Item: Discussion and possible action on a site plan approval for a temporary
parking lot for Continental Auto Sales located at 1005 Earl Rudder Freeway.

Applicant: Kling Engineering
Staff Recommendation: There has been an approved site plan for the subject
property for twelve years for the former Greenworld Golf Course. Staff
recommends denial of the request.
Item Summary: Continental Auto Sales opened January 1, 2002 in the former
Greensworld location. They currently have 54 paved parking spaces and would
like to add more for vehicle display. The size of the office requires that the site
have three parking spaces for customers and employees.
The site plan for Greensworld was approved in 1990, showing development of
the lot in phases. The first phase was completed, but remaining phases have
not. Phase 2 shows the 23 -space parking lot that the applicant would like to
install temporarily. Site plans do not expire; therefore the plan that was adopted
in 1990 is still valid today, and phase 2 of the plan could be built as approved on
the site plan after procuring the appropriate permits.
In February of 2002, the City went into code enforcement on the property
because vehicles were being parked on an unapproved surface in the location of
the phase 2 parking lot. The vehicles have been removed and the parties
involved have requested the temporary parking lot because of the costs involved
with installing an improved surface that meets the City's commercial standards.
The subject property and surrounding properties are zoned C -2 Commercial -
Industrial. Douglass Nissan abuts the property to the north. Land to the south
and east are undeveloped.
Comprehensive Plan Considerations: The Land Use Plan designates the area
as Retail Regional. Earl Rudder Freeway is considered a Freeway and
Expressway on the Thoroughfare Plan.
Item Background: This property was annexed into the city in 1958, was final
platted in 1990, and received an approved site plan in 1990. Greensworld
received building permits and its Certificate of Occupancy in 1991.
Temporary Parking Lot:
Section 9G of the Zoning Ordinance authorizes the existence of temporary
parking lots. The Commission may permit a temporary parking lot, subject to
appropriate conditions and safeguards, after taking into consideration the
following:
1. "Safe and convenient traffic control and handling, both internal and external.
2. Assured pedestrian safety.
3. Efficient and economic access for public utility and emergency vehicles.
4. Runoff, drainage and flood control.
5. Impact on adjacent land uses.
6. Whether in a particular case the above standards will be detrimental to the
public health, safety or general welfare.
The Commission may impose any additional standards necessary to the
protection or preservation of the public health, safety or general welfare."
Commission Action Options: The Commission has final authority over the
temporary parking lot and associated site plan. The options regarding the
temporary parking lot are:
1. Approval as submitted;
2. Approval with conditions relating to specific site characteristics;
3. Denial with specified reasons for denial;
4. Table; or,
5. Defer action to a specified date.
If the temporary parking lot is approved, it will be necessary for the Commission
to set a beginning date for the 12 -month period that the temporary condition will
be valid.

Detailed Explanation of Proposed Use
Continental Auto Sales

Continental Auto Sales has been in operation at this location (1005 Earl Rudder
Freeway) since December 2001.
They have been displaying their inventory on the grass in front of the office building and
adjacent to the one -way frontage road.
City Staff has indicated that this is not an acceptable situation and at a minimum, the
owner needs to install a temporary parking lot.
The purpose of this submittal is to secure a Conditional Use Permit for a temporary
parking lot.
The hours of operation are 7:00 am to 6:00 pm. Continental Auto has 2 -3 employees.
The temporary parking will display 17 -19 cars. There is a low pipe security fence around the
perimeter of the site.
The facility currently has 2 signs:
1) 3' x 5' wood sign with paint on letters, not lighted, fixed to the roof of the office.
2) 2' x 4' wood sign with paint on letters, not lighted, fixed to the roof of the office.
There will be no repair /service at this facility. Outdoor lights are on a timer.
The parking lot surface will consist of removing the existing vegetation and installing
3" - 4" of reclaimed (grind) asphalt.

On May 2, 2002, the Planning and Zoning Commission approved a request for a temporary
parking lot for 1005 Earl Rudder Freeway South. Without the permission for a temporary
parking lot, the Zoning Ordinance requires that commercial properties provide parking and
automobile display on approved surfaces as described in Section 9.2 Off - Street Parking Spaces.
This letter is a reminder that the Commission determined that the temporary parking lot must
cease existence by May 3, 2003. By this date, in accordance with Section 9.2.G of the Zoning
Ordinance:
The lot must be brought up to full compliance with the parking lot standards applicable to
the use as required by the Zoning Ordinance, or the lot, including all paving material,
must be removed and the area no longer used for the parking of vehicles. If the lot is
removed, the area must be sodded, seeded, or hydromulched with grass within 10 days of
removal. Driveway access shall be removed and curb and gutter replaced.
If the property owner and/or a lessee determines they would like to continue the parking lot use
on a permanent basis, proper approvals and permits must be obtained from the City of College
Station and a Certificate of Completion issued by the City by the determined date of May 3, 2003.
