in a non-interest bearing account and upon completion and acceptance, by CoCS, of all
infrastructure that this dollar amount will be returned to the Developer.

Dear Rabon
I am writing you on behalf of my client Summit Crossing, LLC regarding Exxon Mobil
Pipeline Company's comment to the City of College Station that "subdivision lot lines will not be
allowed to cross over their easement"
I have reviewed the alleged Easement described as follows:
Grantors: E.U. Peters, Icy Peters
Grantee: Magnolia Pipeline Company
Date: October 30, 1946
Recording: Volume 127, Page 411, Official Records, Brazos County, Texas
Said easement, does not place any limitations on Grantee's platting of the property. The
Grantee was granted the following rights:
The rights of way, easements and privileges to lay, repair, maintain, operate, and remove
pipe lines and replace existing lines with other lines, for the transportation of oil and gas,
and the products thereof, water, or any other fluid or substance, and to erect, repair,
maintain, remove and operate lines, telegraph lines and telephone lines, over, across, and
through our lands.
The Easement further provides that Grantor shall have the right to fully use and enjoy the
premises except for the purposes hereinbefore granted to said Magnolia Pipe Line Company.
As such, lot lines extending into the easement does not prevent the Grantee from utilizing
the easement as written. Therefore, nothing therein would prevent the filing of the plat as
presented to the City of College Station.

It appears that you designed the 10" PVC sanitary sewer line approx. 48"
below our 12" Mobil pipeline as shown on drawing no. S-01, sheet 3 of 5.
We offer no objection regarding this line only [Rabon A. Metcalf, P.E.] Thanks.
Please make the following changes on dwg. no. ST-06, sheet I 1 of 20:
Submit an answer as to why you can't meet our 24" minimum clearance
requirement for the 30" storm sewer.
[Rabon A. Metcalf, P.E.] In order to achieve the 24" clearance I would have to lay the storm sewer at a 0.17% slope. This slope will
not allow sufficient capacity in the line to convey the required amount of runoff.
What I have proposed is a 2l" clearance. If you add in the thickness of the storm sewer pipe (3") then you will have 24" of clearance
from the flowline of the storm sewer to the top of the gas line. Please let me know if this 3" reduction in clearance will be acceptable.
Subdivision lot lines will not be allowed to cross over our easement.
Stop the back lot lines at the edge of our easement.
