Planning & Zoning Meeting Page 1 of 4 April 17, 2008 Planning & Zoning Meeting Page 2 of 4 April 17, 2008 DEVELOPMENT HISTORY Annexation: 1980 Zoning: A-O Agricultural Open and A-O to C-1 General Commercial on 28.34 acres (2008) Site development: Vacant COMMENTS Water: There is an existing 18-inch water line along the east side of FM 60 which stops at the northwest corner of the property. The Preliminary Plat is in compliance with the Water Master Plan that shows the extension of the 18" water line along FM 60. Sewer: Sanitary sewer to serve the site is being proposed from a 12-inch main on the adjacent property to the southwest. Streets: Additional ROW for FM 60 is proposed for dedication with the Final Plat. Proposed public streets include two 60-foot ROWs and a 50-foot ROW. Off-site Easements: Off-site easements will be required for the extension of sanitary sewer to serve this property. Drainage: The property is located in the Carters Creek Drainage Basin. Drainage on the property is generally to the south. Stormwater design shall be in compliance with the Unified Stormwater Design Guidelines. Flood Plain: No FEMA regulated floodplain is located on the property. Oversize Request: None requested. Impact Fees: None Parkland Dedication: N/A REVIEW CRITERIA 1. Compliance with Comprehensive Plan and Unified Development Ordinance: This area is designated as Planned Development on the Land Use Plan. The property's zoning of C-1 conforms to the Comprehensive Plan, but the A-O zoning does not. The proposed plat meets all the minimum requirements for C-1 and A-O lots. 2. Compliance with Subdivision Regulations: The proposed preliminary plat will require variances to Section 842 Blocks. The applicant is requesting variances to the maximum block length of 800': 1. University Drive East - 918.5' block length; 118.5' variance 2. Proposed west side of High Summit Street - 1290.36' block length; 490.36' variance 3. Proposed east Side of High Summit Street - 1289.48' block length; 489.48' variance Planning & Zoning Meeting Page 3 of 4 April 17, 2008 4. Proposed Buena Vista street projecting to the east - 938' block length; 138' variance In accordance with the Subdivision Regulations when considering a variance, the Planning and Zoning Commission should make the following findings to approve the variance: 1. That there are special circumstances or conditions affecting the land involved such that strict application of the provisions of this chapter will deprive the applicant of the reasonable use of his land; 2. That the variance is necessary for the preservation and enjoyment of a substantial property right of the applicant; 3. That the granting of the variance will not be detrimental to the public health, safety, or welfare, or injurious to other property in the area, or to the City in administering this chapter; and 4. That the granting of the variance will not have the effect of preventing the orderly subdivision of other land in the area in accordance with the provisions of this chapter. STAFF RECOMMENDATION If the Planning & Zoning Commission approves the requested variances, then Staff recommends approval with the condition that Engineering Comments are addressed.
