REQUEST TO CHANGE C-N ZONING TO C-1
WE ARE CURRENTLY SCHEDULED TO COMPLETE CONSTRUCTION,
OF A CONVENIENCE STORE WITH TWO TENANTS AND MOTOR
FUEL AT THE INTERSECTION OF DARTMOUTH AND SOUTHWEST
PARKWAY, BY DECEMBER OR EARLY JANUARY. THE CURRENT
ZONING IS C-N. THIS ZONING DOES NOT PERMIT THE
CONSUMPTION OF FOOD ON THE PREMISES.
OUR REQUEST IS TO CHANGE THE ZONING TO C-1. C-N ZONING
ALLOWED MOST ALL OF THOSE THINGS TO WHICH NEIGHBORS
OBJECT.
WE BELIEVE THAT THE INTENT OF C-N ZONING WAS TO EXCLUDE
FAST FOODS AND OTHER RESTAURANTS OF LARGER
DEMINSIONS...BUT NOT TO EXCLUDE SMALL SANDWICH SHOPS
ETC. OUR NEEDS IS TO HAVE 20 SEATING SPACES FOR SOME
TENANT SUCH AS SUBWAY. WE DO NOT BELIEVE THIS WOULD BE
OBJECTIONABLE TO THE NEIGHBORS.... MAINLY BECAUSE
NOTHING CHANGES ABOUT THE EXTERIOR, ONLY THAT FOR THIS
TENANT A CUSTOMER COULD SIT DOWN.
THE SPACE ANTICIPATED IS VERY SMALL AND DOES NOT ALLOW
FOR EXPANSION NOR ADDITIONAL SEATING. WE REQUEST THE
CHANGE IN ZONING WHICH ALLOWS EVERYTHING WE NOW
HAVE PLUS THE SEATING WHICH IS NOT ALLOWED UNDER C-N
ZONING.

SUMMARY
IT IS HIGHLY UNUSUAL TO REQUIRE A DIFFERENT ZONING FOR
SUCH A SMALL CHANGE AND WE REGRET TAKING YOUR TIME
WITH THIS REQUEST.
IT IS, HOWEVER, CRITICAL TO THE OPERATION OF SUCH A
FACILITY THAT THE EXTRA EXPENDITURE REQUIRED TO
ENHANCE THE ARCHITECTURE HAS AN OPPORTUNITY FOR A
RETURN.

REZONING SUPPORTING INFORMATION
1.) List the changed or changing conditions in the area or in the City which make this zone
change necessary.
C-N Zoning does not allow food to be sold for on the premises consumption. We believe the
original formers of this ordinance had in mind a large fast food such as Sonic or McDonalds or a
larger sit down restaurant. We are building a space for fast food which will have approximately
275 to 295 square feet. But we need to be allowed seating of about 20 people. The current
zoning allows everything else in the center except this small amount of seating for this one
area ...it does not restrict seating any where else.
2). Indicate whether or not this zone change is in accordance with the Comprehensive
plan. If it is not, explain why the Plan is incorrect.
The City plan is currently changing. We believe the new plan should and would allow the
addition for small numbers of chairs for the special operations.
3). List any other reasons to support this zone change.
We believe we have been good representatives for the City by changing the Architecture of our
buildings. We have invested far beyond the norm. Now we need a zoning change because a
"variance" is not allowed for this particular area of C-N Zoning. We believe the neighbors will
like the change because of convenience to them without creating a nuisance or safety problem.
The applicant has prepared this application and supporting information and certifies that the facts
stated herein and exhibits attached hereto are true and correct. IF APPLICATION IS FILED BY
ANYO THER THAN THE OWNER OF THE PROPERTY, APPLICATION MUST BE
