I will then get the necessary signatures and deliver this plat to Development Services. There are several signatures to get on this plat and one is out of town. If anything is added or changed on the plat, I would have to get all the signatures again. My engineer, David Mayo, has calculated the cost difference in the pavement and other applicable utilities. His Construction Estimate is based upon actual per unit prices we have received from Young Brothers (who competitively bid the project against Texcon). The total O.P. I request is $70,623.91. The final plat is due to go before P&Z for approval on August 16, 2001 and we expect to start construction prior to that date. Therefore, time is of the essence. (1-500167) Applicant: Mr. Randy French, BCS Development Corp. Staff Recommendations: Staff recommends approval as submitted Item Summary: The Preliminary Plat for Westfield Phase 3 was approved by the Commission February 15, 2001. The Final Plat includes 51 lots zoned R-1, two lots along Graham Road zoned C-3, and 2.46 acres of Lick Creek floodplain to be dedicated to the City's Greenway Program. The plat meets state and local requirements. The Plat also conforms to the approved Preliminary Plat with the exception of the phase line. The phase line was included due to the fact that these lots are dependent upon sewer and access to be constructed in Westfield Phase 2. It should be noted that Lot 1-A, Block 8, will not be permitted separate driveway access to Graham Road under the Driveway Ordinance. The Commission may opt to require a private access easement that would extend from Lot 1-13 into Lot 1-A. Westfield Phase 3 will include construction of Victoria Avenue, a major collector, from the Graham Road intersection across Lick Creek. Along with the street, the Developer will construct a 12-inch waterline as part of the City's infrastructure. The street and water extensions in and along Victoria will facilitate the development of Edelweiss Garten by providing contiguous infrastructure to tie on. This phase of Westfield is "leap-frogging" Phase 2, as Phase 2 is not quite ready for a Final Plat at this time. The postponement of Phase 2 means that the developer of Phase 3 will not have the benefit of tying into existing public streets and utilities. The applicant for Phase 3 will therefore be extending sewer through Phase 2 and will be providing access and sewer with the Victoria extension. The proposed infrastructure extensions will satisfy the Subdivision Regulations for provision of access and utilities, with the exception of lots in Phase 313. Staff has performed a preliminary review of construction documents for Phase 2 in order to facilitate the construction of the two subdivisions so that there is no replication of infrastructure and so that the final design best serves the City. Comprehensive Plan Considerations: Land Use Plan: The City's LUP shows this area to be single-family residential. The corner property was rezoned in 6/98 as C-3. Thoroughfare Plan: The City's TP depicts both Graham Road and Victoria as major collector status. Westfield Phase 3 will continue Victoria as a major collector. The construction project will include a culvert crossing of Lick Creek. Parkland Dedication: Parkland dedication was done in Phase I for the future phases of Westfield. The Parkland Development Fee will be applied to this plat at $309.00 per single-family lot. Open Space Dedication: Although the current Subdivision Regulations do not require Greenway dedications, the Developer of Westfield Phase 3 will dedicate to the City the Lick Creek floodplain as Greenway. The Greenway will be left as natural as possible with the exception of a pathway/ culvert at the north end to serve as detention in situations of high flow and a future walkway parallel to the creek. It is envisioned that a walkway will extend the entire length of the Lick Creek Greenway to SH 6. Highway 6, South College Station, Tx. 77845 RE: Master Plan for balance of Westfield Dear Randy: When Mr. Szabunicwicz first came to the City with Westfield, it involved 3 separate tracts of land, each about 15 acres. It did not include the larger tract south of what is now Westfield. In fact Mr. Szabunicwicz was very emphatic that the larger tract to the south was under a different ownership and was not to be included with the Westfield development. The master development plan submitted covered only these 3 tracts of land and was called Westfield Phases 1-4 (containing the entire 45 acres). This master plan was approved with the approximate 4.3 acre parkland dedication. When The Parks Board considered Mr. Szabunicwicz's request in January of 1998, he asked whether any dedication above and beyond the requirement for Westfield could be credited to him if and when he did any further developing in this particular park zone. At that time he still had no development plans that he had shown the City for the larger separate tract to the south. As I read the minutes of the Parks Board meeting it sounds as though the Board agreed to give some credit to Mr. Szabunicwicz for future development he might undertake in this park zone, as long as that development took place within a 10 year time frame. I cannot authorize another developer to use Mr. Szabunicwicz's dedication. That is why I suggested you talk to Steve Beachy and go back before the Parks Board. They must make this determination. If Mr. Szabunicwicz decides to develop another tract of land in this park zone, he could claim that the Board gave him some prior credit for parkland. Tome it is simply not clear whether any overage was to go to a specific tract or to a specific developer. I will forward your letter and this response to Mr. Beachy so that he will be aware of the situation and can place your request on a future Parks Board agenda. I fail to understand why the City will not allow me to use credits from the original developer for Westfiled Phase 1 to apply to the balance of the 90 acre mother tract. I don't understand why change in ownership would affect anything. With the original developer, the mother tract was 90 acres and there was 4.29 acres dedicated for parkland. Now that I own the tract, there is still 90 acres and 4.29 acres dedicated. Just because part of the mother tract is sold, to me, is not a valid reason for the City requiring more parkland. have enclosed random correspondence that I have in my file regarding the parkland dedication. One important note is that when I acquired the tract and developed Westfiled Phase 3, the parkland dedication from Phase 1 was allowed. When I bough the land from the original developer, part of the negotiations was that I was to get the parkland dedication credits. In addition to the parkland dedication, there are several acres that have been and are to be dedicated to the City as a part of the Greenbelt program. As you can see in our master plan study, we have incorporated that concept. Please consider my point of view. I am anxious to get this project started but will need to know how to proceed.
