HomeMy WebLinkAbout00071357ordinance was adopted in 1989, this area was called the minimum reservation area. It was defined as an area twenty feet wide running parallel to the floodway on either side of the creek. As property developed, developers had an option to dedicate this property for the City to ultimately improve or to improve it themselves and maintain it or dedicate to the City after making improvements. Much of the minimum reservation area has been dedicated for the upper reach of the creek from Texas Avenue to the Dartmouth / Holleman intersection. Over the history of development in the Wolf Pen Corridor there have been disagreements as to the location of the floodway itself. Several engineered studies have been done over the life of this project. When the master plan was revised in 1998 an oversight committee was established to oversee implementation of the master plan. This committee consists of Council, P&Z, Parks Board and staff members. The Committee decided last year to recommend that the city fund the design for the trail system for the downstream portion of the creek to better establish where those areas would be that would ultimately contain the trails and other improvements. Kee, City Planner eptember 27, 2001 im Callaway, Development Services Director Item: Public Hearing, discussion and possible action on an amendment to the Wolf Pen Creek zoning district pertaining to dedication and development of the minimum reservation area. Item Summary: Under the present ordinance, a developer must either dedicate or develop the area known as the minimum reservation area. This is an area defined as 20 feet on either side of the floodway. This proposed amendment does two things: 1. It includes more specific descriptions for the minimum reservation area for the downstream portion of the creek (from the Dartmouth /Holleman intersection east to Earl Rudder Freeway). The design engineer has actually determined where trails would be located and exactly what property is necessary for these trails. 2. The developer now has the option to dedicate this better - defined area as a drainage and access easement rather than as a fee simple dedication. He still has the other option to actually develop the improvements himself and maintain the improvements. Item Background: The Wolf Pen Creek Master Plan adopted in 1988 provides for hike and bike trails throughout the park along the creek. Kee, City Planner RE: Wolf Pen Creek Ordinance Amendment DATE: August 17, 2001 As you are aware the Wolf Pen Creek Master Plan adopted in 1988 suggested that areas along the creek be used for hike and bike trails throughout the park. When the ordinance was adopted in 1989, this area was called the minimum reservation. It was defined as an area twenty feet wide running parallel to the floodplain on either side of the creek. As property developed, developers had an option to dedicate this property for the City to ultimately improve or to improve it themselves and maintain it or dedicate to the City after making improvements. Over the history of development in the Wolf Pen Corridor there have been disagreements as to the location of the floodplain itself. Several engineered studies have been done. One of the larger landholders in the area, Paul Clarke felt that a better definition of where improvements would be made was necessary. As part of the Wolf Pen Creek Oversight Committee meetings (a group of Council, P &Z, Parks Board and staff charged with implementation of the plan) an idea evolved to have the design engineer working on the trails and bridge describe by metes and bounds the areas needed for trail development up front for the lower reach of the creek. In some cases this is less than the original minimum reservation and in some cases the areas are not defined by the floodplain at all. This way when a property develops it is clear what will be needed. The developer still has the option to dedicate or develop improvements and then maintain or dedicate. It simply better describes the areas where trail and other improvements will be placed. This ordinance amendment incorporates these metes and bounds descriptions for the upstream portion of the creek (from Dartmouth west to Texas Avenue) and clarifies what is required at the time of development relative to these described areas. 01 -135 01 -135 01 -135 ADVANCE STORES CO INC #5087 AGUA RICA LTD BRYAN RADIO & TV SERVICE INC ATTN: TAX ACCOUNTING 3608 E 29TH ST STE 100 4105 TANGLEWOOD DR PO BOX 2710 BRYAN, TX 77802 -3814 BRYAN, TX 77802 -4018 ROANOKE, VA 24001 -2710 01 -135 CAMP HOLDINGS LTD 2400 EARL RUDDER FWY S COLLEGE STATION, TX 77840 -4082 01 -135 CAPTEC FRANCHISE CAPITAL PARTNERS LP IV PO BOX 544 ANN ARBOR, MI 48106 -0544 01 -135 COLLEGE STATION, CITY OF ATTN: ACCOUNTING DEPARTMENT PO BOX 9973 COLLEGE STATION, TX 77842 -7973 01 -135 DALE, DON RAY LTD C/O DRD MANAGEMENT LLC PO BOX 10405 COLLEGE STATION, TX 77842 01 -135 KAHAN, DENA BETH & DAVID LEE KAHAN C/O LESLIE FEIGENBAUM COLLEGE STATION, TX 77845 -7710 01 -135 DAVIS, BOB R & ERIN P O BOX 564 WACO, TX 67603 01 -135 LACOUR INVESTMENTS C/O CHARLES D LACOUR PO BOX 13266 PENSACOLA, FL 32591 -3266 01 -135 JPJ INVESTMENTS & REAL ALCHEMY I LP & CLARKE & WYNDHAM INC 3608 E 29TH ST STE 100 BRYAN, TX 77802 -3814 O1 -135 LAREY,EUGENE 103 CASTANO DR HOT SPRINGS, AR 71909 -4513 01 -135 01 -135 01 -135 MARTINEZ, ISRAEL & MICAELA MCGILL, DAVIS & THELMA FAMILY, MOONDANCE INVESTMENTS, LTD 1810 LOWRY RD DAVIS T. Kee, City Planner RE: Wolf Pen Creek Ordinance Amendment DATE: November 1, 2001 At your September 27` meeting, the Commission recommended approval of an amendment to the Wolf Pen Creek district regulations regarding the minimum reservation area. Council subsequently approved this amendment which incorporated specific metes and bounds descriptions for the downstream portion of the creek (from Dartmouth/Holleman east to Earl Rudder Freeway) matching those areas designed by the consulting engineer. Recall that the amendment also provided for the private property owner to develop the improvements himself, dedicate the property or simply grant an easement so that the City can construct improvements at a later date. This amendment does two things: It incorporates more specific language regarding what improvements might ultimately be in the minimum reservation areas. The City Attorney recommended this change after the previous amendment had been approved by Council. That language is underlined in the proposed ordinance. 2. It incorporates the final metes and bounds descriptions. The described areas have not changed, but the documents are now signed by the engineer and no longer say "preliminary ". This is set for a public hearing, as it is an amendment to the Zoning Ordinance. It is set for Council consideration on December 6, 2001.
