Parkland Dedication: Fee in lieu of land dedication in the amount of $2,021.00 is due
prior to filing the final plat.
REVIEW CRITERIA
Compliance with Subdivision Regulations:
In older subdivisions, such as College Park, the City recognizes properties held under
common ownership prior to July 15, 1970 as the lot of record and as one building plot.
The subject property has been shown to be under the same ownership since before
July 15, 1970, and therefore meets this criterion.
Section 8.2.A.11.b.2.(b) of the Unified Development Ordinance states that a plat which
creates an additional lot or building blot must meet or exceed the average width of the
lots along the street frontage, for all lots in the block and contain at least 8,500 square
feet of space for each lot.
The proposed final plat requires a variance to Section 8.2.A.11.b.2.(b) of the Unified
Development Ordinance, regarding lot width standards and minimum lot size
requirements for replatting in older subdivisions. The two lots being created would
require a variance of 2,500 square feet to the minimum lot size standard, as well as a
variance of 20 feet to the average lot width requirement (the average lot width for Block
3 of the College Park Subdivision is 70 feet).
In accordance with the Subdivision Regulations, when considering a variance, the
Planning and Zoning Commission should make the following findings to approve the
variance:
1) That there are special circumstances or conditions affecting the land involved
such that strict application of the provisions of this chapter will deprive the
applicant of the reasonable use of his land;
A special condition does not exist which deprives the applicant reasonable use of
the property.
2) That the variance is necessary for the preservation and enjoyment of a
substantial property right of the applicant;
