The purpose of this meeting was to request a variance for the driveway separation from the City of College Station Project
Review Committee.
Item Discussion Action Due Date
1.01 The Committee discussed the project and requested an understanding of Info
the law from the City Attorney. She said you have to allow access to a
tract and there is currently access to the property via an easement
through the auto parts store parking lot. There is no TXDOT law about
access to a tract. TXDOT defers to the policies set by the City of
College Station. Since there is one access available, no variance is
required.
1.02 The City of College Station staff recommends the use of the access
easement through the auto parts store parking lot and gaining an
easement through the church parking lot.
l t_ rf 1.03 MA pointed out that without a driveway there was concern that the fire Info
lane was in jeopardy since the driveway provides access for the fire
truck. It was stated that in this case the fire department could use a
turnaround. MA doesn't think the parking lot is large enough for a
turnaround.
1.04 The driveway on Texas Avenue was discussed in detail. There is a 275' Info
minimum requirement for the driveway to be separated from Harvey
Rd., but the driveway is only 240' away. Also the driveway falls into a

right hand turn lane and the driveway to the church is 110' from the
proposed driveway. This would create difficulties for traffic slowing
down to turn since there are certain expectations at corners for
deceleration. The attorney stated that legally there is no requirement for
this driveway since access to the property exists. It was pointed out
that there is a full raised median planned on Texas and that traffic
exiting the property could only turn right. There are many existing
traffic problems with this intersection as is and they are reluctant to add
to those problems. It is also a major arterial.
1.05 The driveway at Harvey Road was discussed in detail. If the driveway Info
doesn't exist, it was suggested that grasscrete could be used for the fire
truck access. The point was raised that there may not be sufficient
ability to enter the parking areas.
1.06 The committee stated that the building would be an attractive addition Info
to the city at this particular intersection.
1.07 The attorney recommended investigating the encroachment on the Info
floodway by having an engineer review the plans. It was pointed out
that there are parking spaces, columns and an elevator pit scheduled to
be in the floodway.
1.08 The attorney stated that ancillary issues shouldn't be discovered before Info
the driveway variance is issued. Variances cannot be granted
conditionally. Variances are permanent and travel with the land.
1.09 FEMA would determine if there could be parking spaces in the Info
floodway. There are a large number of parking spaces as planned in the
floodway.
1.10 There is a domino effect with the various problems inherent in the site. Info
The determination of the driveways affects parking count A variance is
required for the parking count also. If FEMA doesn't allow parking in
the floodway, then the parking count is reduced also. These issues need
to be decided before going before the ZBA.
1.11 The question was raised if there was enough clearance under the Info
building for the necessary equipment.
1.12 The committee is very concerned about allowing any access on Harvey Info
Road since there are more problems with this driveway over the one on
Texas Avenue. They would prefer allowing the Texas Road access and
denying the Harvey Road access, but access on Texas Road would have
to be right in only and no exit. The driveway width would need to be
adjusted accordingly. MA pointed out that this would mean there is no
means to exit the parking lot except through one adjacent property and
that it may cause a large backlog of traffic at rush hour.
1.13 It was pointed out that the plat indicates a large portion of this land is Info
dedicated as a drainage easement.
1.14 The committee recommended reviewing all the issues and the order of Info
the approval process with the Development Department with advice
from Counsel. If access is the first order of business then the committee
will meet again next week.

PROCEDURE FOR
A LICENSE TO ENCROACH
UPON A PUBLIC UTILITY EASEMENT
A. An application for a License to Encroach upon a public utility easement by the
City of College Station must be made pursuant to the procedure described below
in order to get a request before the City Council. The application should insure
that all stipulations and instructions outlined herein have been complied with
prior to submission of the final application for action by the City Council of the
City of College Station.
Application required
Attached to this information sheet is an application form for encroachment
upon a public utility easement.
2. Submission deadline
The application must be completed and returned to the Development
Services Department. The Development Services Department will
circulate the application among the various City departments for review
and approval. After all City departments have executed the application,
the Engineering Department will place the application on the next Council
agenda. The City Council holds regular sessions on the second and
fourth Thursdays of the month at 7:00 p.m. An applicant may attend the
meeting, if desired. The item will be presented by the staff. After Council
consideration of the request, the applicant will be notified of the action
taken by the Council relative to the encroachment request.
3. First page of application
a. On the first page of the application, the heading information to be
filled in includes the name of the addition or subdivision in which
the public utility easement is located. The date the application is
prepared should be entered in the appropriate space. Item No. 6
on the first page should set out the names and addresses of the
abutting property owners who have not consented to the
encroachment which you seek. You should also state why their
consent was not obtained; that is, if you were unable to locate the
abutting property owners or if the abutting property owner refused
to give his or her consent, you should so state briefly setting out the
points of objection that such owner might have to this
encroachment. Additional sheets may be used if necessary to fully
explain.
b. Item No. 7 provides space for a brief statement of the reason why
such License to Encroach should be granted. Item No. 8 should
relate briefly the history of the use of the easement sought to be
encroached. It is very important that the full name and address of
the applicant be shown in the space provided. This will insure
proper notification to the applicant following action by the Council.
The applicant's signature must appear immediately above the
typed name and the notary certification must be completed.

4. Exhibit No. 1
You must provide, attached to the application, two sealed copies of the
metes and bounds description of that portion of the public utility easement
sought to be encroached upon, prepared by a Registered Public
Surveyor. Please note, an employee of the Engineering Department, by
law, cannot prepare legal descriptions for you.
5. Exhibit No. 2
You must provide, attached to the application, two copies of a plat or
detailed sketch of the easement proposed to be encroached upon. Again,
this item is most easily furnished by a licensed land surveyor. It must
clearly show the surrounding areas to the nearest streets in all directions,
abutting lots, and the block or blocks in which the area sought to be
encroached upon is located. It shall also show the names of the record
owners of the lots abutting the area sought to be encroached.
6. Exhibit No. 3
Exhibit No. 3 must be executed by the various utility companies shown.
As applicant you are responsible for circulating the application and secur-
ing the signatures of the authorized representatives.
7. Exhibit No. 4
Exhibit No. 4 must be executed by the various City of College Station
staff. The Development Services Department will be responsible for
circulating the application amongst the City departments.
8. Exhibit No. 5
Exhibit No. 5 constitutes the consent of the abutting property owners
(other than the applicant) to the encroachment. The full names,
addresses and signatures are required for all who consent to the re-
quested encroachment. The names and addresses of those who cannot
be contacted should appear under Item No. 6 on with the appropriate
explanation made on Page 1 of the application.
B. In the preparation of your application, should you encounter any problems or
have questions, the answers to which you are unable to find in this information
sheet, please do not hesitate to contact the Development Services Department
for assistance.
C. By Council Resolution No. 8-23-01-11.6, the fee for an application has been set
at $325.00, which is non-refundable.

The purpose of this meeting was to request a variance for the driveway separation from the City of College Station Project
Review Committee.
Item Discussion Action Due Date
1.01 There was a motion to untable the variance decision and the motion was Info
seconded and approved.
1.02 Ken and Dale reviewed the traffic issues with the proposed driveway on
Texas. There are approximately 40,000 cars each day at the
Harvey/Texas intersection. Potentially with a 6-lane road, there could
be 100,000 cars. The right hand turn lane on Texas is scheduled as a
deceleration lane and will handle 4,000-5,000 right turns. This lane is
scheduled to be a continuous turn at certain times in the cycle when
there is a dual left turn onto Harvey.
1.03 The traffic engineer said he did not recommend constructing either Info
driveway under these conditions.
1.04 Mr. Floyd suggested that perhaps the City of C.S. could open Info
discussions with the church and Mr. Smith so that the church will allow
an easement to Mr. Smith's property. He suggested that Mr. Smith
install a parking canopy to encourage the agreement since they
currently have no covered parking.

1.05 Mr. Floyd stated that they are not inclined to provide a variance which
is contrary to public safety as the engineer's report provided.
1.06 Mr. Trapani asked if there were statistics at driveways in similar
situations, like Texas/University, where there is high volume and the
driveways are close to the intersection. Mr. Picha stated that the
statistics show that the Texas/University intersection rates #6 in no. of
accidents.
1.07 There was motion to deny the variance to provide a driveway on Texas
Ave. The motion was approved by the committee.
1.08 There was motion to deny the variance to provide a driveway on
Harvey Road. The motion was approved by the committee.

I spoke to Ms. Alleman this morning ...a summary of my recommendations to her are as follows:
- For safety reasons, AASHTO design guidelines specify that driveways should not be located in the
"influence area" of an intersection (including other driveways), which includes acceleration and
deceleration lanes (auxiliary lanes);
- it is a well known and documented fact that the number of crashes near driveways is higher than at other
intersections;
- Texas Avenue carries approx. 20,000 vehicles per day (per direction) on this section, and the right turn
volume (NB Texas to EB Harvey) is approx. 4,200 vehicles per day; with such a high volume of turning
movements, any driveway in the influence area would almost certainly create a safety problem;
- when TxDOT widens Texas Avenue, this signal will operate with a "right turn overlap," which means that
during 66-75% of the cycle length, this right turn will operate with have a protected movement (green ball
or green arrow). This right-turn movement will constantly be moving, except during the SIB left-turn phase.
Motorists decelerating for this driveway will create operational delays at the intersection.
Therefore, the city is denying the driveway location on Texas Avenue, 245 feet south of the intersection
with Harvey Road, regardless of right-in/right-out or just right-in design;

I spoke with Roxanne this morning and she would like to know exactly what the conditions need to be for
the license to encroach. (There is not a two step process.) She suggested that Richard Smith provide
some preliminary engineering studies, etc. before we proceed with the license to Council.
I've scheduled a meeting next Wednesday afternoon with Brett McCully & Mark Smith to determine
exactly what we need in order to recommend approval of the license. We will also put together a list of
conditions that are necessary to issue the license. We will then forward that information to Roxanne for
her review before we finalize the details with Richard's architect.
Roxanne was pretty upset by the fact that the architect told her that the right-of-way acquisition for the
Texas Avenue widening was almost complete and that they were not going to condemnation. Roxanne
found out this week that their condemnation hearing with TxDOT is 8/28. She's concerned that they are
pushing forward in an effort to have more leverage at their hearing.
Once Council has made a decision on the license to encroach, the next step should be the floodway
variance to ZBA. This will require full engineering studies to be submitted & reviewed by staff prior to the
PH before ZBA.
The next hurdle will be the variance to the total number of parking spaces that will also go to ZBA. (Or, if
the UDO is approved & in effect by this time, the DRB may have the authority to grant the variance.)
This is a long, intricate process given the magnitude of the development and the conditions of the lot. If
any variance is not granted or conditions change, it could impact the schedule. Please let me know if
you'd like additional information or if you think we should change the way we're approaching this
development.

Flood Way variance
I talked to Spencer re: flood way variance. He said he had never done one...is there anyone that has? He
said that there are probably 2 ways that it can be done. Either with the ZBA looking at the modeling of the
effects of their construction and granting the variance based on the findings, or granting permission to
building in the flood way as long as it is found (by whoever, Spencer, FEMA, etc) that it is not detrimental
to other properties, not increasing the water surface elevation. So, basically the same thing, but in reverse
order.

Natalie, As we discussed, the license to encroach cannot be a two step process. However, we
can place a set of restrictions and conditions in the license to encroach when the city grants it.
Since Mark Smith is in charge of drainage, we should consult with him to determine what
conditions he would require to allow an encroachment and what engineering data he would need
from Smith.

research the question as to whether or not we can make the license to encroach a two step
process? Or, could we issue a conditional license to encroach over the entire easement that
expires if certain conditions are not met?
Richard Smith called Tom and he wants to meet re: this project. In order for us to finish our
recommended process schedule, we need to find out how to handle the license to encroach.

In terms of process, we could take the license to encroach (to Council) with the parking variance (to ZBA).
However, it doesn't make sense to me to take the parking variance before the floodway variance.
Depending the on the outcome of their engineering work, they may have to reduce their total number of
parking spaces (especially the surface level parking within the floodway). I think if we take the parking
variance before the floodway variance, we're setting ourselves up to have to go back to ZBA once we
know the results of the floodway study.
I would feel much differently if they didn't have surface parking within the floodway. It appears they would
have to fill the floodway in order to have what they're proposing. (Which is in direct conflict with the
drainage ordinance.)

FYI - When I spoke with Roxanne, it appears hopeful that we could go ahead and process the license to
encroach and parking together at the same time. Her main concern was delaying the floodway variance.
I know this "duel" processing may not be consistent with the message you received, but it appears there is
a shot at it. In regard to the floodway variance, the delay of this doesn't appear to hold up their project any
more than it would have been otherwise, since they need a letter of amendment anyway. What are your
thoughts on this?

License to Encroach:
It appears from the drawing that they only need a license to encroach into the drainage
easement, not the 20' public utility easement. If so, we will not need to process the
application through TCA, Encor & Verizon.
Two options for processing the license:
• The quickest option in terms of processing is to stay out of the designated floodway.
(Through this property it's approximately 177' wide.) The license could be granted
for the entire property as long as the 100 year flood elevation is not increased. This
would be a condition on the license.
• If improvements are proposed within the floodway, we will need full blown
engineering studies and plans. If this option is chosen, we should probably take the
ZBA case first.
Need to make sure through this process that Smith is responsible for maintenance
underneath the building. (Will need to maintain adequate vertical & horizontal space for
maintenance.)
The pedestrian access doesn't necessarily have to go underneath the building. It may
make more sense to come into the property and tie into the sidewalk along Harvey Road.
