SUBJECT: Driveway Variance for property located on Salzbu Sin Edelweiss Section
14 Subdivision: the proposal of a driveway variance for the driveway
located on a single- family residential lot at 3203 Salzburg (01 -143)
The PRC held a meeting on Wednesday, June 20, 2001 to review the above - mentioned
project. Mrs. Fran Lamb brought it to the board's attention that this house will be a
single - family dwelling but it will include a suite for her in -laws which are in their 80's
and mobile. Mrs. Lamb stated she asked her builder Robert Mills of Mills Homes to
make certain provisions for the handicapped. The one provision in question today is
the driveway area where there is a 32' straight entrance from the street, which is meant
to access the 3 car garage plus a 15' semi - circle drive. The idea was to provide for her
in -laws a safe environment. Asst. City Engineer Mayo stated that this normally doesn't
require a driveway permit but it was not addressed with the original site plan. When
the house was built, it was obviously in excess of the normal Driveway Access Design
Policy, which is part of Ordinance 1971 (Chapter 3 of City's Code of Ordinances). The
ordinance only allows 28' curb cut for a single - family residence. The engineer can
approve the variance but Mayo stated he didn't feel comfortable approving the variance
from 28' to 47'. Asst. City Engineer Mayo said that the lot has 85 -foot frontage, which
would have 47' in pavement. Mr. Mayo questions if this is going to create precedence
for other lots to have a variance. Commissioner Happ asked why this didn't go to ZBA.
Staff Planner Jimmerson stated that it is written into the driveway ordinance that the
board for appealing is the PRC. Commissioner Happ question what is the intent of the
amount of the driveway cut? Mayo stated it is for control of traffic on city streets.
Commissioner Happ stated that he doesn't necessarily agree that this will set a
precedent because the homeowner does have handicapped need. Commissioner Floyd
said that it does take up a quite a bit of space and looks more like a commercial

property than residential. Commissioner Happ asked Mrs. Lamb what was the reason
for the curve drive and straight entrance. He felt either one should sufficient. Mrs.
Lamb stated it was a preference thing. Asst. City Engineer Mayo stated the builder was
premature in building the two driveways and it wasn't on the site plan. Commissioner
Floyd asked that with a 2 -car garage and a carport, how would the driveway normally
look? Asst. City Engineer Mayo stated that there wouldn't be a semi - circle driveway
but the 32' straight entrance from the street only. Mrs. Lamb asked if it is legal to pave
the entire front yard, as long it doesn't touch the street. Commissioner Happ said yes
because all they need to worry about is the curb cuts. Asst. City Engineer Mayo stated
our driveway criteria only apply to the public, so anything on private property can be
widen out. The concern comes when someone uses the extra space for other uses such
as parking a mobile home. Commissioner Floyd states that they have to consider the
future history of the structure and what each owner might do. Commissioner Happ
moved to approve. Commissioner Harris seconded. Commissioner Happ asked if there
was a way to make sure that the next owner would have to come back into compliance.
Commissioner Floyd said we don't have the right to do that and he doesn't support this
motion. Commissioner Happ stated that he is torn between someone who has a need
and felt that the single driveway does meet the need. Commissioner Happ and
Commissioner Floyd voted against the first motion therefore, the motion failed.
Commissioner Happ motioned to approve the 32 -foot increase from 28 foot for single
driveway to go in and out and removal of the curb cut and the associated curve drive.
Commissioner Harris seconded and the motion passed 3 -0.
