I was asked to contact you about landscaping in the Gateway Subdivision. Rockfish will need to submit a
survey of the existing trees in the 24-ft. landscape reserve. The reserve line is measured from the public
right-of-way back 24 ft. Trees of 4-inch caliper or more must be preserved.

SUBJECT: ROCKFISH RESTAURANT - SITE PLAN
Staff reviewed the above-mentioned site plan as requested. The following page is a list of staff
review comments detailing items that need to be addressed. Please address the comments and
submit the following information for further staff review and approval of the plans:
Six (6) complete sets of construction documents for the proposed development,
including the Erosion Control Plan..
Two (2) site and landscaping plans.
If there are comments that you are not addressing with the revised site plan, please attach a
letter explaining the details. If you have any questions or need additional information, please

RockFish Restaurant: The site plan shows a 12 x 12 dumpster pad, but cuts a corner of the enclosure
off in the back with what looks to be a wall. It shows the corner of the container set against this wall.
Enclosure needs to have an inside dimension of 12 x 12 feet. The general notes comment to see the
architectural drawing for details. Do we have those?
River Place Subdivision Ph 3: Sanitation is OK with this one.

We are looking at our drawings now to revise. I think what happened is we
had the 12x12 pad on our drawing but we had to have the architect revise the
back portion of the building along with the walk in cooler and dumpster
area. I think when we got the architects drawing back he had revised the pad
dimensions and we didn't recognize it. We can get a 12x12 in and are doing
so now with the revised drawing. Thanks and tell Pete thanks for checking
it - we would much rather fix it now than in the field when time frames are
critical and tempers can flare.

I'm sorry. I thought that the attached e-mail from Pete had already been
forwarded to you. It came in after comments had gone out while I was on
vacation.
I just called Pete and left a message with him, trying to determine if he
had sheet AS1, which shows the dumpster in more detail. I am ready to stamp
the project with the exception of this one issue. I will let you know when
I hear from Pete, or you are welcome to talk with him yourself. I will be
in and out of predev's the rest of the afternoon.

No, I don't know about the dumpster concerns. We are ready to print today
all of these today so if I can talk to one of you before I print we can try

Re: Parking Variance Request and Rezoning Request for Lot 5, Block I of the Gateway Subdivision -
Rockfish Restaurant
Lot 5, Block 1 of the Gateway Subdivision is currently planned for a Rockfish Seafood Restaurant.
The site plan has been submitted for the restaurant and site plan approvals have been obtained
based upon the restaurant not seating the large outdoor patio area and instead using this as a
standing waiting area. The interpretation of the parking section of the Zoning Ordinance requires
that if seating is allowed on the patio, the area
must be included in the parking count. This
site is short 10 spaces from meeting the
parking count required to seat the patio area.
The following variation is requested from the
ordinance that requires that "...there shall be a
twenty-four foot (24') setback to act as a
landscape reserve. Existing trees of four-inch
(4") caliper or more must be preserved...
There are seven trees that fall within this 24'
setback, which we would like to remove and
replace with new trees with similar point count.

This variance is necessary because the trees contained within the first 24' of this property are all
Post Oaks. The site has had large equipment and vehicles parking under the trees in question. As
evidenced by the photograph, one can see that the area has been used over the past several
months as a storage area for the TexDOT University Drive construction project. The root systems of
these trees have been compacted with this equipment. As such, their chance of survival after
construction is questionable, even if protected during the Rockfish construction.
The unnecessary hardship involved by
meeting the provision of the ordinance is that
the survival likelihood of these trees is minimal
at best based upon recent TxDOT construction
in the area. As seen on the adjacent
Cheddar's Restaurant site, even with tree
protection, which Cheddar's provided during
construction, the survival rate of these type of
trees is questionable, as evidenced by the
recent loss of two protected trees.
The following two alternatives to the requested
variance are possible:
1. Provide the needed parking offsite in
the adjacent Lot 1 of the Gateway
Subdivision.
2. Allow an interpretation to the parking section, which would not require parking for the patio
areas.
This variance will not be contrary to public interest because even though several large trees would
be removed, the site aesthetics, which is the purpose of the ordinance, will be improved by the
planting of new trees to replace the ones removed. The site landscape plan has not counted these
seven trees in their landscape point requirement and will not count the replacement trees such that
these will be in addition to the required landscaping.
