HomeMy WebLinkAbout00072384 STAFF REPORT Prepared by: Jessica Jimmerson Date: 3-27-02 Email: jjimmers@ci.college-station.tx.us Item: Public hearing, discussion, and possible action on an ordinance amendment for a rezoning of approximately 17.22 acres located along Arnold Road from A-O, Agricultural Open to R-1, Single Family Residential and C-1, General Commercial. (02-48) Applicant: Municipal Development Group Staff Recommendations: Staff recommends denial of the rezoning due to infrastructure constraints and noncompliance with the Land Use Plan. Item Summary: The applicant is requesting this rezoning to enable development of the property. The property to the southwest and northwest is zoned R-1. The majority of it is developed as the Southwood Athletic Complex and a portion of it is developing as the Sun Meadows Subdivision. To the northeast the property is zoned R-4 and developed as a hospital complex, The Med. Property to the southeast is zoned A-O, the majority of it is vacant with a few residences, while a portion of it is developed as the City's Utility Service Center. A rezoning request for a 7.75 acre portion of the A-O tract has been submitted and will likely come before the Commission at the beginning of May. Arnold Road is currently a narrow gravel road. It is planned to be improved and extended through the adjacent development, Sun Meadows, to the edge of the subject property. The Final Plat of Sun Meadows Phase II, adjacent to the subject property is filed at the courthouse and the infrastructure has been guaranteed. It is presently under construction. However, for the purpose of a rezoning request, the City does not recognize that infrastructure is available to the subject property until it is in place and accepted by the City. In addition, in order to provide access to the site, by building Arnold Road and complying with the Thoroughfare Plan some off-site improvement will be required, as a portion of the road ROW is off-site. If development of this tract were to proceed faster than the development of the adjacent Sun Meadows Subdivision the City would be responsible for the off-site improvements necessary to support development on this tract. Even if Sun Meadows were completed, it would fall to the City to ensure that Arnold Road, which is primarily off of the subject property, was capable of handling the traffic impacts resulting from the new development. Comprehensive Plan Considerations: As the Commission is aware rezoning requests are evaluated on two main sets of criteria. The first criterion is compliance with the Comprehensive Plan, including the Land Use and Thoroughfare Plans, etc. Second, a proposed rezoning is evaluated based on the conditions in the area, including the potential increase in negative impacts into the public infrastructure. R:IHTLTRIPZLTRIPRODIPZ20021P0006020.DOC Page 1 of 3 Created on 03127102 11:28 AM The Land Use Plan shows this area as Medium Density Single Family, with a corresponding density of 3-6 dwelling units per acre. The C-1 zoning request does not comply with the Land Use Plan for this area. The C-1 also does not comply with the development policies of the City's Comprehensive Plan, which would only support commercial uses at intersections of major roadways. The R-1 zoning requested does comply with the Land Use Plan, but the increase in density would have a negative effect on the infrastructure. Initial access to the site would be from Arnold Road, which is shown on the Thoroughfare Plan as a minor collector. The Thoroughfare Plan currently shows Arnold Road crossing the subject property from the southern corner to the northeast property line where it would tie into another minor collector that is shown north-south from Rock Prairie to Graham Rd. Item Background: The subject property has been in the City's ETJ since approximately 1971. When annexation occurred in 1993, the tract was brought into the City under the A-O, Agricultural Open, zoning district. Platting of this tract has not yet occurred. Related Advisory Board Recommendations: A requirement during the platting of the property is that the Parks Board review the parkland dedication proposal of the developer, whether it is for land dedication or fee in lieu of land. The current development fee is $309 and the fee in lieu of land dedication amount that may be required is $148 for each R-1 lot with final platting. If platting occurs after July 10th, the new parkland fees will apply. Commission Action Options: The Commission acts as a recommending body on the question of rezoning, which will be ultimately decided by City Council. The Commission options are: 1. Recommend approval of rezoning as submitted; 2. Recommend a less intense zoning classification; 3. Recommend denial; 4. Table indefinitely; or, 5. Defer action to a specified date. The City would require a subdivision to possibly tie-in water from that point to the 12" line at the proposed collector to the east. Sewer: This property is in the 92-01 Sewer Impact fee area. In order to physically connect this property to the sewer line that it has been allocated to, an off-site easement, connection, and extension would be required. Streets: Arnold Road is a Minor Collector. The Thoroughfare Plan currently shows Arnold Road crossing the subject property from the southern corner to the northeast property line where it would tie into another minor collector that is shown north-south from Rock Prairie to Graham Rd. Off-site Easements: Required for sewer extension and possibly storm water drainage. Drainage: This property is in the Lick Creek Drainage Basin (LCN II). The development would be required to comply with the drainage ordinance. Drainage problems may be remedied by street design or other method. A Public Drainage Easement may be required to accommodate off-site drainage. Flood Plain: None known. Oversize request: OP may be requested on the construction of Arnold Road and 12" water line extension. Impact Fees: This property is in the 92-01 Sewer Impact Fee area. Currently the fee is $232.04 per Living Unit Equivalent.
