HomeMy WebLinkAbout00071349Memorandum To: Project Review Committee From: Ted Mayo P.E. , Assistant City Engineer Date: June 13, 2001 Re: Variance consideration for driveways located on a single family residential lot at 3203 Salzburg This item is consideration of a driveway variance request for a new single family residence located at 3203 Salzburg in Edelweiss Section 14 Subdivision. The City's driveway ordinance normally allows one curb cut for a single family residence with a maximum width of 28'. A circular drive may be allowed but the combined width of the two drives may not exceed 28'. More than one curb cut may be allowed upon approval by the City Engineer or his designee. The residence was constructed with a 32' wide driveway near the south corner of the property from the street to the house for a two car garage and single car carport. Also constructed was a 15' semicircular drive from near the north corner of the property to about midway of the 32' driveway. This situation was brought to my attention last week. A driveway permit is not required with this construction since it is new construction and the driveway is reviewed with the site plan. In this case the site plan did not detail the proposed driveway. The building inspectors were not aware of a plan to vary from the driveway ordinance until the driveways were constructed. I am comfortable with allowing the 32' driveway to accommodate the three vehicle parking requirement but I do not support the additional 15' semicircular driveway. The variance request is an appeal to my position not to allow the semicircular driveway. The purpose of bringing this case to the PRC is to allow due process to the applicant in consideration of her variance request. Attached is an appeal by the property owner to the City Engineers' interpretation of driveway footage for 3203 Salzburg Court, Edelweiss Subdivision; a memorandum from the builder Robert Mills; and a memo for record from City Building Official Lance Simms. • " ' Memo for Record / S From: Lance Simms, Building Official •�' + Date: 12 June 2001 RE: 3203 Salzburg Court On 28 February 2001, the Building Division issued a building permit for a single family home to be constructed at the above referenced address. The site plan submitted (see attached) with the building plans did not indicate the proposed driveway location. During the week of 28 May, a building inspector noticed that the driveway width did not appear to meet the residential driveway ordinance requirement as it relates to the maximum allowable driveway width. Upon further investigation, Carl Warren, Plans examiner, contacted the builder Robert Mills (builder) about the driveway width. Carl recommended that Mr. Mills contact one of the engineers in Development Services for further information. On Wednesday (6 June) I spoke with Fran Lamb (homeowner) about the driveway situation. That same day, I field verified the driveway dimensions and sketched them on the site plan (see attached). The interior of the in -lags suite contains special handicapped previsions for the parents. In addition, the drivewati access was designed at the specific request of Dr. and Mrs Lamb to enable the parents to have a safer and easier access to their carport at the residence. For your information, I have received nothing in writing that states this ruling, but rather was given this information verbally by Lance Sims on Wednesday, June G. I appreciate his willingness to share this information with me so promptly. As background to the issue, let me stress that Robert Mills Homes has been most cooperative and supportive of'the various suggestions my husband and I made regarding the construction specifications of our new home. Mr. Mills has taken all our needs into consideration when designing the home and has been able to accommodate almost all of them, specifically the handicapped provisions we made for my husband's parents. My husband's father and wife (James and Bernice Lamb) are in their 80s. While they still have their mental faculties, physically, they are declining. Jaynes Lamb still drives, although he has a certified handicapped parking permit, and they use their automobile to drive short distances to the College Station Medical Center Complex for doctor appointments and to the Kroger Shopping Center for grocery shopping and pharmacy needs. The use of their automobile, although limited to short distances, has provided them with the ability to maintain the independence and dignity they deserve. ,u4U11 6 4� l4yC TA9O SYSTEM &A OfiIUErOI 15:20 P.OQ l00 They currently live at the Villas of Rock Prairie retirement center, approximately 1.5 miles from The Med. Dr. Mason, their I physician, has' submitted a letter in support of their wish to continue to drive (attached). The interior of our new home at 3203 Salzburg includes numerous handicapped provisions for the ease of James and Bernice Lamb's impending move into our new home including sloped doorway entrance to their side of the residence, lowered cabinets for storage, wider hallways, raised toilet seat, and specially designed shower with seat. The finishing touch on all the special requests was intended to be the expanded driveway entrance, designed to give them an easy access to the carport parking which we had built for their specific use. When I heard from Lance Sims that the drive way exceeded the minimum number of 28 feet at the street, I was dismayed. This restricted size of 28 feet for our 2 -car garage and attached carport entrance is obviously not adequate to allow for the necessary space for access to the handicapped carport entrance. Therefore, I am respectfully requesting that the PRC review the ruling, reconsider the circumstances, and grant an exception in this case.
