They are as follows: Engineering Comment 1. You mention a replat for inclusion the 0.11 acre portion of Lot 1, Block 1, Gateway Phase 1 (Lot 1 A). The two developers (Mr. Mihalopoulos & Mr. Scarmardo) have agreed to transfer this portion of Lot 1 via metes and bounds description. I have informed Mr. Scarmardo that this is in opposition to the state statutes local govt code, however, that is the chosen method of transfer. To include Lot 1 of Phase 1 on this plat is beyond our scope. I will revise the boundary of the Master Preliminary Plat not to include the 0.11 acre Phase 1 portion. Please advise if this will be a problem. Engineering Comment 3. Please clarify which items you do not want named in the Drainage Concept Plan Engineering Comment 4. By referring to the BFE +1 foot are you referring to the Floodway? If so, the Floodway is shown and labeled per the presently active LOMR. If this is not the case, please clarify. Engineering Comment 5. Since a site layout for Phase 3 does not exist, an access easement with a defined route can not be determined. Will a note to the effect of siting the conditions for rezoning of this tract from R -5 to C -B suffice at this time? (Refer to January 11, 2001 staff comments for Gateway Phase 2 preliminary plat - conditions include access through tract to the adjacent University Park Lot "Y" tract). Along this same line, are the other two conditions for the prior rezoning (a. one access point & b. the 100' landscape buffer between C -B & R -5 zoning) still applicable? If so, does the buffer apply to the Gateway Phase 1, Lot 1 tract? Engineering Comment 6. Similar to the access easement issue, without a layout for Phase 3, a visual representation of a drainage easement for the current conditions would not be the same as for developed & final plat conditions. The existing outfall channel from University Dr. will either be re- routed or storm sewered upon development. In both instances (comment 5 & 6) will a note suffice or would the City like to see some sort of visual representation with a qualifying statement relating to final position dependent on actual site development layout?
