Item: Public hearing, discussion, and possible action on a Conditional Use
Permit for the Southland #517 Wireless Telecommunications Transmission
Tower located at 112 Holleman. (02 -118)
Applicant: Cingular Wireless
Staff Recommendation: Staff recommends approval of the Conditional Use
Permit as submitted.
Item Summary: The applicant is requesting a Conditional Use Permit in order to
erect a new 118 -ft. tower behind CC Creations on Holleman Drive. Access to
the site will be taken from a driveway off of the Private Access Easement from
Holleman that runs between the CC Creations building and CC Creations
eastern property line.
The property is currently zoned C -2 Commercial Industrial. The proposed tower
meets the separation requirement for WTFs, setback from the right -of -way,
setback from residential structures, and setback from an R -1 Single Family
Residential zoning district and an R -2 Duplexes zoning district as set forth in the
Zoning Ordinance. The new tower will be large enough for the co- location of
other antennas.
Comprehensive Plan Considerations: The Land Use Plan shows this area to
be High Density Single Family Residential. Holleman Drive is classified as a
minor arterial on the Thoroughfare Plan.
Item Background: The property was annexed into the City in 1956. The
property was rezoned from R -2 Duplex to C -2 Commercial Industrial for the
development of CC Creations in 1988. The proposed tower's lease space is
located in the Regency Square Subdivision that was originally platted in 1983
and replatted in 1988 and in May of 2002.
The Planning and Zoning Commission recently approved a Conditional Use
Permit for the First United Methodist Church on Wellborn Road, which is located
directly to the south of the subject property in the Single Family zoning district.
Staff Analysis: In addition to the standard CUP guidelines (described below),
the Commission shall consider the following additional factors when determining
whether to grant a CUP for a telecommunication facility:

1. Height of the proposed tower, surrounding topography and surrounding tress
coverage and foliage as they relate to:
a. Skyline impact, examining whether the proportions of the structure
appears to dominate or blend in with the surrounding environment and
b. Shadow impact, whether or not the proposed tower will cast shadows that
would prevent the reasonable use of enjoyment or surrounding properties.
Design of the tower, with particular reference to design characteristics that
have the effect of reducing or eliminating visual obtrusiveness.
3. Proximity of the tower to residential structures and residential district
boundaries.
4. Economic impact on adjacent and nearby properties.
5. Proposed ingress and egress.
6. Availability of suitable alternatives and /or existing support structures.
Section 14 of the Zoning Ordinance authorizes the existence of conditional uses.
The Commission may permit a conditional use subject to appropriate conditions
and safeguards, when after public notice and hearing the Commission finds that:

1. "The proposed use meets all the minimum standards established in the
ordinance for the type of use proposed."
2. "That the proposed use meets the purposed and intent of the ordinance and
is in harmony with the development policies and goals and objectives as
embodied in the Comprehensive Plan for Development of the City. The
comprehensive Plan designates this area as high- density single family
residential. Cell Towers are not allowed in residential zoning districts.
However, the current zoning is C -2 Commercial Industrial, and the land is
already developed as such. The Comprehensive Plan is a long range plan,
whereas the technology of wireless transmission towers may not be. It is not
foreseen that this area will redevelop in the near future.
3. "That the proposed use will not be detrimental to the health, welfare, and
safety of the surrounding neighborhood or its occupants, nor be substantially
or permanently injurious to neighboring property." The public hearing is an
opportunity for the Commission to measure the potential impact on
surrounding land uses.
The Commission may impose additional reasonable restrictions or conditions to
carry out the spirit and intent of the ordinance and to mitigate adverse effects of
the proposed use. These requirements may include, but are not limited to,
increased open space, loading and parking requirements, additional

landscaping, and additional improvements such as curbing, sidewalks and

1. Approval as submitted;
2. Approval with conditions relating to specific site characteristics or with time
limitations;
3. Denial with specified reasons for denial;

The church is currently under construction.
A public hearing was held on this item at the September 5 2002 Planning and
Zoning Commission meeting. At that time there was concern expressed by
several Commissioners that the First United Methodist Church might not have
been notified of the proposed tower. The item was tabled in order for staff to

meet with representatives of the Church to inform them of the proposal and to
report to the Commission any concerns that the Church may have had.
Since that ti aff has met with representatives of the First United Methodist
Church an show them the proposal of the cell tower. The Church
representati ad no objections to the proposed tower or its location.
Because the public hearing was closed at the September 5 meeting the
opinions of the Church were not able to be presented to the Commission on
September 19th. This item was tabled for re- notification for a new public hearing
at the September 19, 2002 meeting so that the Commissioners would be able to
hear the comments of the Church.
