Item: Discussion, and possible action on a revised site plan in the Wolf Pen
Creek Development Corridor for the Fazoli's Restaurant located on the southeast
corner of Harvey Rd. and George Bush Dr. East (00-68).
Applicant: Municipal Development Group
Staff Recommendations: Staff recommends approval of the revised site plan.
Item Summary: Last year the applicant went through the site plan review
process and gained approval of their proposed site plan. However, in the course
of site inspections conducted during the development and building of the project,
it was discovered that multiple changes had been made to the site, without the
approval or knowledge of staff or the appropriate boards.
Staff cannot issue a full Certificate of Occupancy if the approved site plan is not
followed. The applicant is therefore coming before the appropriate boards to
gain approval of the all the changes. In an effort to work with the applicant, the
City did grant a temporary 60 day C/O, with the condition that all necessary
approvals must be granted or the site must be brought into compliance with the
originally approved site plan.
The changes are:
1. A 2-foot sidewalk was added along the drive-thru up to the window.
2. The exit of the drive-thru was expanded from 12 to 22 feet in width.
3. A sidewalk was added from the southern service door to the drive-thru.
4. The brick paver area that was planned for across the drive-thru is now
proposed to be concrete with a paving treatment to make it look like
pavers. This same treatment is being proposed for the driveway on
George Bush.
5. The applicant would like to spell out Fazoli's in greenery on the berm at
the corner of Harvey and George Bush.
In addition to the changes proposed, the applicant is also requesting approval of
the sign face to be added to the freestanding sign shared with Office Max. In
April of this year, the applicant began discussions with staff about receiving
approval of the sign faces to be placed in the existing freestanding sign. The
existing sign has a vacant section, intended to be used by whomever occupied
the pad site. Upon researching the minutes from the DRB and P&Z meetings it
was discovered that, although discussion had taken place regarding Fazoli's
signage, the only approval received was for signage attached to the building.
Comprehensive Plan Considerations: All site plans within the Wolf Pen Creek
Development Corridor are subject to review by the Design Review Board (DRB).
The DRB evaluates site plans and the appearance of the development for
compliance with the City's Land Use Plan and development codes, and guided
by the Wolf Pen Creek Corridor Study and Master Plan. Specifically, the DRB
has discretionary review over lighting; garbage; utility service; relationship of
building to site; relationship to adjoining areas; landscape transition; harmony in
texture, lines, and masses; park access easements; building design; materials;
colors; signs miscellaneous structures and street hardware; and maintenance.
The DRB makes recommendations to the Planning and Zoning Commission
regarding proposals for development in the Wolf Pen Creek corridor.
Item Background: The site plan was originally approved by P&Z, with staff and
DRB recommended conditions, in May of 2000. Construction began in March of
this year.
Related Advisory Board Recommendations: The DRB met on June 13th of
this year to review the revised site plan. They recommend approval of the
changes over which they have purview and of the proposed face for the
freestanding sign shared with Office Max. The Planning and Zoning Commission
has the final authority over these items. Meeting minutes are attached.
The ZBA met on July 10th of this year to consider the applicant's request for a
variance to the 180sf end island requirement. They denied the variance request.
The ZBA has final authority over this issue. A draft of the meeting minutes are
attached. The applicant has submitted revised plans, showing compliance with
this requirement.
Commission Action Options: The Commission has final authority over site
plans in the Wolf Pen Creek District. The Commission's options are to:
■ Approval as submitted;
■ Approval with conditions;
■ Table;
■ Defer action; or,
■ Deny.

WOLF PEN CREEK DESIGN REVIEW BOARD

Fazoli's Site Plan (00-68)
All proposals involving site development or redevelopment in the Wolf Pen Creek
Corridor District shall require a review by a subcommittee of the Wolf Pen Creek Design
Review Board (DRB):
Zoning District: WPC, Wolf Pen Creek
Location: 400 Harvey Rd.
Applicant: Bob Davis
Item Summary: This project is coming back before the DRB to review several items.
Staff has become aware of multiple changes that have been made on site that are not
in compliance with the approved site plan. These changes have been made without the
knowledge of staff, DRB or P&Z. At this time, the WPC zoning district regulations do
not allow for staff to approve even minor changes to a site plan. Therefore, in order for
a full Certificate of Occupancy (C/O) to be issued, the changes must be reviewed by the
DRB and approved by the P&Z. Approval of one of the changes will involve ZBA
granting a variance.
At this time, the applicant is also requesting approval of the sign face to be placed on
the existing freestanding sign.

Then in April of this year, the applicant began discussions with staff about receiving
approval of the sign faces to be placed in the existing freestanding sign. The existing
sign has a vacant section, intended to be used by whomever occupied the pad site.
Upon researching the minutes from the DRB and P&Z meetings it was discovered that,
although discussion had taken place regarding Fazoli's signage, the only approval /
received was for signage attached to the building.
While preparing to bring the sign request to the DRB and P&Z, it came to the attention
of staff that site-plan changes were occurring in the field. After discussions with staff,
the applicar became concerned a o emg a le o receive a C/O in time for their
planned grand opening on June 11th. Therefore, the applicant has agreed to comply
with the previously approved site plan if the necessary approvals are not received by
the required Boards and Committees. Actions required for compliance may include, but
are not limited to, the demolition and removal of existing improvements. With this
understanding, staff may grant a conditional C/O permitting the applicant time to pursue
the necessary approvals and variance. The applicant is fully cognizant of the City's
intention to go into enforcement if the terms of the conditional C/O are violated.
Issues/items for Review:

3. A sidewalk was added from the southern service door to the drive-thru.
4. The brick paver area that was planned for across the drive-thru is "osed~

will need a variance granted by the ZBA.

8. At some point, whether by Fazoli's or the original developer does not matter, a :
sprinkler system was installed with hardware extending outside of the property
lines. Approval for any item to be placed in the City's ROW is required through
the P.I.P (Private Improvements in the Public ROW Permit) process. This has
not been re u d. Approval for any items to be placed in TxDot RO
grange y TxDot, and should be submitted through the City. This has not been
requested. Any improvements outside the property lines are at the developer's ' I
own risk. If either the City or State proposes improvements in the ROW, the
developer's items are subject to removal without notification or compensation of
any kind, Staff is concerned about this issue, because construction of a
~si ewalk along arve Rd. is being considereC If it is installed, and irrigation
removed, some of the required landscaping may not receive adequate watering.
9. If the Board feels that any of the proposed changes affects other issues on the
site, it would be within their purview to revisit those issues.
