This responds to your letter requesting that the U.S, Fish and Wildlife Service (Service) review
potential impacts to federally listed or proposed threatened and endangered species, to
designated Critical Habitat, and to migratory birds that may occur as a result of the proposed
construction of the following communications tower site in Texas:
The new construction of a 120 -foot monopole communications tower at 114 Holleman
Drive in College Statiun, Brazos County, Texas.
Threatened and Endangered Species
Due to staffing constraints and the large volume of requests we are receiving to review cellular
and other types of communications towers and associated structures, we are no longer able to
review and respond to each individual request for potential impacts to federally listed threatened
and endangered species and their habitat, wetlands, migratory birds, and other fish and wildlife
resources, Under the Endangered Species Act, it is the responsibility of the Federal action
agency (Federal Communications Commission in this case), or its designated representative, to
determine whether actions authorized, filnded, or otherwise carried out by those agencies "may
affect" federally lasted endangered, threatened, or proposed species.
We therefore recommend that your firm assess the potential of individual communications
projects to, affect federally listed and proposed species. For your general information, you may
access a complete list of federally listed or proposed species by county of occurrence in Texas at
htMp // ifw2es .fws,gov/EndangeredSpe.cies. A qualified biologist should use this and other current
information to determine if a proposed project "may affect" listed species. If your assessment of
the proposed project indicates that no effects to listed species are likely, no coordination with
this office would be necessary_ However, you should maintain a complete record of the
assessment, including the steps leading to your determination of effect, the qualified personnel
conducting the assessment, habitat conditions on -site, etc. Should your determination indicate
that the proposed project "may affect" federally listed species, this office should be contacted for

further evaluation of the project. Please note that this office will continue to review all proposed
communications projects on an individual basis which occur in Bastrop County due to their
potential impacts to the endangered Houston toad (Bufo houstorresis) and projects occuring in _
Bexar, Travis, and Williamson Counties due to their potential impacts to endangered karst
invertebrates.
There are some types or categories of communications projects that may be assumed to have no
effect on federally listed species or other resources under jurisdiction of the U. S. Fish and
Wildlife Service. Therefore, there is no need for you to contact us about these types of actions, -
as listed below:
• Projects that do not involve new construction activities or soil disturbance.
Construction of new towers or the placement of antennae assemblies which are
co- located with an existing structure (tower, building, water tank, smokestack,
etc., but not a small building in otherwise undisturbed habitat).
Routine maintenance of existing tower sites, such as painting, antenna or panel
replacement, upgrading of existing equipment, etc_
Repair or replacement of existing towers and/or equipment, provided such
activities do not significantly increase the existing tower mass and height, require
the addition of guy wires, or increase the size or location of the existing pad site
or equipment shelter.
For those proposed projects that do not meet these criteria (e.g. new tower sites on undeveloped
land), an assessment using appropriate biological expertise should be conducted to determine the
potential of the proposed project to affect federally listed species, as detailed above.
We recommend that all proposed communications projects be located in previously cleared
areas, urban or suburban developed areas, road or utility right -of -way, fallow fields or
pastures, landscaped areas, or essentially any area that has already been disturbed and would
require little or no clearing of native vegetation. Locating communications projects in these
previously disturbed or developed areas should not only save your clients time and money,
many of the threatened or endangered flora and fauna are associated with relatively
undisturbed areas or sites where remnant pockets of native vegetation and/or wetlands are
present. Therefore, projects located outside of or far from these areas are significantly easier
to determine if endangered species or their habitat could be potentially impacted by proposed '-
development activities.
Wetlands- and Wildlife Habib
Wetlands and riparian areas are high priority fish and wildlife habitat, serving as important
sources of food, cover, and shelter for numerous species of resident and migratory wildlife.
Waterfowl and other migratory birds use wetlands and riparian corridors as stopover, feeding,

and nesting areas. We strongly recommend that the sites selected for communications towers
and other projects not irppact wetlands and riparian areas, and be located as far as practical from
these areas. Migratory birds tend to concentrate in or near wetlands and riparian areas and use _
these areas as migratory flyways or corridors, which could potentially exacerbate the
documented problem of birds being killed by flying into and striking the communications
towers. 9 after every effort has been made to avoid impacting wetlands, you anticipate
unavoidable wetland impacts will occur, you should contact the appropriate U.S. Army Corps of
Engineers office to determine if a permit is necessary prior to commencement of construction
activities_ _.
NCAratory Birds
The Service recommends that communications tower companies co- locate new communications
devices on existing towers or other existing structures whenever possible to limit the amount of
airspace and landscape impacted by communications towers_ Secondarily, we recommend that
self-supported towers (e.g. lattice) or monopole towers be used instead of guyed towers, as

Communications Towers and Migratory Birds
The population levels of many of North America's migratory birds have declined dramatically
throughout the latter half of the 20* century, causing grave concern among land managers and
biologists. These declines are thought to be due mainly to human- induced factors, such as
habitat destruction, habitat fragmentation, pesticide use, and shooting. While some of these
factors, such as pesticide use and uncontrolled shooting have decreased in the past few decades,
other negative factors have been on the rise. The explosive growth of the communications tower
industry, as well as unabated habitat loss due to development, are likely two of the more recent
causes for the continuation in the decline of many migratory birds.
The Service is becoming increasingly concerned about the effect of communications towers on
migratory birds, particularly guyed towers and towers over 200 feet tall. All native migratory
birds (e.g., waterfowl, shorebirds, birds of prey, song birds, etc.) are afforded protection under
the Migratory Bird Treaty Act (40 Stat. 755; 16 U.S.C. 703 -712)_ Communication towers and
antennas may pose a hazard to migratory birds in flight and may pose a threat to nesting birds
attracted to the site, depending tower and site characteristics. Tower characteristics, such as
beight, physical design (e.g. guyed, self supporting lattice, or monopole), lighting, and site
location are factors in the equation concerning tower - induced bird mortality. Towers exceeding
200 feet in height and particularly towers that are supported by guy wires are expected to have a
greater impact on migratory birds than shorter, free - standing towers and co-located towers.
Research and monitoring efforts have indicated that communication towers may be taking a
devastating toll on our continent's migratory birds. A study by Banks (1979) estimated that 1.2
million birds were killed by communications towers across the United States each year between
the mid- -1970s and early 1990s wbeu new tower construction (200 feet tall or higher) was
proceeding at the rate of about 1,000 per year. There have been documented occurrences of
hundreds or thousands of birds colliding into towers in single events during peak migration
periods. The most devastating bird -tower collisions usually have occurred at night during
conditions of low visibility, though large numbers of birds have also collided with towers at
night during clear weather and during the day under foggy conditions. There are also
documented occurrences of birds congregating around towers with aviation warning lights while
migrating at night during inclement weather. During these events, birds apparently have become
disoriented by the tower lights and have repeatedly circled the towers until they collided with
guy wires, each other, or the ground, or died from sheer exhaustion_ Due to the growth of the
cellular phone and Personal Communication Service (PCS) industry, it is now estimated that
new tower, construction (over 200 feet) has accelerated to over 5,000 per year, so it is likely that
bird mortality due to collisions with towers will only increase in the foreseeable future

A Communications Towers 'Wor icing Group composed of government agencies, industry,
academic researchers, and non - governmental organizations has been formed to develop a
research protocol to study the problem of bird -tower strikes and to determine how to best
construct and operate towers to minimize bird strikes_ Until the research studies are completed,
the Service recommends the enclosed guidelines be used to reduce the impact of
communications towers on migratory birds protected under the Migratory Bird Treaty Act and

the Endangered Species Act. In order to obtain information on the usefulness of these guidelines
in preventing bird strikes, and to identify any recurring problems with their implementation
which may necessitate modifications, please advise us of the final location and specifications of _
the proposed tower, and which of the measures recommended for the protection of migratory
birds were implemented. If any of the recommended measures can not be implemented, please
explain why they were not feasible,
The Service requests that an E"ronmental Assessment (EA) be prepared for all proposed
towers that may pose a hazard to migratory birds. This includes all towers over 200 feet in "
height proposed in migratory bird concentration areas. The EA should include an analysis-of
alternatives, including those identified above, and an analysis of the cumulative effects of
existing towers in the area. Direct and indirect impacts of towers and associated facilities
(including roads) to migratory birds and other wildlife and flab and their habitats should also be
addressed as appropriate. With regard to birds, the geographic scope of the EA should include
the migratory corridor, and the towers in that corridor should be considered by height class and
type. The EA, should be seat, along with the project proposal, to the Service Office responsible
for evaluating the project.
Informiation on tower kills, including mechanisms, studies, literature, bibliographies, legislation,

good discussion on the effects of lighted structures and migrating birds can be found in the 1996-
publication by the World Wildlife Fund and the Fatal Light Awareness Program, Collision
Course: the hazard of lighted structures and windows to migrating birds. In addition, a
bibliography on bird kills at towers and other man -made structures can be found at the website,
http:// www. fws .govlr9mbmolissuesltmver_htmi. The Service's Migratory Bird Management
Office maintains this annotated document to increase public awareness of the potential impacts
of towers and other than -trade structures by highlighting some of the pertinent literature on the
subject.

Service Interim Guidelines For Recommendations On
Communications Tower Siting, Construction, Operation, and Decommissioning
1. Any company /applicant/licensee proposing to construct a new communications tower is strongly -
encouraged to collocate the communications equipment on an existing communication tower or
other structure (e.g.. billboard, water tower, or building mount). Depending on tower load factors,
from 6 to 10 providers may collocate on an existing tower.
2. if collocation is not feasible and a new tower or towers are to be constructed, communications
service providers are strongly encouraged to construct towers no more than 199 feet above ground
level (AGL), using construction techniques which do not require guy wires (e.g., use a lattice
structure, monopole, etc.). Such towers should be unlighted if Federal Aviation Administration
regulations permit.
3. If constructing multiple towers, providers should consider the cumulative impacts of all of those
towers to migratory birds and threatened and endangered species as well as the impacts of each
individual tower.
4. If at all possible, new towers should be sited within existing "antenna farms" (clusters of towers).
Towers should not be sited in or neat wetlands, other known bird concentration areas (e.g., state or
Federal refuges, staging areas, rookeries), in known migratory or daily movement flyways, or in —
habitat of threatened or endangered species. Towers should not be sited in areas with a high
incidence of fog, mist, and low ceilings.
5. If taller ( >199 feet AM) towers requiring lights for aviation safety must be constructed, the
minimum amount of pilot warning and obstruction avoidance lighting required by the FAA should be
used. Unless otherwise, required by the FAA, only white (preferable) or red strobe lights should be
used at night, and these should be the minimum number, minimum intensity, and minimum number
of flashes per minute (longest duration between flashes) allowable by the FAA. The use of solid red
or pulsating red warning lights at night should be avoided. Current research indicates that solid or
pulsating (beacon) red lights attract night - migrating birds at a much higher rate than white strobe
lights. Red strobe lights have not yet been studied.
6_ Tower designs using guy wires for support which are proposed to be located in known raptor or
waterbird concentration areas or daily movement routes, or in major diurnal migratory bird
movement routes or stopover sites, should have daytime visual markers on the wires to prevent
collisions by those diurnally moving species. (For guidance on markers, see Avian Power Line
Interaction Committee (AMC). 1994. Mitigating Bird Collisions with Power Lines: The Store of --
the Art in 1994. Edison Electric Institute, Washington, D.C., 78 pp, and Avian Power Line
Interaction Committee (APLIC). 1996. Suggested Practices for Raptor Protection on Power Lines.

7. Towers and appendant facilities should be sited, designed and constructed so as to avoid or
minimize habitat loss within and adjacent to the tower "footprint ". However, a larger tower footprint

is preferable to the use of guy wires in construction. Road access and fencing should be minimized
to reduce or prevent habitat fragmentation and disturbance, and to reduce above ground obstacles to
birds in flight.
8. If significant numbers of breeding, feeding, or roosting birds are known to habitually use the
proposed tower construction area, relocation to an alternate site is recommended. If this is not an
option, seasonal restrictions on construction may be advisable in order to avoid disturbance during
periods of high bird activity.
9. In order to reduce the number of towers needed in the future, providers should be encouraged to
design new towers structurally and electrically to accommodate the applicant/lieensee's antennas and
comparable antennas for at least two additional users (minimum of three users for each tower
structure), unless this design would require the addition of lights or guy wires to an otherwise
unlighted and/or unguyed tower.
10. Security lighting for on- ground facilities and equipment should be down - shielded to keep light
within the boundaries of the site-
11. if a tower is constructed or proposed for construction, Service personnel or researchers from the
Communication Tower Working Group should be allowed access to the site to evaluate bird use,
conduct dead -bird searches, to place net catchments below the towers but above the ground, and to
place radar, Global Positioning System, infrared, thermal imagery, and acoustical monitoring --
equipment as necessary to assess and verify bird movements and to gain information on the impacts
of various tower sizes, configurations, and lighting systems.
12. Towers no longer in use or determined to be obsolete should be removed within 12 months of
cessation of use.

general public, is not for publication or for use in public documents, and is for your company's
use only. Site location information is protected by the National Historic Preservation Act of 1966 "
Title III, Section 304 and by Section 191.004 of the Antiquities Code of Texas. If you have

Our research has determined that in the proposed delineated project area, there is one site.
41BZ127, located approximately 655 feet southwest of the Southern Pacific Puri! Line. More
information about this site is available upon request. No sites in the project area are registered as
State Archeological Landmarks (SAL) or listed in the National Register of Historic Places.
Although no sites have been recorded in the main area of this project, this does not mean sites are
not present. The lack of recorded prehistoric or historic remains may indicate that this project is
in an area not yet explored for sites or that the sites may not be visible on the modern ground
surface.
You need to contact the Archeology DivLnion at the Texas Historical Commission (512 -463-
6096) who handles regulatory and permitting details, provides comments, and makes
decisions regarding archeological work. Also, for the most up to date information
concerning properties bsted in the National Register of E istoric Places, please contact the

Phase 1 (ESA) on the above referenced property (Subject Property). The Subject
Property is under consideration for a communication tower for Cingular Wireless
on approximately 2,500 square foot tract of land.
Currently, the Subject Property is undeveloped_ Past usage of the subject
property has been as pastureland. Past usage of the adjoining properties has
been as either commercial or residential properties. To the north of the Subject
Property is a corrugated metal building occupied by CC Creations and a Sports
Store. To the east is undeveloped land and residential properties. To the south
is undeveloped land. To the west is undeveloped land and storage unit
buildings.
The Area of Potential Effect (APE) consists of a one-half mile radius outward
from the Subject Property. A historic resource survey was conducted of an area
one -half mile in radius from the proposed tower site as part of our environmental
review process for the project. As part of the historic resource survey, LFC
reviewed database records from the Texas Historical Commission's website

this review and a visual survey of the area, the 1972 aerial photograph depicts
the subject property as being undeveloped. The surrounding area is mostly
developed with residential properties. The 1989 aerial photograph depicts the
subject property developed with the metal building and the tower site
undeveloped. The area surrounding the subject property shows development of
mostly residential properties. The location of the Subject Property is shown on
the attached 1961 (photorevised 1980) USGS Wellborn, Texas quadrangle map.
Photographs of the Subject Property and representative views of the surrounding
area are provided for documentation purposes (Photos 1 -12).
As per Section 106 of the National Historic Preservation Act, LFC requests that
the following statements be confirmed in regard to the above referenced site and
the area within the one -half mile of the Subject Property:
a. This facility will not affect districts, sites, buildings, structures, or objects
listed, of eligible for listing in the National Register of Historic Places.

prevent the lots from being subdivided (See Attachment and pictures of area).
This area is not listed with the state or federal government.
It is LFC's opinion that no National Register eligible properties are in the project
area (1/2 mile).

Good Evening. My name is Jennifer Flanery, Staff Planner.

This is the same case that came before you on September 5 It was tabled
at that time so that staff could inform the First United Methodist Church of
the proposed tower. I have met with representatives from the church and
they expressed no objections to the proposed tower or its location.
For the benefit of the audience, since this is a new public hearing, I will
briefly go through the presentation again.
The proposed cell tower will be 118 feet tall and will be located behind the
CC Creations building and the Red Oak Sportswear Building, at 112
Holleman Drive.
I am recommending approval of the conditional use permit
R -1 Picture:
This is a picture of the site looking toward the R -1 zoned property to the
south that recently received a Conditional Use Permit for First United
Methodist Church.
R -2 Picture:
This picture is looking east toward the R -2 zoning district. The proposed
cell tower meets all setbacks and separation distances from these two
residential zoning districts.
Wellborn Picture:
To the west of the property is a C -1 zoning district developed as a mini
storage ... this is a view looking toward Wellborn road.
Holleman Picture:
and to the north is Holleman Drive. From the pictures you can tell that there
is a natural "buffer" on all sides of the CC Creations property. The cell
tower equipment will also be surrounded by a Cedar screening fence and
landscaping.
Conditional Uses may be permitted by the Commission after a public
hearing and after it is determined that the project complies with development
regulations, and will not harm the surrounding neighborhood, occupants, or
property.
In addition, with a cell tower the commission should consider aesthetics,
proximity to residences, economic impacts, ingress and egress.

I have not received any inquiries about this proposal. However, as I
mentioned earlier I did speak with representatives from the adjacent First

PLATTING AND REPLATTING WITHIN OLDER RESIDENTIAL
SUBDIVISIONS
18-A. In addition to the other provisions of this ordinance, no application for plat, replat, vacating
and resubdivit ing plat or other plat Mended to provide for the resubdivision of an existing lot
or lots in a residential subdivision created prior to July 15, 1970, may be considered for
approval unless:
18-A.1 The plat does not create an adddional lot or building plot.
18-A.2 A plat which does create an additional lot or building plot must meet or
exceed the average width of the lots along the street frontage, for all lots in
the block and contain at least 8,500 square feet of space for each dwelling
unit
For the purpose of this section, a lot shall be defined to include the lot, lots
and/or portions of lots that have been combined and used as a residential
plot, as of the effective date of this ordinance.
18 -A.3 This moratorium on an application for a Change to a plat shall apply to the
following areas:
Area A - An area bounded by Texas Avenue, Holleman Drive, Glade
Avenue, Southwest Parkway, Wellborn Road and George
Bush Drive and reflected in Illustration A below. -
