Kee, City Planner RE: Parkland Dedication Ordinance Review DATE: November 1, 2001 The parkland dedication ordinance, which is a chapter in the Subdivision Regulations, was amended 3 years ago. This amendment raised the fees, which had not been done since the original ordinance was adopted in the early 80's. There were also some location and design standards that were added. The ordinance, as it was approved three years ago, calls for a review every three years. This review is due for consideration by Council in January, 2002. It is part of a Council Strategic Issue for the Parks Department. Because the ordinance is part of a development code, I have participated in the review. To date the Parks and Recreation Advisory Board (Board) has been working on this amendment. They have had several meetings including one with a focus group of the development community. This amendment was endorsed and approved by the Board at their October meeting. There is no public hearing required for this amendment since it requires only Council action as part of the Subdivision Regulations. Any amendment approved by Council will ultimately be incorporated into the Unified Development Code. For this reason, and because fees can be set only by Council, this proposed amendment is on the Planning & Zoning Commission's consent agenda. If approved by consent, it will be a statement that the Commission endorses the amendment as proposed. If the Commission does not desire to support the amendment as proposed and would like to send alternate recommendations to Council, then the item should come off the consent agenda and the Commission should take some action. Fees were reviewed in light of the 2000 Census information and Council direction to incorporate intergeneration amenities into park development. These two items result in fee increases. 2. Fees were reviewed in light of an evaluation of recent land acquisition costs. Costs have risen slightly and the fees have been adjusted accordingly. The Parks and Recreation Advisory Board asked that for the next review period, staff investigate a method where land costs are determined by zone and then fees set accordingly. 3. Both single family and multi family fee increases are proposed. Proposed fees for single family increase 19 percent and fees for multi-family increase 31 percent. 4. These fee increases will be adopted, rejected or amended by resolution of the Council. To summarize the remainder of the proposed changes: 1. Since plats no longer go to Council, it was necessary to amend some language to clarify this. 2. Language was added to clarify that dedication is due at building permit time if no plat is required. 3. Language was added to state what has been Parks and Recreation Advisory Board policy that no detention area is accepted as part of any required dedication. It may be accepted in addition to dedication. Any detention/retention area must be designed in accordance with standards meeting specific criteria established by the Parks staff and the Parks and Recreation Advisory Board. 4. References to greenways were added to allow the Board to look for parkland dedications adjacent to greenways. The ordinance is written to take effect 6 months after adoption. This will allow any developments that are in the planning stages to continue under the current fee schedule. It will only be discussed and we'll receive direction at that meeting. It will be set for a PH on in Jan. 24th. So the ord. should read Jan 24, 2002 and the ad should run for this date. And because it is an amendment to the subdivision regulations and NOT the Zoning Ord. there is no specific requirement for posting the ad for the public hearing. If you want to do it at the same time as other Zoning ord. amendments or rezonings that's up to you. Susan Hazlett 12/14/01 11:22AM It is on the tracking sheet for January 10th CC meeting as a public hearing and would therefore require a legal notice to be published on December 26th. For publication on this date, the ad must reach The Eagle by noon on December 24th, possibly Friday, the 21 st (we'll need to check with The Eagle on this). I will not be here to do that. So, if I cannot take care of this task today, Tammy will need to do that on the morning of Christmas Eve or the Friday prior to that as mentioned above. I have cc'd her on this e-mail. The 10th is just a workshop discussion - no action is planned. It will either be the last mtg. in Jan or sometime in Feb where CC will hold a hearing and take action. I've attached an ad done for the Northgate Ordinance Amendment for you to change, modify, etc. Let me know if I need to do anything else. A notification letter is not required but since I will be gone after today until after new years, I'm trying to get the legal notices done before I leave to avoid any confusion, stress, etc. for others.
