Item: Consideration, discussion, and possible action on a Vacating and Final Plat For
Lot 1, Block 1 (Cinemark) and a Final Plat for Lot 2, Block 1 (Rear Parking) of the
Gateway Park Subdivision consisting of 2 lots on 11.5 acres generally located at 1401
Earl Rudder Freeway South and Associates Drive.
Applicant: Rusty Glover, P.E. for Cinemark Corp.
Staff Recommendations: Staff recommends approval of this item as submitted.
Item Summary: Cinemark Theater is expanding the rear of the building to the east. As
you may remember, this plat came before the Commission in July of this year. Due to
changes in remodeling plans, the plat has been slightly changed but the intentions are
basically the same.
The Applicant is vacating the original plat to abandon a utility easement in order to
relocate a water main. The new building layout conflicts with the existing waterline
location. The Vacating Plat removes the old utility easement from Lot 1. The Final Plat
reestablishes Lot 1 and all easements and plats Lot 2.
Comprehensive Plan Considerations:
Land Use Plan: Retail Regional, zoned C -1. The property to immediate east is shown
as park.
Thoroughfare Plan: Earl Rudder Freeway is a highway /expressway
Floodplain: No portion of either lot is in the 100 -yr floodplain.

Hear Citizens At this time, the Chairman will open the floor to citizens wishing to address the
Commission on planning and zoning issues not already scheduled on tonight's agenda. The citizen
presentations will be limited to three minutes in order to accommodate everyone who wishes to
address the Commission and to allow adequate time for completion of the agenda items. The
Commission will receive the information, ask city staff to look into the matter, or will place the
matter on a future agenda for discussion. (A recording is made of the meeting; please give your name
and address for the record.)
2. Public Comment on the Unified Development Ordinance WDO). At this time, the Chairman will
open the floor to citizens wishing to address the Commission on the recently adopted Unified
Development Ordinance. The citizen comments will be limited to three minutes in order to
accommodate everyone who wishes to address the Commission and to allow adequate time for
completion of the agenda items. The Commission will receive the information and it will be added to
the public record. (A recording is made of the meeting; please give your name and address for the
record.)
All matters listed under Item 3, Consent Agenda, are considered to be routine by the Planning and Zoning
Commission and will be enacted by one motion. These items include preliminary andfinalplats, where staff
has found compliance with all minimum subdivision regulations. All items approved by Consent are
approved with any and all staff recommendations. There will not be separate discussion of these items. If
any Commissioner desires to discuss an item on the Consent Agenda it will be moved to the Regular Agenda
for further consideration.

3.2 Consideration, discussion and possible action on a Final Plat for Bentwood Estates Phase 2 in
the City's ETJ consisting of 48 lots on 127 acres generally located 3.5 miles south of
Wellborn on FM 2154. (03 -276)
This building is wheelchair accessible. Handicapped parking spaces are available. Any request for sign interpretive service must

3.3 Consideration, discussion, and possible action on a Final Plat for Lots 1 through 20 of the

subdivision is located aproximately 3.5 miles south of Wellborn on FM 2154 north of

3.4 Consideration, discussion, and possible action on a Preliminary Plat for the USDA
Subdivision consisting of 14.62 acres of the Morgan Rector Survey Abstract No. 46 generally
located on the north side of Holleman approximately 850' northeast of the
Dartmouth/Holleman intersection. (03 -279)
3.5 Consideration, discussion and possible action on a Vacating and Final Plat for Lot 1, Block 1
(Cinemark) and a Final Plat for Lot 2, Block 1 (Rear Parking) of the Gateway Park

9. Discussion and possible action on future agenda items — A Planning and Zoning Member may inquire
about a subject for which notice has not been given. A statement of specific factual information or
the recitation of existing policy may be given. Any deliberation shall be limited to a proposal to
place the subject on an agenda for a subsequent meeting.

The Planning and Zoning Commission may seek advice from its attorney regarding a pending and contemplated litigation subject
or attorney -client privileged information. After executive session discussion, any final action or vote taken will be in public. If
litigation or attorney- client privileged information issues arise as to the posted subject matter of this Planning and Zoning
Commission meeting, an executive session will be held.

SUBJECT: GATEWAY PARK (FP)(2) - Final Plat
Staff reviewed the above - mentioned final plat as requested. The following page is a list
of staff review comments detailing items that need to be addressed. If all comments
have been addressed and the following information submitted by Monday, November
10, 10:00 a.m., your project will be placed on the next available Planning and Zoning
Commission meeting scheduled for, November 20, 2003 7:00 p.m. in the City Hall
Council Chambers, 1101 Texas Avenue.
Two (2) copies of the revised final plat;
One (1) Mylar original of the revised final plat; and
One (1) copy of the digital file of the final plat on diskette or e-mail to
nmanhart@ci.college-station.tx.us
Upon receipt of the required documents for the Planning & Zoning meeting, your project
will be considered formally filed with the City of College Station. Please note that if all
comments have not been addressed your project will not be scheduled for a Planning &
Zoning Commission meeting. Your project may be placed on a future agenda once all
the revisions have been made and the appropriate fees paid. If you have any questions

The comments are related to the plat only. Site Plan and Engineering comments will be
returned separately.
ENGINEERING
1. Change "Electric Easement" to PUE. The City does not accept single utility
easements.
2. Realign drainage easement on Lot 2. Curved storm sewer is not in accordance with
City ordinance and will not be accepted. Technically, if the intention is to remove the
original 40 -ft drainage Easement on Lot 2, include it in the dark, bold outline of the
vacating plat. That way it will be part of the vacation.
3. Label the bottom plat as FINAL PLAT only and change title block accordingly.
Technically there is no replat occurring with this document.
4. The easement your are trying to vacate, L48, L49, L50, covers a fire hydrant and
can not be vacated.
5. Change "Public Utility and Access Easement" to "Access and Public Utility
Easement ". The City does not wish to accept any implied responsibilities with the
dedication of a Public Access Easement. No access easement has been requested
by th City on this project.

ELECTRICAL
1. Developer installs conduit per city specs and design.
2. Developer provides 30' of #4 rigid conduit for riser poles. Developer installs
first 10'. City installs remainder.
3. Developer pours transformer pad(s) per city specs and design.
4. Developer installs pull boxes as per city specs and design.(pull boxes
provided by the city.
5. Developer provides digital AutoCAD 2002 version of plat and /or site plan.
