Rear Visitors At this time, the Chairman will open the floor to citizens wishing to address the Commission on planning and zoning issues not already scheduled on tonight's agenda. The citizen presentations will be limited to three minutes in order to accommodate everyone who wishes to address the Commission and to allow adequate time for completion of the agenda items. The Commission will receive the information, ask city staff to look into the matter, or will place the matter on a future agenda for discussion. (A recording is made of the meeting; please give your name and address for the record.) 2. Public Comment for the Record At this time, the Chairman will open the floor to citizens wishing to address the Commission on consent and regular agenda items that are not scheduled for a public hearing, This does not include items where hearings have been previously held. All matters listed under Item 3, Consent Agenda, are considered to be routine by the Planning and Zoning Commission and will be enacted by one motion. These items include preliminary and final plats, where staff has found compliance with all minimum subdivision regulations. All items approved by Consent are approved with any wid all staff recommendations. There will not be separate discussion of these items. If any Commissioner desires to discuss an item on the Consent Agenda it will be moved to the Regular Agenda for further consideration. 3. Additional Requirements for Certain Replats (a) In addition to compliance with Section 212.014, a replat without vacation of the preceding plat must conform to the requirements of this section if (1) during the preceding five years, any of the area to be replatted was limited by an interim or permanent zoning classification to residential use for not more than two residential units per lot; or (2) any lot in the preceding plat was limited by deed restrictions to residential use for not more than two residential units per lot. (b) Notice of the hearing required under Section 212.014 shall be given before the 15 day before the date of the hearing by: (1) publication in an official newspaper or a newspaper of general circulation in the county in which the municipality is located; and (2) by written notice, with a copy of Subsection (c) attached, forwarded by the municipal authority responsible for approving plats to the owners of lots that are in the original subdivision and that are within 200 feet of the lots to be replatted, as indicated on the most recently approved municipal tax roll or in the case of a subdivision within the extraterritorial jurisdiction, the most recently approved county tax roll of the property upon which the replat is requested. The written notice may be delivered by depositing the notice, properly addressed with postage prepaid, in a post office or postal depository within the boundaries of the municipality. (c) If the proposed replat requires a variance and is protested in accordance with this subsection, the proposed replat must receive, in order to be approved, the affirmative vote of at least three- fourths of the members present of the municipal planning commission or governing body, or both. For a legal protest, written instruments signed by the owners of at least 20 percent of the area of the lots or land immediately adjoining the area covered by the proposed replat and extending 200 feet from that area, but within the original subdivision, must be filed with the municipal planning commission or governing body, or both, prior to the close of the public hearing. (d) In computing the percentage of land area under Subsection (c), the area of streets and alleys shall be included. (e) Compliance with Subsections (c) and (d) is not required for approval of a replat of part of a preceding plat if the area to be replatted was designated or reserved for other than single or duplex family residential use by notation on the last legally recorded plat or in the legally recorded restrictions applicable to the plat. The majority of lots already subdivided are either 50 or 52' wide by 104' deep in the Richard's Addition. The remainder of original lots is 104' by 104' deep with 1000 to 1200 square foot houses or less by original owners, some of which are in good shape and some that are not. To continue revitalizing homes in the area in a cost effective manner for developers and or Community Development by the City, the following should be addressed because the size of original lots (104' by 104'), new lots can only 52' by 104', unless a developer can by 5 adjoining lots of 104' by 104'of which could then create 6 lots at 87'wide to meet the current replating ordinance. This option is not probable because of several different owners involved. Because of the income level of housing in this area (Richard's Addition), the remaining lots of 104' by 104' would not be cost effective to improve this area, at the current income level. SECTION 18: PLATTING AND REPLATTING WITHIN OLDER RESIDENTIAL SUBDIVISIONS SECTION 18: PLATTING AND REPLATTING WITHIN OLDER RESIDENTIAL SUBDIVISIONS 18 -A. This section applies to all property in which any portion of that property meets the following criteria: 18 -A.1 Any portion of the property is currently zoned or developed for single family residential uses as of January 1, 2002 with the exception of NG -1, NG -2 and NG -3 zoning districts; and, 18 -A.2 The subject property is part of a lot or building plot that was created prior to July 15, 1970. This also includes lots that may have been vacated or replatted after July 15, 1970 but where the original plat predates July 15, 1970. 18 -13. In addition to the other provisions of this ordinance, no plat, replat, vacating and resubdividing plat or other plat intended to provide for the resubdivision of an existing lot or lots in a residential subdivision may be approved unless: 18 -6.1 The plat does not create an additional lot or building plot. 18 -6.2 A plat which does create an additional lot or building plot must meet or exceed the average width of the lots along the street frontage, for all lots in the block and contain at least 8,500 square feet of space for each dwelling unit. For the purpose of this section, a lot shall be defined to include the lot, lots and /or portions of lots that have been combined and used as a residential plot, as of the effective date of this ordinance. 18 -C. It is the applicant's responsibility to provide documentation during the application process regarding the original plat in which the lot was created.
