(Phases 6 - 10 are their most recent phases towards the back of the subdivision near Barron Road.) The money we collected was the old fee of $225 per lot. When they were planning Phases 6 - 10 in Shenandoah and Phases 1 - 5 in Alexandria, they dedicated land to satisfy their entire requirement (before the development fee was required.). Around the time of Phase 7 in Shenandoah, their preliminary plat expired which grandfathered them under the old parkland ordinance. We allowed Phase 7 to develop without paying the development fee. It's my opinion that we should require the development fee with Phases 8 and up. Mike's working on the new master plan now. We should make decisions on the land dedication and let them know that as phases develop or final plat, they will be required to pay the development fee. I hope this answers you question. Please let me know if this is as clear as mud. (1- 500148) Applicant: EDWARD FROEHLING Staff Recommendations: Staff recommends approval with Staff Comments. Item Summary: Shenandoah Subdivision, Phases 7 thru 10 is located off Barron Road and across from Alexandria Subdivision. Phase 6 is complete. A Master Preliminary Plat for Shenandoah Phases 6 - 10 was approved in 1998. That MPP has expired. The Applicant submitted a Final Plat Application for Phase 7A and 7B. However, the application was not accepted due to the fact that a current Preliminary Plat was not on record. Because the Plat had expired, Staff wished to take the opportunity to look at connectivity in the area. This tract abuts the Crowley tract. Alexandria is no longer being extended through and will dead -end in Shenandoah. The City is asking the Developer to extend a residential street to the northeast adjacent tract. It has not been decided which of the streets will be extended. The extended street will transect the park and the Parks Department wants to work closely with the Developer in deciding this aspect of the project. The City asked the Developer to oversize the sewer line from Shenandoah to the Spring Creek Trunk Line. The Developer had obtained a sewer easement and was installing an 8" line for the project. A 12" line was requested to better serve the area. The City also asked the developer to extend sewer to the adjacent tract to the southwest. The extension is shown on the plat on Lexington Lane. Parkland dedication was discussed with the original plat. The Developer has dedicated an 8 -acre portion of the area to date. The City will allow the Final Plat of &A and 7B to move forward with the current parkland dedication. Further plats will require the remaining land to be dedicated. This park will connect to the Greenspace in the Crowley addition. It should be understood with this Master Preliminary Plat that Phases 8 - 10 may slightly change. The Developer is assessing the idea of acquiring other property in the area and, if this occurs, the street layout may change. Also, as mentioned above, the through- street location has not been established. Comprehensive Plan Considerations: Land Use Plan: The LUP depicts this area as single - family, residential. Thoroughfare Plan: The T -Plan shows Southern Plantation Drive continuing to the southwest as a minor collector. Parkland Dedication: As discussed above, the Developer can final plat Phase 7A and 7B. Phases 8 thru 10 will require the dedication of the remaining parkland. Open Space Dedication: The parkland is being dedicated to the City. The park is part detention pond, part open space and part greenway. This park will join with the Greenspace in the Crowley Development. Special Area Plans: N/A Budgetary & Financial Summary: The City has requested the Developer to increase the downstream size of the sewer line from 8" line to 12 ". He is amenable to making a street connection to the east. This will go thru the parkland that is still to be dedicated. I will talk to parks about how they feel about a residential street going thru this area and report back to Spencer before he writes his staff report. As for the master plan, Spencer will recommend approval with the condition that the street connection east be made from one of 3 streets and that the exact location be determined at a later date with a revised master plan. As for the 4 acres that has still not been dedicated, I told Mike that because he still has more lots that could be built with the dedication that has already been made (this is somewhat of a stretch since part of the dedication that has been made includes a detention facility), that in the interest of facilitating development we would allow the phase 7 to go on to final plat. Spencer will cover this in his staff report so that it's in writing. The park boundary will change when the street connection is made so it makes sense to hold off on the dedication a while longer. If this is mud to anyone feel free to stop by and we an talk about it. Ric felt like the most southerly street wouldn't be a problem and that maybe the middle culdesac wouldn't be a problem. Because of the topo south of the middle culdesac, there probably wouldn't be much park development anyway on that southern side. He says he thinks the board would be very opposed to extending the northern culdesac or the street that would run adjacent to the detention pond. They try to keep streets, even residential ones, from cutting their parks in half so kids don't have to run back and forth. He really thought they would like the idea of more park east of the 8 acres so if Froeling decides to buy the property east then a relocation of that 4 acres might be well supported by parks. They have this on the August Parks Board meeting just to talk about the street connectivity issue and see how the board responds. We probably need to be at that one. So, Spencer the report can still recommend approval with the connectivity issue to be resolved pending parks board consideration.
