SUBJECT: ST MARY'S CATHOLIC CHURCH -Conditional Use Permit Site Plan
Staff reviewed the above - mentioned site plan as requested. The following page is a list
of staff review comments detailing items that need to be addressed. Please address the
comments and submit the following information by Monday, April 22, 10:00 a.m. to be
placed on the next available Planning and Zoning Commission meeting scheduled for
May 2, 7:00 p.m. in the City Hall Council Chambers, 1101 Texas Avenue.
Ten (10) copies of the revised site plan.
Staff is currently in the process of scheduling a meeting with the Project Review
Committee (PRC) to review this project for Northgate regulations. Please incorporate
those comments, if any, prior to submitting the revised plans for P &Z review. Please
note that the attached Easement Dedication Sheet and necessary documents are
required prior to the issuance of a development permit. If you have any questions or
need additional information, please call me at 764 -3570.

SUBJECT: St. Mary's Catholic Church Parking Lot Construction
Gentlemen,
It has come to my attention that all of the city approvals necessary for the recent
parking lot construction at Church Avenue and Nagle have not been obtained.
The site plan and conditional use permit for the parking lot were both approved
by the necessary boards. However the site plan review process has not been
completed, therefore there are no plans approved by the City, nor has a drainage
development permit been issued. In essence, none of the work that has been
performed to date has been permitted, and is thus in conflict with our
development ordinances.
According to our files, on April 26, 2002 the City issued comments in regards to
landscaping and streetscaping, with directions to make the necessary corrections
and return four sets of plans for review. The only plans received by the City after
this date were several sets of uncorrected plans that were submitted for
distribution at the Planning and Zoning Commission Hearing.
Because the site plans have not been submitted with corrections, the site plan
review process is not complete. As a result, the City could not have approved
any plans in use at this time. In addition, because the site construction drawings
have not been approved, the drainage development permit necessary for all
public and private work has not been issued.

We have also been made aware of a portion of the design for Church Avenue
that was overlooked in the original review process. Because the issue is directly
related to public safety, it must be addressed at this time. While not dimensioned
on the construction drawings, it appears that the new curbing line on Church
would reduce the street section to approximately 22 feet. in width from back of
curb to back of curb. The minimum width for any city street is 27 feet measured
from the same points.
While the City has no intent of requesting that Church Avenue be fully developed
to it's planned standards, we must require that the street section that results from
this development be no less than the City minimum criteria. Therefore the new
curbing and the proposed access road connection should be adjusted to obtain
that minimum clearance.
We have investigated the area affected by this change, and feel that there are
several options to handle the competing issues of street width, sidewalk width,
existing utilities and existing trees.
In order to bring the project into compliance, the plans should be revised to
address the landscape and streetscape issues raised on 4/26, as well as the
revisions to the proposed width of Church Avenue. Four sets of these plans
should be delivered to the City for review. When the plans are found to meet
these requirements, you will be notified to provide 8 sets of plans to be stamped
for approval, and a drainage development permit will be issued. After the plans
are approved and permit issued, the project may continue under the inspection
by the appropriate City Staff.
As always, we are more than willing to meet with you to discuss these issues,
their resolution, or any other possible changes to the planned project either in the
office or onsite.

What a difference a day makes.
By bringing in a design question for clarification John Logan helped us discover that the work being
performed at St. Mary's in Northgate has not been permitted. This has been relayed to the contractor via
John, and all work in the public ROW has been stopped. Work onsite will be allowed on a temporary
basis.
The project documents did go to PRC and P &Z and appears to meet conditions imposed by those bodies.
However, the site landscaping had outstanding comments going back to 4/26 that were never responded
to. As such, the site plan was not approved, so the DP was not issued, nor the associated construction
drawings approved.
Because of safety issues brought to our attention, Engineering (Brett) will be adding the comment that the
proposed improvements to Church Street need to be revised to not restrict the street below the 27'
minimum provided by Ordinance. Due to the fact that this condition was not noticed earlier, it would
normally not be required at this time. However I believe that the street width in this area, particularly at
what will be a high volume intersection is a matter of public safety, and as such the requirement will be
made. Based on the information I have to date, this will affect the existing trees and /or the width of the
proposed sidewalk, so a site meeting may be warranted.
In order to come into compliance, the applicant should to respond to the landscaping comments in the
request of 4/26, and address the Church Avenue street width issue with revised plans. When these plans
are approved, the site plan can be approved and development permit issued.
With approved plans in the hands of all parties, the City Engineer and Inspector can proceed with the
process of insuring the constructed work meets the approved construction documents.
If there is any of this that I'm off base on or missing, please let me know ASAP because I will be releasing
this information to the applicant this afternoon.
