was defined as an area twenty feet wide running parallel to the floodway on either side
of the creek. As property developed, developers had an option to dedicate this property
for the City to ultimately improve or to improve it themselves and maintain it or
dedicate to the City after making improvements. Much of the minimum reservation area
has been dedicated for the upper reach of the creek from Texas Avenue to the
Dartmouth / Holleman intersection. Over the history of development in the Wolf Pen
Corridor there have been disagreements as to the location of the floodway itself.
Several engineered studies have been done over the life of this project. When the
master plan was revised in 1998 an oversight committee was established to oversee
implementation of the master plan. This committee consists of Council, P&Z, Parks
Board and staff members. The Committee decided last year to recommend that the city
fund the design for the trail system for the downstream portion of the creek to better
establish where those areas would be that would ultimately contain the trails and other
improvements.

Staff Recommendation: Staff recommends approval of this ordinance as written. The
Planning & Zoning Commission recommends unanimous approval as well.

Item: Public Hearing, discussion and possible action on an amendment to the Wolf Pen
Creek zoning district pertaining to dedication and development of the minimum
reservation area.
Item Summary: Under the present ordinance, a developer must either dedicate or
develop the area known as the minimum reservation area. This is an area defined as 20
feet on either side of the floodway. This proposed amendment does two things:
1. It includes more specific descriptions for the minimum reservation area for the
downstream portion of the creek (from the Dartmouth /Holleman intersection
east to Earl Rudder Freeway). The design engineer has actually determined
where trails would be located and exactly what property is necessary for these
trails.
2. The developer now has the option to dedicate this better - defined area as a
drainage and access easement rather than as a fee simple dedication. He still
has the other option to actually develop the improvements himself and maintain
the improvements.

the design engineer working on the trails and bridge describe by metes and bounds the
areas needed for trail development up front for the lower reach of the creek. In some

not defined by the floodplain at all. This way when a property develops it is clear what
will be needed. The developer still has the option to dedicate or develop improvements
and then maintain or dedicate. It simply better describes the areas where trail and other
improvements will be placed.
This ordinance amendment incorporates these metes and bounds descriptions for the

It did go to both P&Z and CC. However, after it was approved, our Legal Staff determined that we need
to add some additional language to accomplish what we need.
So, the newest item on the tracking sheet is an ord. amending Chapter 12 (Zoning Ordinance), 7.21D of
the Code of Ordinances to provide for public improvements or structures that are reasonably necessary
for pedestrian access in the minimum reservation area of Wolf Pen Creek.

RE: Wolf Pen Creek Ordinance Amendment
DATE: November 1, 2001
At your September 27` meeting, the Commission recommended approval of an
amendment to the Wolf Pen Creek district regulations regarding the minimum reservation
area. Council subsequently approved this amendment which incorporated specific metes
and bounds descriptions for the downstream portion of the creek (from
Dartmouth/Holleman east to Earl Rudder Freeway) matching those areas designed by the
consulting engineer. Recall that the amendment also provided for the private property
owner to develop the improvements himself, dedicate the property or simply grant an
easement so that the City can construct improvements at a later date.
This amendment does two things:
It incorporates more specific language regarding what improvements might ultimately
be in the minimum reservation areas. The City Attorney recommended this change
after the previous amendment had been approved by Council. That language is
underlined in the proposed ordinance.
2. It incorporates the final metes and bounds descriptions. The described areas have not
changed, but the documents are now signed by the engineer and no longer say
"preliminary ".
This is set for a public hearing, as it is an amendment to the Zoning Ordinance. It is set
for Council consideration on December 6, 2001.
