property owners within residential areas. These standards are intended to allow reasonable and comfortable enjoyment of adjacent and nearby property by their owners and by occupants of neighboring residential dwellings, while providing opportunities for the pursuit of home-based businesses. (b) Special Provisions for Home Occupations. (1) Not more than one business-related vehicle shall be present at one time, and the proprietor shall provide adequate off-street parking on the property where the use is located; (2) One commercial vehicle, GVW capacity of one ton or less, according to the manufacturer's classification, may be used, or parked behind the front building line on the property, in connection with the home occupation, but the vehicle may not be parked in the street; (c) Uses Prohibited as Home Occupations.
