You will see in the accompanying water report that we have demonstrated an 8" line is adequate to provide water service for Phases 1 through 6 of the subdivision. I estimate the additional cost for installing an 18" line instead of an 8" line to be $26,608.00. According to the latest map revision dated 2/9/00, regulatory floodplain and floodway both significantly impact your property. I have attached a copy of a portion of this map for your reference. The City of College Station Flood Hazard Protection Ordinance specifically prohibits development within the floodway, which is shown as the hatched area on the map. As you can see, this requirement covers a significant portion of Emerald Park Plaza. In my position as Floodplain Administrator, I am not permitted to make interpretations of whether a specific location is or is not in the floodplain based on elevation or to allow floodway location interpretations without engineering data. However it is clear that the majority of lots 1, 4 & 5 are within the regulatory floodplain area as shown on the regulatory map. In reviewing the background information on this issue, I have revievyed the Final Plat for this development, and noted that the floodplain and floodway lines are not consistent with the FEMA map. The drainage report that was prepared for this development did not contain information explaining why the limits shown on the plat do not match the regulatory map in effect at the time. In cases of conflict such as this, the regulatory FEMA map supercedes the limits shown on the Final Plat. Also as you requested, from my standpoint as Floodplain Administrator, I will briefly describe the three options I believe are available for your consideration. The first option is to obtain a Letter of Map Amendment (LOMA) issued by the Federal Emergency Managemcat Agency (FEMA). In essence, this involves extensive engineering modeling to show that the map is not correct, based on updated or more precise information. Your second option is to obtain a Letter of Map Revision (LOMR) issued by the FEMA. In short this involves extensive engineering modeling as well as physical modifications to the channel to alter the location of the floodway and floodplain. This is the process followed by your development when the Appomatox extension and channel improvements were performed. Home of Texas A &M University Your third option is to seek a variance to the City Flood Hazard Ordinance that prohibits development in the floodway. This variance would also require significant engineering efforts and would have to be presented and approved by the Zoning Board of Adjustment. Based on information available to me at this time, it is most likely that Staff would oppose the request in our recommendation to the Board. I encourage you to discuss these alternatives with your design professionals due to the amount of money and time involved with all of these options. When you are closer to a decision, I would be glad to meet with you to discuss any details of the process or questions you may have. If this property was deeded to BCS Development more than 90 days ago, we will need current title work. From a copy of a Deed of Trust dated April 5, 2002, from BCS Development Company to First American Bank, SSB, it appears that a mortgagee's title policy was or will be issued by Aggieland Title Company to First American Bank. If you will provide us with a copy of the mortagee's title policy to First American Bank, this will take care of the requirement for current (within 90 days) title insurance. 2. Please provide Legal with a copy of a corporate resolution of other proof of authority for you to execute these easements on behalf of BCS Development Company.
