Following this coversheet is a copy of the Staff Report that was prepared for the following
project. Please keep in mind that stars responsibility is to provide the Planning & Zoning
Commission with all pertinent facts of a development case, but that staff is not acting as an
advocate for the applicants. Therefore, it is in the applicant's best interest to send a
representative to the Planning & Zoning Commission meeting to speak on behalf of the
proposal.
This item is scheduled for the Thursday, July 1, 2002 Planning & Zoning Commission
Meeting. This meeting will begin at 6:00 P.M. in City Hall Council Chambers. I have

Item: Public hearing, discussion, and possible action on an ordinance
amendment for a rezoning of approximately 17.22 acres located along Arnold
Road from A -O, Agricultural Open to R -1, Single Family Residential. (02 -109)
Applicant: Municipal Development Group
Staff Recommendations: Staff recommends approval of the rezoning.
Item Summary: The applicant is requesting this rezoning to enable development
of the property. The property to the southwest and northwest of the subject
property is zoned R -1. The majority of it is developed as the Southwood Athletic
Complex and a portion of it is developed as the Sun Meadows Subdivision. To
the northeast the property is zoned R -4 and developed as a hospital complex,
The Med. Property to the southeast of the subject property is zoned A -O; the
majority of it is vacant with a few rural residences, while a portion of it is
developed as the City's Utility Service Center.
Arnold Road has recently been improved and extended through the adjacent
development, Sun Meadows, to the edge of the subject property. In order to
provide access to this site, by continuing Arnold Road and complying with the
Thoroughfare Plan, some off -site improvements will be required because a
portion of the road right -of -way is off -site. Due to a recent amendment to the
Subdivision Regulations, the property must connect to paved, public right -of -way
in order for the property to develop. This requirement will be addressed at the
platting stage.
Comprehensive Plan Considerations: As the Commission is aware rezoning
requests are evaluated on two main sets of criteria. The first criterion is
compliance with the Comprehensive Plan, including the Land Use and
Thoroughfare Plans, etc. Second, a proposed rezoning is evaluated based on
the conditions in the area, including the potential increase in negative impacts
into the public infrastructure.
The Land Use Plan shows this area as Medium Density Single Family, with a
corresponding density of 3 -6 dwelling units per acre. The R -1 zoning requested
does comply with the Land Use Plan.

Initial access to the site would be from Arnold Road, which is shown on the
Thoroughfare Plan as a minor collector. Because of the recent Subdivision
Regulation amendment the Arnold Road street infrastructure will either be
required to be improved prior to subdivision of the property or shown as part of
the internal circulation system on the plat. The Thoroughfare Plan currently
shows Arnold Road along the property lines of the subject property from the
southern corner to the northeast property line where it would tie into another
minor collector that is shown north -south from Rock Prairie through the Med,
along this property line, and to Graham Road through the Utility Service Center
site. This requirement will also be addressed at the platting stage. Once the
entire road system for the area is built out, access to the subject property will be
via this collector system and via the Arnold / Schaffer system that was recently
constructed.
Item Background:
The subject property has been in the City's ETJ since approximately 1971.
When annexation occurred in 1993, the tract was brought into the City under the
A -O, Agricultural Open, zoning district. Platting of this tract has not yet occurred.
The applicant requested a rezoning of this property to R -1 and C -1 in April of this
year. Staff recommended denial of the request because of concerns with the
lack of access for the commercial development and because of inadequate
street infrastructure because we were unable to require that Arnold Road be
improved before the Subdivision Regulation amendment occurred. The request
was denied without prejudice by the Planning and Zoning Commission and the
City Council due to infrastructure constraints and the potential negative impact of
commercial traffic accessing through a residential subdivision. This decision was
made prior to the Subdivision Regulation amendment.
A request for a rezoning of 7.76 Acres along Arnold Road has also been
submitted and is under consideration.
Related Advisory Board Recommendations:
A requirement during the platting of the property is that the Parks Board review
the parkland dedication proposal of the developer, whether it is for land
dedication or fee in lieu of land. The current development fee is $309 and the fee
in lieu of land dedication amount that may be required is $148 for each R -1 lot
with final platting. If platting occurs after July 10 the new parkland fees will
apply.
Commission Action Options: The Commission acts as a recommending body
on the question of rezoning, which will be ultimately decided by City Council.
The Commission options are:
1. Recommend approval of rezoning as submitted;
2. Recommend a less intense zoning classification;

5. Defer action to a specified date.

INFRASTRUCTURE AND FACILITIES
Water: Sun Meadows Subdivision Phase 2 extended a 12" waterline
along Arnold Road to its eastern border. The City would require a
subdivision to possibly tie -in water from that point to the 12" line at the
proposed collector to the east.
Sewer: This property is in the 92 -01 Sewer Impact fee area. In order to
physically connect this property to the sewer line that it has been
allocated to, an off -site easement, connection, and extension would be
required.
Streets: Arnold Road is a Minor Collector. The Thoroughfare Plan
currently shows Arnold Road along the edge of the subject property from
the southern corner to the northeast property line where it would tie into
another minor collector, the Norman extension, that is shown along the
eastern property line running north -south from Rock Prairie to Graham
Rd.
Off -site Easements: Required for sewer extension and possibly storm
water drainage.
Drainage: This property is in the Lick Creek Drainage Basin (LCN II).
The development would be required to comply with the drainage
ordinance. Drainage problems may be remedied by street design or
other method. A Public Drainage Easement may be required to
accommodate off -site drainage
Flood Plain: None known.
Oversize request: OP may be requested on the construction of Arnold
Road and 12" water line extension.
Impact Fees: This property is in the 92 -01 Sewer Impact Fee area.
Currently the fee is $232.04 per Living Unit Equivalent.
