Planning and Zoning Commission Meeting of March 21, 2002
Dear Ms. George:
Transmitted via this letter are revised plans representing the Preliminary Plat Submittal for the proposed
Westfield Addition Phase 2 which is located within the city limits of the City of College Station, Texas.
More specifically, the proposed subdivision consists of 60 lots that are situated on an approximately
12.447 acres tract of land located on the south side of Graham Road, approximately 400 feet east of the
intersection with Victoria Street.
The Preliminary Plat drawings have been revised to address the comments of the City of College Station
staff as outlined in your Memorandum to us dated March 5, 2002. The staff comments were designated
as "Staff Review Comments No. 1" and are summarized in Table 1 along with a description of the
changes in the drawings to incorporate the comments.
We are submitting these drawings in connection with the proposed Planning and Zoning Commission
(PZC) meeting scheduled for March 21, 2002.
Transmitted herewith are ten (10) "blue line" copies of the revised PP, one (1) mylar copy of the revised
PP, and a disk with an electronic digital file copy of the preliminary plat.

A copy of my letter to the 57 property owners that will be notified concerning a Preliminary Re-Plat that will be
presented at the March 21 ' meeting of the P & Z Commission is attached. along with the names and addresses
of the folks to whom the letter was sent.
The Development Staff has been asked to give this transmittal and the attached letter to the members of the
P & Z Commission to apprise you of my efforts to meet with and address questions and concerns of property
owners, to he notified of the subject filing - and to do so as iitr in advance of the. March 21°` public hearing date
as possible.
If I were a member of the Commission, I Would Wtult to be awdre of curmspondcnuc bculg som to property
owners concerning a future filing to be presented to the Commission (in order not to be blind sided by a
property owner that might contact me concerning the correspondence). So the attached is forwarded FYI.

My purpusc ill writing you is to rcquesl aii opportunity to personally review with you a proposal to rc-plat
approximately 12 acres of the Woodland Estates Subdivision. A "Preliminary Plat" will be presented at the
March 215 meeting of the College Station Planning and Zoning Commission; and in accordance with
procedures followed by the P & Z Commission, you and other nearby neighbors will receive ten days prior to
the March 21" meeting, a notice of the public hearing conducted at the meeting. In order for yrnl to have an
npport.unity to review the proposed re-Platting prior to March 21', and to get answers to questions you may
have. I would like to have an opportunity to share this information with you at your convent=s.
The Preliminary Plat to be submitted to the P & Z Commission was not available from the engineering firm as
of this writing, but a close approximation of the plat will be available next week; and I am available to meet
with you at your resideuce, ur at rnrrother place of your chuosuig, to review the information - or we can visit by
phone, if you prefer. To reach me on a direct basis, please call my cell phone (575-6248), which is a local-dial
number. If my line is busy, please leave your name and number so I may return the call.
The proposed re-platting is in compliance with all zoning, code and moratorium requirements of the City of
College Station. As you may know, Woodland Estates is zoned R-1 (single family residences only); and the
minimum size of all home sites re-platted In this residential area must comply with the requirements of a
"nioraturiuut" Wuptud by the City of College Station to preserve the character tula integrity of the surrowlding
neighborhood. Under tho moratorium, the width of rc-platted lots must be as wide as the average of all other
lots in the adjacent neighborhood. The proposed re-platting complies fully with the City's moratorium.
Should you not be familiar with the locale of Woodland Estates Subdivision, it is bordered by Munson,
Dominick, Westover and Holt.. The subdivision, however, primarily touches only Munson Avenue (not the
other streets mentioned), because most of the original subdivision was re-platted and re-named over the years.
My wife, Cathy, and I lived in RCS for 20 years before moving to the Temple-Belton area five years ago for
employment reasons; but having recently wrapped up my professional career, we are selling our residence on
I ake Helton and moving back home. A tract of land became available to us in Woodland Estates to build a new
home; but after determining that several hundred thousand dollars of development costs was required to satisfy
City requirements fbr cul-de-sac access, drainage control, utilities, etc., we realized the only way financially
feasible to construct our hu me uit the propcrty was to kx;ludc additional holm sites over which to spread the
required development costs.
The lots to be re-platted are larger than most in the area; and we believe the upscale custom hunitb built oil the
lots will enhance the market value of the surrounding neighborhood. Please give me a call.

In addition to receiving any comments or suggestions you may have for my 2115/02 letter to property owners
faxed to you ycstcrday, I alto would appreciate receiving a copy of the language referencing the `moratorium"
and P & Z "public hearing" notice for plats presented to the P&Z. If it is not on what you fax me, caul you
pencil on the date the "moratorium" covering the Woodland Estatcs Subdivision went into effect.
The reason I would like to see the text covering these two subjects is because I reference both in my letter to
property owners; and the language I am using is what. I recalled hearing at my two meetings with the
Development Services staff. I would like to make sure that I know what I am talking about when referencing
these two aitas - particulurly when i tun discussing the subjects with property owners. I left a message on
Dridgette's voice mail Friday AM for the sauce info.
If one or both of you could give me a call or fax Monday AM, I would greatly appreciate it. I have hold up
mailing the letter to property owners wanting to have the benefit of your comments and the text of the regs
covering "puhlic hearings" and "monitoriums". My Fax # and Belton voice # are above. My local B-CS dial

Attached please find a copy of a portion of the State Statute addressing replats in residential
areas.
In regard to your question about the date of the moritorium, the original moritorium was
approved by Council on January 17t', 2000. Since that time, the ordinance has been amended
such that there is not actually a prohibition from subdivision, but there are additional regulations
that apply to property that was originally subdivided prior to 1970.
At this time, the a copy of the letter to the residents and the cover letter to the Planning and
Zoning Commission are scheduled to be placed at the Commissioner's seats at the meeting on
Feb. 21th, 2001. I will be out of the office for the remainder of the week, so if you would like to
make changes to the letters before they are given out please contact Natalie Ruiz, Development

§ 212.015. Additional Requirements for Certain Replats
(a) In addition to compliance with Section 212.014, a replat without vacation of the
preceding plat must conform to the requirements of this section if
(1) during the preceding five years, any of the area to be replatted was limited by an
interim or permanent zoning classification to residential use for not more than two
residential units per lot; or
(2) any lot in the preceding plat was limited by deed restrictions to residential use for
not more than two residential units per lot.
(b) Notice of the hearing required under Section 212.014 shall be given before the
150i day before the date of the hearing by:
(1) publication in an official newspaper or a newspaper of general circulation in the
county in which the municipality is located; and
(2) by written notice, with a copy of Subsection (c) attached, forwarded by the
municipal authority responsible for approving plats to the owners of lots that are in
the original subdivision and that are within 200 feet of the lots to be replatted, as
indicated on the most recently approved municipal tax roll or in the case of a

tax roll of the property upon which the replat is requested. The written notice. mi av hf=

(c) If the proposed replat requires a variance and is protested in accordance with this
subsection, the proposed replat must receive, in order to be approved, the affirmative

commission or governing body, or both. For a legal protest, written instrof-nel-lts

(d) In computing the percentage of land area under Subsection (c), the area of streets
and alleys shall be included.
(e) Compliance with Subsections (c) and (d) is not required for approval of a replat
of part of a preceding plat if the area to be replatted was designated or reserved for
other than single or duplex family residential use by notation on the last legally

My purpose in writing you is to request tut opporturdty to personally review with you a proposal to rc-plat
approximately 12 acres of the Woodland Estates Subdivision. A "Preliminary Plat" will be presented at the
March 21 u meeting of the College Station Planning and Zoning Commission; and in accordance with
procedures followed by the P & Z Comunission, you and other nearby neighbors will receive ten days prior to
the March 21" meeting, a notice of the public hearing conducted at the meeting. In order for ynv to have an
opportunity to review the proposed re-platting prior to March 21", and to get answers to questions you may
have, I would like to have an opportunity to share this information with you at your convenience.
The Preliminary Plat to he submitted to the P & Z Commission was not available from the engineering firm as
of this writing, but a close approximation of the plat will be available next week; and I am available to Inset
with you at your residence, ur at wiother place of your choosing, to review the Information - or we can visit by

The proposed re-platting is in compliance with all zoning, code and moratorium requirements of the City of
College Station. As you may know, Woodland Estates is zoned R-1 (single family residences only); and the
minimum size of all home sites re-platted in this residential area must comply with the requirements of a
"moruturiuttf' udoptud by the City of College Station to preserve the cltarbcter bail uitegrity of the surrounding
neighborhood. Under the moratorium, the width of rc-platted lots must be as wide as the average of all other
lots in the adjacent neighborhood. 'rho proposed re-platting complies fully with the City's moratorium.
Should you not be familiar with the locale of Woodland Estates Subdivision, it is bordered by Munson,
Dominick, Westover and Holt.. 'rho subdivision, however, primarily touches only Munson Avenue (not the
other streets mentioned), because most of the original subdivision was re-platted and re-named over the years.
My wife, Cathy, and I lived in ACS for 20 years before moving to the Temple-Belton area five years ago for
employment reasons; but having recently wrapped up my professional career, we are selling our residence on
Lake Helton and moving back home. A tract of land became available to us in Woodland Estates to build a new
home; but after determining that several hundred thousand dollars of development costs was required to satisfy
City requirements fbr cul-de-sac access, drainage control, utilities, etc., we realized the only way financially
feasible to COIIStruCt our home utt the prUpcrLy was to kicludc addiLiuiW hullos sites over which tU spread the
required development costs.
The lots to be re-platted are larger than most in the area; and we believe the upscale Custow homes built on the
lots will enhance the market value of the surrounding neighborhood. Plcasc give me a call.

Attached please find a copy of a portion of the State Statute addressing replats in residential
areas.
In regard to your question about the date of the moritorium, the original moritorium was
approved by Council on January 17th, 2000. Since that time, the ordinance has been amended
such that there is not actually a prohibition from subdivision, but there are additional regulations
that apply to property that was originally subdivided prior to 1970.
At this time, the a copy of the letter to the residents and the cover letter to the Planning and
Zoning Commission are scheduled to be placed at the Commissioner's seats at the meeting on
Feb. 21th, 2001. I will be out of the office for the remainder of the week, so if you would like to

§ 212.015. Additional Requirements for Certain Replats
(a) In addition to compliance with Section 212.014, a replat without vacation of the
preceding plat must conform to the requirements of this section if
(1) during the preceding five years, any of the area to be replatted was limited by an
interim or permanent zoning classification to residential use for not more than two
residential units per lot; or
(2) any lot in the preceding plat was limited by deed restrictions to residential use for
not more than two residential units per lot.
(b) Notice of the hearing required under Section 212.014 shall be given before the
15"1' day before the date of the hearing by:
(1) publication in an official newspaper or a newspaper of general circulation in the
county in which the municipality is located; and
(2) by written notice, with a copy of Subsection (c) attached, forwarded by the
municipal authority responsible for approving plats to the owners of lots that are in
the original subdivision and that are within 200 feet of the lots to be replatted, as
indicated on the most recently approved municipal tax roll or in the case of a
vn>o hin the extraterritorial jurisdiction, the most recently approved county
tax roll of the property upon which the replat is requested. The written notic n -v !Dc-

office or postal depository within the boundaries of the municipality.
(c) If the proposed replat requires a variance and is protested in accordance with this
subsection, the proposed replat must receive, in order to be approved, the affirmative
