( "Declarant "). 1. This First Amendment is made to amend, alter, and change that one certain Supplemental Declaration of Covenants, Conditions and Restrictions of Castlegate, Section 8, filed for record in Vol. 5014, Page 133 of the Official Records of Brazos County, Texas on December 19, 2002 (the "Supplemental Declaration ") regarding side setback requirements and amendment provisions. This First Amendment reflects the City of College Station's interpretation of the setbacks requirements contained in the zoning ordinance for the Property. All capitalized terms not defined herein shall have the definitions ascribed to them in the Supplemental Declaration. 2. The Supplemental Declaration is amended as follows: (a) Section 9.07 of the Supplemental Declaration is hereby deleted and replaced with the following: "9.07. Set -back Requirements A building ( "subject building ") on a Lot may be erected on or at any distance from a side lot line, provided the following formula is met: the distance that the foundation of a subject building lies from a side lot line plus the distance that the foundation of a building constructed on an adjacent lot lies from such lot line equals at least ten feet (10'). For example, if the foundation of a building constructed on Lot 10 lies two feet (2') from the side lot line between Lots 10 and 11, then no part of the foundation of a building constructed on Lot 11 may be nearer than eight feet (8') from the side lot line between Lots 10 and 11." (b) Section 12.04(a) of the Supplemental Declaration is hereby deleted and replaced with the following: "12.04 Amendments (a) By Declarant During the Development Period, this Supplemental Declaration may be amended by the Declarant, acting alone. No amendment by Declarant shall be effective until there has been recorded in the Official Records of Brazos County, Texas, an instrument executed and acknowledged by Declarant, setting forth the amendment, and acknowledged by the Secretary of the Doc Bic Vol Fg 00809 OR 15211 226 Association certifying that the Development Period has not terminated. " 3. Declarant, as Owner of all of the Lots and having all of the votes in the Association, makes this First Amendment pursuant to Section 12.04(a) of the Supplemental Declaration. 4. All provisions of the Supplemental Declaration not amended by this instrument shall remain in full force and effect.
