RE: Northgate Amendment
Attached please find a copy of the latest draft of the Northgate District amendment. The
amendment is preceding consideration of the Unified Development Ordinance because
Staff anticipates further development in the area before the adoption of the UDO, and
because there are immediate needs for changes in the current review process.
BACKGROUND
In 1995, the Council made a commitment to upgrade the Northgate area, and made it a
strategic issue in 1995 to come up with a plan for the area. By early 1996, the plan and
its recommendations were adopted, and implementation of the plan became the number 2
ranking strategic issue that year.
There are essentially two ways of dealing with older small downtown areas such as
Northgate - either enhance the development pattern with infrastructure upgrades and
Traditional Neighborhood Development style ordinances to remain urban, or redevelop
the entire street and lot layout to become suburban. With the adoption of the plan, the
Council chose to enhance the existing development pattern and encourage a small
downtown character.
The Northgate ordinance provisions that existed at the time barriers to the more urban
style that was adopted in the plan. Therefore and ordinance amendment was adopted
mid-1996 that would encourage and allow the urban style. The provisions were so
flexible, however, that they also allowed development that is more typical of suburban
development, which is not compatible with the adopted plan.
Since the adoption of the ordinance, the building rehabilitation projects have been in line
with the future vision of the area, but new development and redevelopment have not been
in the desired style. This result was likely due to the fact that there were no real standards
written into the ordinance, and the Northgate Revitalization Board did not feel
empowered to impose additional standards.
PURPOSE
The goal of the attached ordinance is to implement the 1996 adopted plan for Northgate
on private property by clarifying the required development style.
ORDINANCE SUMMARY
The amendment involves the following concepts:
1) Clarifies that site improvements ranging from site development/redevelopment to sign
and fence additions would require board review and approval.
2) Changes the review board from the current Northgate Revitalization Board Review
Subcommittee (which includes three rotating members of the Commission) to the
Project Review Board (which is made up of three rotating members of the
Commission). Approval would be final unless appealed to the full Commission.
3) Maintains all of the uses currently allowed in the three subdistricts and add a few
more as permitted that had been inadvertently left out before. Commercial uses
would be permitted in the NG-3 as a mixed use concept.
4) Requires a maximum setback of 10' and prohibits parking in front and side street
yards, thus requiring buildings to be pulled up to the front property line. Buildings
may be set back farther only if the additional yard space is devoted to semi-public
uses (wider sidewalks, seating areas, cafe's, etc.) Also requires a minimum building
height of two stories in all of Northgate and a minimum density of 18 dwelling units
per acre. All of these restrictions are intended to promote the character of Northgate
as a small downtown area with higher density housing.
5) Does not require any parking in NG-1. Standard parking numbers found elsewhere in
the City are required in NG-1 and NG-3 but a parking study may reduce these
numbers if approved by the PRC.
6) Requires pedestrian-oriented elements such as street trees, bicycle parking, public
sidewalks, access to buildings to be off of public spaces, and civic (semi-public)
areas on larger developments.
7) Restricts signage to building signs only, where signs cannot exceed 8 square feet and
must be either parallel or perpendicular to the wall. Freestanding signs will be
prohibited, as well as all signs that are currently prohibited in other areas of the city.
One low profile sign may be used within civic use areas.
8) A building design section begins to regulate building aesthetics by prohibiting certain
materials, requiring windows on the ground floor of commercial buildings, and
requiring pedestrian-oriented features on facades. The draft also includes a reserved
section for future insertion of certain materials that will limit future construction. The
recommended section may be presented to the Commission at the November 8
meeting.

I spoke with Natalie about my thoughts on this. She agreed that I would continue updating the Zoning
Ordinance on the O drive = O/Group/Development Services/Zoning Ordinances/Zoning Ordinance. I will
then provide a master copy for our Customer Services Reps and Tammy, our Secretary, to use in
making copies to update the existing Zoning Ordinance Books. You could then retrieve the updates
electronically in the files mentioned above, if that is okay with you. Tell me your thoughts. Does this
sound like a plan and one that would minimize the paper work and confusion? Let me know. I'm here to

would we be responsible to keep them updated? If we have to do it, how would I know when the updates

When I was speaking with Harvey yesterday, we realized that he does not have the most up to date copy
of the zoning ordinance. He asked that I get him updated copies, including ones for Roxanne and Carla.
I was not sure whether they have bound copies of the zoning ordinance or if their's are in three ring
binders. We'll bring over hard copies of the current zoning ordinance, subdivision regulations, as soon
as we get more copies in. And, I'll walk over the PD policy paper right now.
If their copies are in three ring binders, please get with Susan Hazlett when you both get back from
vacation, and she can let you know where the ordinance is on the system. Then.y'all can print out
updates whenever you need to.
