Dear Jeff:
We are in receipt of your comments dated March 1, 2000, and have revised the Preliminary Plat
document, and Engineer's Report / Impact Study to address your comments, and have attached them
to this letter. The subdivision will be known at Fairfield at Luther Street, however, the actual
development name will be different. We have coordinated with the operators of the pipelines along
Harvey Mitchell Parkway, and they have insured us that the pipelines are located a few feet inside the
ROW. They should be locating the actual lines horizontally, and probing the depths within the next few
weeks. All existing, on-site septic systems will be removed and disposed of prior to any utility
construction. The 50' private drainage easement through the property will not be disturbed other than
constructing a wastewater line, and outfalling the storm sewers into the waterway. The developer
intends to leave this area as natural as possible, therefore, we do not anticipate any Corps of Engineer's
404 Permits to be required. Should this change, the developer will insure that all activity falls within the
nationwide permit, or obtain an individual permit. Conveyance through the 60" culvert will be further
studied during the site plan review. Preliminary street profiles of Luther Street do not indicate the need
for a sag in the street, however, due to the length of curb and gutter, a drainage system will be required
for Luther Street. Preliminarily it is anticipated that a storm sewer will be needed through the north
corner of the subject tract, to the water way through the tract. A drainage easement has been shown
on the Preliminary Plat for this purpose. The wastewater system has been revised to consist of a private
lift station and force main that will discharge into the existing 15" wastewater line located at the southeast
corner of the Gorzycki tract. The developer is obtaining the necessary easements to that location.

Please accept this letter as Fairfield Residential's request to remove the Final Plat for the
Williams Addition from the April 27th Planning and Zoning Commission agenda. As the applicant,
we also hereby waive our statutory 30 day approval period as it pertains to the meeting this week
as well as the following two regularly scheduled Planning and Zoning Commission agendas,
although we do reserve the right to ask that the item be placed back onto a future agenda.

Dear Mr. Riley:
This letter is intended to outline a proposal for providing sanitary sewer service for a residential
project at the comer of Luther Road and Harvey Mitchell Parkway. As you will remember, we met
previously and I believe all of us felt like we had a workable scenario to provide service to the
subject property. Following the meeting it now appears our approach either did not pass muster
with the City's legal department or would require a lengthy development agreement process
which unfortunately does not fall within this project's time constraints. 1 subsequently met with
some members of the City staff to outline a subsequent proposal and they in turn held
reservations on recommending it for approval. Their preference was for us to construct the
ultimate master lift station and associated lines (gravity and force main) off-site from and through
our project site. Unfortunately, due to lender and construction time constraints we can not perform
that task. We would in effect have to have completed, approved, and bid engineering plans
within four weeks as well as all necessary easements which we do not control. Therefore, as a
follow up to that meeting I would like to outline what I believe to be the benefits to our proposal
and restate our commitment to working out the most efficient and beneficial outcome available at
this time.
As for our proposal itself, I believe it would in effect save the City an estimated $170,000
(engineer's estimates are attached) while helping to implement the City's Master Sanitary Sewer
Plan for the area. In conjunction with the development and tied to the resolution of this issue we
have also agreed to assume another developer's responsibility to provide much needed and
desired transportation improvements to the area. This roadway commitment entails no gurantees
of reimbursement.
In realization of the time constraints, I have tried to formulate our proposal in a way that would be
easy to implement, monitor, and administer without the need for a development agreement and
which could be handled as conditions to the final plat and construction plan approvals.
The basis of the proposal includes the following:
Fairfield would
• construct a lift station within a public easement on the project property adjacent to the FM
2818 ROW. This station would be removed once the ultimate lift station was constructed
on the south side of FM 2818. Fairfield would not seek any reimbursement for this item
and any pumps, fittings, etc. would belong to the City once the ultimate lift station was
built and could be reused by the City.

construct the ultimate force main as shown within the master sewer service plan from the
creek located on our property east to the existing 15" gravity line. This force main would
be located within the TxDOT right-of-way as a public project or if possible on-site within a
platted public easement. Fairfield would also not seek reimbursement for this force main
along our site frontage though the money is already budgeted to pay for this out of
municipal funds nor would we seek any oversize participation reimbursement for the
force main along this portion. This would be an approximate $35,000 savings to the City.
We would construct a gravity sanitary sewer line to the six-acre parcel to the
south/southeast of our subject tract. This would eliminate the need for an additional bore
under FM 2818 as outlined in the Sewer Plan for this area at significant savings to the
City (approximately $135,000 in savings).
Fairfield would be responsible for any U.S. Corps of Engineers permitting required for the
force main's creek crossing and would not seek any reimbursement for the study and
permitting costs which would have been at the cost of the City.

surety upon completion equivalent to what is required of other newly constructed public
improvements when accepted by the City.
The City would
• accept the initial lift station and permanent force main as public and sign as the public
sponsoring entity for TxDOT permitting. Fairfield would cover any costs associated with
this process.
An additional item that has been talked about has been the assistance of Fairfield in acquiring the
easements necessary to construct the master public lift station and associated lines on the other
side of FM 2818. We have always committed to the City that we would make a good faith effort
to help you acquire those easements as the underlining property is controlled by a relative of the
owners of the properties which we have under contract to purchase. I had originally been
informed that the owner of that property was also one of the sellers of the tracts we have under
contract but have now learned that he is a relative. We have begun discussions with him to
dedicate the easement even to the point were we've offered to pay any legal or engineering
review costs he may incur. We would not request any reimbursement from the City for these
costs and are continuing our efforts to acquire this easement for the City.
As mentioned above, we have committed as a part of this project to certain transportation
improvements. Early on, the City staff and subsequently the Planning & Zoning Commission and
City Council requested that we complete Luther Road out to FM 2818 which includes a large
section that is the responsibility of the Melrose development under a valid development
agreement. Melrose has not performed but we committed to the improvements in order to move
this project forward at an extra cost of approximately 5200,000 that should be Melrose's. This is
with no guarantees of reimbursement of any kind on this cost. We are trying to tie Melrose down
privately but have not been able to at this point. However, I told the Staff, Commission, and
Council that we would construct Luther and should this project move forward we will. Our
commitment also involves an agreement to facilitate the dedication of ROW for Luther from four
different property owners which we have done. I bring this up to point as an example of our
commitment to do the right thing at the City's request as well as some of the benefits to the City
that would dissolve if some compromise can not be reached.

1 realize that our time problems are not your problems. However because our realities affect
some beneficial opportunities for the City I hope that we can work something out. Obviously
determining the benefits is and should be the City's decision. I see the issue as basically whether
or not the City Is willing to accept a public interim lift station in exchange for significant cost
savings for the overall master project, getting a large portion of it built now, having the best
chance of securing much needed easements for the master lift station at no cost to the City, and
all of Luther Road being built now.
