SUBJECT: Alley Abandonment - 500 Fairview Avenue
Attached is Scott McDermott's request to abandon the alley behind his property at 500
Fairview Avenue. The Procedure for Abandonment of A Public Right-of-Way/Easement
application states that the applicant is required to attain the names and addresses of
property owners who have not consented to the vacation and abandonment, including
property owners of land within 1,000 feet of either end of the proposed abandonment
area. Mr. McDermott has not contacted those residents per his conversation with Mark
Smith, who indicated that would not be necessary for this abandonment.
I have tentatively scheduled this project for the February 28, City Council meeting.
Please let me know at your earliest convenience if this project will need to be scheduled
for a later Council meeting and I will change that on our tracking sheet. I have also
informed Mr. McDermott about the tentative date and would like to notify him if that
date changes.
There is one condition we would like to make upon approval of this abandonment: the
dedication of a 15' PUE for an existing overhead utility line (see attached drawing). Mr.
McDermott has submitted the necessary documents for this dedication and has asked for
this condition. Please let me know if you foresee any problems with this request.

My thoughts would be for a 20 foot easement or any additional width necessary to encompass the existing
sewer line to past the edge of the electric utility poles. Tony did say that the electric poles did not have
cross bars so the additional 5 foot outside of the poles are not necessary. The easement must be
extended to the far side of the alley that is to be abandoned. If he wants to meet to discuss, I suggest
scheduling a meeting with the parties included in this e-mail.

Who does Scott McDermott need to talk to regarding the sewer line on his property and exactly where that
easement can be? He was told in the field that it could just cover that sewer line and extend 15' beyond it
on the other side to include the electrical line. I want to make sure he, and I, are clear about the exact
location before we proceed with the abandonment.

Do you have a copy of the existing easement for the sewer? Based upon the new easement for electrical
that was submitted, the easement is shifted to the west side of Lot 9 and the poles would be on the east
side of that easement (opposite of that in the remaining alley), however, based upon a manhole on the
south side of Fidelity, it does not appear that the new easement would incorporate the sewer line which
appears to continue down the alley to the east of the power poles. If the sewer easement stays in effect, it
does not make any sense for the electrical easement to have that offset or to have two separate
easements. The issue still remains about how to bridge the planned abandoned alley with an easement
as it the proposed easement terminates at the south side of the current alley.

Good morning! I spoke with Scott McDermott this morning and he said that he has already spoken with
Mark Smith about the existing sewer line and that Mark said he wouldn't have a problem
extending/rebuilding his garage over it (in place of the existing garage). Can you please get with Mark on
that and let me know where we stand on this. Thanks!

Do you know if anything has happened related to the dedication of the public utility easement either by plat
or by separate easement agreement? The response from Jan on 2/28/02 indicated Legal wanted the
easement and also wanted me to revise the proposed ordinance to be in a different format. The sample
that she sent was specifically applicable to the abandonment of an easement and not a right-of-way which
would have the property revert to adjacent multiple property owners. I have not tried to make modification
yet and am waiting on a resolution to the easement dedication issue. Please let me know the status.

The metes & bounds are included in exhibit "A" sent by interoffice mail. As far as the easement
agreement, Development Services expressed a desire to list the easement as a condition but the actually
receive the easement by a later replat. I told them I would see if Legal was acceptable (included in the
draft ordinance previously submitted). If not, I assume this is on hold until the plat or separate easement
metes & bounds are submitted.

Bob, the ordinance you attached is not in the proper format for an abandonment. I have attached the a
copy of the ordinance format you should have use.
Also, legal needs to have time to review the application and to prepare the utility easement. Do you have
the metes and bounds description for the utility easement?
Please send me a copy of the application, a diagram of the area to be abandoned along with the metes
and bounds description, the metes and bounds description and diagram of the proposed easement area,
and the ordinance retyped in the proper format.
In order to give Legal time to review the documents and prepare the easement, please reschedule this for
the second Council meeting in March.

I have placed a draft ordinance in the Legal Review folder for an alley abandonment application for
3/14/02. Attached is the cover sheet for that item. I am sending by Interoffice Mail a copy of Exhibit "A" to
include metes and bounds and graphics. Please let me know if anything else is needed.
