Staff reviewed the above-mentioned site plan as requested. The following page is a list
of staff review comments detailing items that need to be addressed. Please address
the comments and submit the following information for further staff review:
Two (2) revised site and landscaping plans.
$32,430 (94 units x $345/unit) Parkland Dedication fees due prior to
issuance of a building permit.

Jessica,
Response to your comments dated 11-12-01 on the Deacon Condominium project
as follows:-
1. COMMON OWNERSHIP:- Agreed. It is understood that all land including the
land under the units will remain under common ownership.
2. PHASING:- Yes, the project will be developed in two parts. The first
part containing 52 units located inside the area bounded by Fraternity Row,
Deacon, and Wellborn Rd will be developed immediately. The second part
containing 42 units and located south of Fraternity Row will be developed
later.
3. ADA SIDEWALKS:- This project is almost completely identical (including
sidewalks) to our recently competed Navarro townhouse project. Like the
townhouse project, these homes will be marketed under HUD guidelines for
FHA/VA financing and sold to owner-occupants. Because condominiums and
townhomes are viewed by HUD as single family residential housing we are not
been required to meet ADA requirements as would be required for public or
commercial property (e.g. apartments, office buildings, retail, etc.).
4. PARKING/FLUMES:- I think paint striping may be the best way to address
this restricted parking question. On previous projects, paint striping has
been very effective for designating assigned parking, visitor parking, and
fire lane areas. I prefer to avoid installing a permanent physical barrier
(i.e. bollard) because it may unnecessarily restrict lawncare access (i.e.
tractor mower)
5. LANDSCAPING: (to be addressed by Hester Engr'g drawing revisions)
6. TREE PROTECTION:- (to be addressed by Hester Engr'g drawing revisions)

SUBJECT: Deacon Condominiums -100 Fraternity Row
Blake Cathey has submitted a site plan application with a proposal to build a 94-unit
condominium project. When property is zoned for single-family residential, developers
are required to dedicate park land, or the fee in lieu of land, prior to the filing of the final
plat. Since this property is zoned R-5, the required dedication is due prior to the issuance
of a building permit.
Mr. Cathey's property is located at the corner Deacon Drive and Wellborn Road and
consists of 10.46 acres. Mr. Cathey is proposing a fee in lieu of land in the amount of
$32,430 (94 units x $345). Please let me know at your earliest convenience if this fee in
lieu of land is acceptable by the Parks and Recreation Advisory Board so that we may
proceed with issuing the building permits once the plans have been approved.

Phase 2 landscape plan was prepared in accordance with the previously discussed and approved
landscape plans for Phase 1.

Jennifer,
Good Afternoon!
Per our earlier telephone conversation on this topic,
the revised landscape plan did not include "parking
screening" because the current city ordinance only
requires screening when parking is located BETWEEN a
building and a street ROW.
Per zoning ordinance section 11.3 para c; parking lot
screening is required "if parking is located between a
building and a street right of way." Since our
parking lots are adjacent to a ROW and are not
located between a street ROW and a building we
modified the engineer's original landscaping plan
accordingly.
If you would like to discuss this requirement in more
detail, please give me a call.

Blake is coming in to get a permit for the wall.
He has also agreed to install his streetscaping requirements. So, I'm okay to issue a temporary CO on
Fraternity Row with the following condition: that the landscaping and streetscaping requirements are
installed per the approved plans.
When he comes in we just need to ask him how long it will take to finish the landscaping/streetscaping and
put that date on the Temporary CO. Thanks!
