HomeMy WebLinkAbout00071993 STAFF REPORT Item: Public Hearing and Consideration of a Conditional Use Permit, for a medical clinic, InnerWisdom Counseling Centers to be located at 1726 Harvey Mitchell Parkway South. (0-2) Applicant: JoAnne D. Mandel Item Summary: The applicant is proposing to establish a mental health service and clinic in the 9,000 square foot building once occupied by Texas Digital Systems. The property is currently zoned M-1 Planned Industrial. Medical clinics are permitted in any zoning district upon the Planning and Zoning Commission's approval of a conditional use permit. The applicant proposes to operate a mental health facility that will house two separate programs, a day program and an evening program. The facility will not have overnight patients. Item Background: The site was zoned M-1 in 1976 and has been used as a planned industrial site for several years. The intent of the M-1 district is to assure that the use and site are compatible with the surrounding uses. The subject property is fairly isolated as adjacent tracts to the west and south, zoned R-1 and A-O respectfully, are undeveloped. Staff Recommendations: Section 14 of the Zoning Ordinance authorizes the existence of conditional uses. The Commission may permit a conditional use subject to appropriate conditions and safegards, when after public notice and hearing the Commission finds that: (Staff comments are in italics.) 1. "The proposed use meets all the minimum standards established in the ordinance for the type of use proposed." The use meets the minimum standards. In addition, the applicant has stated that most of the patients will be picked up at home and brought to the proposed facility. 2. "That the proposed use meets the purpose and intent of the ordinance and is in harmony with the development policies and goals and objectives as embodied in the Comprehensive Plan for Development of the City." 3. "That the proposed use will not be detrimental to the health, welfare, and safety of the surrounding neighborhood or its occupants, not be substantially or permanently injurious to neighboring property." ❖ The public hearing is the opportunity to hear such concerns. "The commission may impose additional reasonable restrictions or conditions to carry out the spirit and intent of the ordinance and to mitigate adverse effects of the proposed use. These requirements may include, but are not limited to, increased open space, loading and parking requirements, height restrictions, additional landscaping, and additional improvements such as curbing, sidewalks, and screening." Unless the public hearing brings to light any new information indicating potential negative impacts, Staff recommends approval of the site plan and use request.
