Item Summary: This Development Agreement provides for dedication of right -of -way and $37,015.00 in cash towards the future construction of Jones - Butler Road alongside the Holleman Village Section II development. This dollar amount represents the construction cost of one -half (1/2) of a 28' wide street that would be the developer's typical responsibility in this situation. The agreement waives any assessment against the property for the initial construction of Jones - Butler Road but not any subsequent widening or repaving. Item Background: This is a continuation of the terms and conditions established in a Development Agreement related to Holleman Village Section I approved by Council on July 28, 1999. A Development Agreement, similar to the one proposed, was approved by Council on March 23, 1999 for the previous developer of the Holleman Village Section II tract, Fairfield Realty. However, the approved agreement expired when Fairfield Realty did not purchase and develop the subject property. The ROW for the Jones - Butler Extension was platted as a public street in the 1977. At that time, the City Council did not require the construction of Jones - Butler, only the right -of- way dedication. Drainage improvements will be constructed with this development that may be utilized by the Jones - Butler Road Project, increasing the ultimate contribution by the Developer. A five -foot (5 -ft.) ROW strip is being dedicated with the plat for Jones - Butler and additional ROW is being dedicated for Holleman Street. The Developer is proposing to construct a street off of Holleman, going south paralleling Jones - Butler, and then bear east into Jones - Butler. Duplexes are proposed for the platted lots. Budgetary and Financial Summary: The $37,015 will supplement City funds for this future CIP project. An additional $9,125 will be spent by the Developer on drainage improvements under Jones - Butler. Staff Recommendation: Staff recommends approval. Council Action Options: 1. Approve as submitted. 2. Approve with modifications. 3. Deny. Supporting Materials: 1. Proposed Development Agreement. 2. Page 1 of 3 _,� 7 Agenda Item Cover Shept Anpnrla TtPm .# 1 fl_ 1 Item: Public Hearing, Presentation, discussion, and possible action on an ordinance levying assessments against various persons and their property for the payment of a part of the cost of Dartmouth Drive from its' current termination south of Southwest Parkway to Krenek Tap Road. Item Summary: This item is the eighth and ninth step in the assessment process for the Dartmouth Drive Extension Project. The eighth step is a regular Council agenda item holding the Public Hearing and adopting the assessment ordinance. The ninth step will be to publish the assessment ordinance approved by the City Council. This project approach is consistent with direction received from Council in a workshop meeting on December 14, 2000. Council supported staff's recommendation that paving assessments for thoroughfare extensions were to be initiated by the City if it enhanced the value of the adjacent property. Item Background: The first and second steps were taken on June 14, 2001 and consisted of a resolution authorizing the plans and specifications for the improvement of Dartmouth Drive, from its current termination south of Southwest Parkway to Krenek Tap Road. The third step was to solicit bids for construction. The bids were advertised on September 11, 2001 and September 18, 2001. The bids were opened on October 4, 2001. The fourth step was a resolution awarding the construction contract and calling for a Public Hearing to consider an ordinance levying proposed assessments against the abutting property owners. This action was approved by City Council on October 25, 2001. The fifth step was the filing of a Notice of Paving Lien in the deed records of the Brazos County Courthouse. The sixth step was to publish a Notice of Public Hearing. The seventh step was to notify the property owners subject to the assessment of the Public Hearing by mail. The Dartmouth Drive Extension Project extends Dartmouth Drive from its' current termination south of Southwest Parkway to Krenek Tap Road. Budgetary and Financial Summary: Certificates of Obligation fund this project in the amount of $635,000. An appraiser will testify at the public hearing as to the property values and the enhanced values due to the proposed improvements. Staff Recommendations: Staff recommends adoption of the resolutions. Council Action Options: 1. Adopt the ordinance with all streets and properties at the proposed rate 2. Adopt an amended ordinance by deleting streets, specific properties or lowering the rate on any particular street or property 3. Do not adopt an assessment ordinance Supporting Materials: 1.
