STAFF REPORT
Item: Public Hearing and consideration of a Conditional Use Permit, use only, for First
United Methodist Church to be located on 5 acres, approximately 400 feet south of Rock
Prairie Road and 130 feet east of the Highway 6 frontage road. (00-1)
Applicant: Pastor Melvin Amerson for First United Methodist Church
Item Summary: The proposed church would be developed on approximately 5 acres.
The building will be used weekdays and weekends during the day and evenings for various
church related activities.
The property is currently zoned A-O, Agricultural Open. It is adjacent to A-O on the east,
west and south sides and C-2, Commercial - Industrial, to the north. The Land Use Plan
shows this area as Medium Density Single Family Residential with Retail Regional on the
adjacent C-2 property. Religious facilities are allowed in any zoning district with a
Conditional Use Permit.
This site plan will need to return to the Commission for approval. The applicant is aware
that the Commission may impose additional site restrictions and requirements to mitigate
possible negative impacts of the use. These conditions maybe imposed either with the use
only request or at the time of site plan approval.
Item Background: This tract is unplatted and will require preliminary platting of the
parent tract as well as final platting of the subject tract. All infrastructure issues will have
to be addressed through the platting process.
Budgetary & Financial Summary: N/A
Staff Recommendations:
The Commission may permit a conditional use subject to appropriate conditions and
safeguards, when after public notice and hearing the Commission finds that:
1. "The proposed use meets all the minimum standards established in the
ordinance for the type of use proposed."
2. "That the proposed use meets the purpose and intent of the ordinance and is
in harmony with the development policies and goals and objectives as embodied in
the Comprehensive Plan for Development of the City."
3. "That the proposed use will not be detrimental to the health, welfare, and
safety of the surrounding neighborhood or its occupants, not be substantially or
permanently injurious to neighboring property."

"The commission may impose additional reasonable restrictions or conditions to carry out
the spirit and intent of the ordinance and to mitigate adverse effects of the proposed use.
These requirements may include, but are not limited to, increased open space, loading and
parking requirements, height restrictions, additional landscaping, and additional
improvements such as curbing, sidewalks, and screening."
Unless the public hearing brings to light any new information indicating potential
negative impacts, Staff recommends approval.

Commission Action Options: The Commission has final authority over the Conditional
Use Permit and associated site plan. The options regarding the use permit are approval as
submitted, approval with conditions relating to specific site characteristics or with time
limitations, denial with specified reasons for denial, or table or defer action to a specified
date.

INFRASTRUCTURE AND FACILITIES
Water: Will be addressed at time of platting. Water does not currently
extend to the site.
Sewer: Will be addressed at time of platting. Sewer does not currently
extend to the site.
Streets: Will be addressed at time of platting. At this time it appears that the
only access to the site is by a private access easement.
Off-site Easements: Will be addressed at time of platting. It appears that water
and sewer may require off-site extensions.
Drainage: Will be addressed at time of site plan. The development will be
required to comply with the City's Drainage Ordinance.
Flood Plain: Will be determined at the time of platting.
Oversize request: Unknown at this time.
Impact Fees: This tract is within Water Impact area 99-01, and will be required
to pay impact fees of $550 per L.U.E. (Living Unit Equivalent) at the time of
building permit.
