This is to notify you that the City of College Station is considering a Replat request
for the following property:

The Planning and Zoning Commission will hold a public hearing on Thursday,

212.014 Replatting Without Vacating Preceding Plat
A replat of a subdivision or part of a subdivision may be recorded and is controlling
over preceding plat without vacation of that plat if the replat:
(1) is signed and acknowledged by only the owners of the property being
replatted.
(2) is approved, after a public hearing on the matter at which parties in interest
and citizens have an opportunity to be heard, by the municipal authority
responsibility for approving plats; and
(3) does not attempt to amend or remove any covenants or restrictions.

COUNTY OF BRAZOS j TWOVI ALL M BY THESE PRESENTS: That the College Station
Housing Corporation a private corporation, duly incorporated under and by virtue of the
laws of the State of Texas, acting by and through F. B. Clark its President, and M.C.
Hughes its Seoretary-Treasurer, of the County of Brazos, State of Texas for and in con-
sideration of the sum of Twenty Two hundred dollars ($2200).Doll8ra to it cash in hand
paid and secured to be paid by Mr. J.S. Rogers the receipt of which is hereby acknow-
ledged, as follows:
One hundred dollars in cash, and vendor's lien note for($2100) twenty one hundred
dollars payable as follows: Beginning with the first day of November after date,
fifty dollars ($50) monthly for six successive months, and thereafter thirty dollars ($30)
monthly for seventy-four months and finally a seventy-fifth payment of eleven dollars and
ninety-six cents ($11.96). The above payments are due on or before the first day of each
successive month until the principal and interest at the rate of 6% per year have been
extinguished. If payments vary from the above schedule, any amount left over after deduc-
tion for accumulated interest will be applied on the principal.
have Granted, sold and conveyed, and by these presents do Grant, Sell and convey, unto the
said Mr. J. S. Rogers of the County of Brazos State of Texas all that certain tract or
parcel of land lying and being situated in the County of Brazos, State of 'T'exas, and more
particularly described as follows to-wit: Being, Lot Numbered 3 in Block numbered 3
in the plan of 0011ege Park, Southeast of the A. & M. College Campus, as plotted by Martin
and Calvin, Surveyors, and r. W. Hensel, L.A., and recorded in the Deed Records of
Brazos County,Texas, in Volume 38, pages 602-0$, and being 50 feet wide, facing Fairview
Avenue on the east.
This deed is granted with the following limitations:
1. The improvements in College Park to be made at the expense of The Southaide
Development Company are as follows, to-wit: (1) Extension of water and liC,hts to the pro-
party line of each lot; (2) opening up and grading, but not gravelling, of the drives,
streets and avenues as plotted in the map of College Park; (3) construction of a sewage
disposal plant and the provision of a sewerage system sufficiently large to accomodn.te all
bona fide residents of ''ollege Park.
The company does not guarantee to dispose of sewage except such as runs out of a
properly constructed septic tank located on the property transferred.
The company retains title to all light lines, sewer lines, and water lines, except su
as are constructed at the exprense of the property owner within the limits of areas trans-
ferred.
2. No out-door toilet shall be allowed on any lot in College Park.
3. The lay-out of the lots as shown in the plan of College Park shall be adhered to
and no scheme of facing lots in any other direction shall be permitted.
4. No use shall be made of the property hereby conveyed, or any part thereof,.whioh
shall constitute a nuisance or injure the value of neighboring lots. The question of de-
termining what shall constitute a nuisance shall rest with the board of directors of The
Southside Development Company.

5. the general landscape plans, such as location of houses, location of flower beds

trimming of trees, planting of shrubbery eto., shall be in accordance with such standard
authority as shell be acceptable to the board of directors of The Southside development
Company.
6. The Company reserves the right in fee in all streets, alleys, end sidewalks, to ti
the same for pavements, railways, gas and water mains, sewer pipes, electric lights, tele-
grcpU and telephone wires, and such other reasonable uses as the company may see fit.
f 7. No house shall be built closer to the street then twenty feet..
g 8. Churches, stores, theatres, school houses, and other central meeting places shall
be constructed only on lots provided in the plan for establishments of that kind unless
h agreed to by the board of directors of the said company.
E 9. No house, with the exception of wood-sheds, garages, and similar supplementary
buildings shall be constructed in College Park the plans of which have not been drawn or
approved by an architect acceptable to the board of directors of The Southside Development
Company.
10. At the expiration of three years from the date of sale of any lot in College
Park, The Southside Development Company reserves the right to buy back at the,orieinal pur
oht.se price, without interest, any lot the owner or owners of which can not show bona fide
evidence of utilization to some social or individual end other than that of merely holding
the lot for increase in value.
The above limitations are subject to the rights and duties growing out of the transfe:
of the Utility lines by The Southside Development Company to the City of College Station
Texas, and The College Station Housing Corporation is bound thereby.
TO HAVE AND TO HOLD the above described premises, together with all and singular,
the rights and appurtenances thereto in anywise belonging unto the said Wr. J.S.Rogers
heirs and assigns forever; and said The College Station Housing Corporation does her<by
bind itself, and its successors, to Warrnnt and Forever Defend, all and singular the said i

premises unto the said gro ntee, heirs and assigns, against every person whomsoever law-
fully claiming or to claim the same, or any part thereof.
But it is expressly agreed and stipulated thnt the Vendor's Lien is retained against
the above described property, premises and improvements, until the above described note,
and all interest therein are fully paid according to its f::ce and tenor, effect and read-
ing, when this deed shall become absolute.

knowledged, as follows: One thousand dollars ("'1,000) in cash, and a vendor's lien
note for twelve hundred dollars (,1 200) payable in regular monthly installments of
thirty dollars ("'30) each, due on or before the first day of each month after date with
interest at the rate of 6% on unpaid balances until paid.

the said Mr. M. C. Hughes of the County of Brazos State of 'Texas all that certain tract
or parcel of land lying and being situated in the County of Brazos, State of Texas, and
more particularly described as follows, to-wit: Being, Lot Numbered five in 'lock numbered
eleven in the plan of College PArk,oSoUthaast of the A. & M. College Campus, as plotted
by Martin and Calvin, Surveyors, and F. W. Hensbl:, L.A., and recorded in the Deed
Records of Brazos County,Texas, in Volume 38, pages 602-05, and being 50 feet wide,
facing Ayreshire Street on the east.
This deed is granted with the following limitations:
1. The improvements in Oollege Park to be msde at the expense of The Southside
Development Company are as follows, to-wit: (1) Lxtension of water and lights to the
property line of each lot; (2) opening up and grading, but not gravellinC, of the
drives, streets and avenues us plotted in the map of Uollege Park;
(3) construction
of a sewage disposal platn and the provision of a sewerage system sufficiently large
to acoomodate all bona fide residents of College Park.
The company does not guarantee to dispose of sewage except such as runs out of
properly constructed septic tank located on the property transferred.
The company retains title to all light lines, sewer lines, and water lines, ex-
cept such as are constructed at the expense of the property owner within the limits of
areas transferred.
2. No out-door toilet shall be allowed on any lot in Uollege Park.
3. The lay-out of the lots as shown in the plan of Uollege Park shall be adhered to
and no scheme of facing lots in any other direction shall be permitted.
4- No use shall be made of the property hereby conveyed, or any part thereof,
which shall constitute a nuisance or injure thevalue of neighboring lots. The question
of determining what shall constitute a nuisance shall rest with the board of directors
of The Southside Development Company.
5. The general landscape plans, such no location of houses, location of flower
