(01-122) Applicant: Shawn St. John for American Tower Corporation Staff Recommendation: Staff recommends approval of the tower with Staff Comments #3. Item Summary: The applicant is requesting a Conditional Use Permit for a new 130-ft. tower to be located behind the Discount Tire site on Texas Avenue South. Access to the site will be gained from a driveway off of the Private Access and Utility Easement that runs between Discount Tire and Epicures Cafe from Texas Avenue. The property is currently zoned and surrounded by C-1 General Commercial. The proposed tower meets the separation requirement for WTFs, setback from the right-of-way, setback from residential structures, and setback from an R-2 Duplexes zoning district as set forth in the Zoning Ordinance. The new tower would be large enough for the co-location of other antennas. Comprehensive Plan Considerations: The Land Use Plan shows this area to be Retail Regional. Texas Avenue is classified as a major arterial on the Thoroughfare Plan. Item Background: The proposed tower's lease space is located in the 3.97-acre Herman F. Krenek Subdivision Phase Two which was originally platted in 1985 and replatted in 1986 and 1992. Except for Discount Tire, the subdivision has remained undeveloped. Staff Recommendations: In addition to the standard CUP guidelines (described below), the Commission shall consider the following additional factors when determining whether to grant a CUP for a telecommunication facility: 1. height of the proposed tower, surrounding topography and surrounding tress coverage and foliage as they relate to: a. skyline impact, examining whether the proportions of the structure appears to dominate or blend in with the surrounding environment and b. shadow impact, whether or not the proposed tower will cast shadows that would prevent the reasonable use of enjoyment or surrounding properties. Created on 07/02/018:59 PM Catalog l 2. design of the tower, with particular reference to design characteristics that have the effect of reducing or eliminating visual obtrusiveness. 3. proximity of the tower to residential structures and residential district boundaries. 4. economic impact on adjacent and nearby properties. 5. proposed ingress and egress. 6. availability of suitable alternatives and/or existing support structures. Section 14 of the Zoning Ordinance authorizes the existence of conditional uses. The Commission may permit a conditional use subject to appropriate conditions and safeguards, when after public notice and hearing the Commission finds that: (Staff comments are in italics) 1. "The proposed use meets all the minimum standards established in the ordinance for the type of use proposed." Staff conducted a technical review and found general compliance with development regulations with the exception of the items listed in Staff Comments #3. 2. "That the proposed use meets the purposed and intent of the ordinance and is in harmony with the development policies and goals and objectives as embodied in the Comprehensive Plan for Development of the City. The request is in compliance with the Comprehensive Plan. 3. "That the proposed use will not be detrimental to the health, welfare, and safety of the surrounding neighborhood or its occupants, nor be substantially or permanently injurious to neighboring property." The public hearing is an opportunity for the Commission to measure the potential impact on surrounding land uses. The Commission may impose additional reasonable restrictions or conditions to carry out the spirit and intent of the ordinance and to mitigate adverse effects of the proposed use. These requirements may include, but are not limited to, increased open space, loading and parking requirements, additional landscaping, and additional improvements such as curbing, sidewalks and screening." Commission Action Options: The Commission has final authority over the Conditional Use Permit and associated site plan. The options regarding the use permit are: 1. Approval as submitted; 2. Because the application was incomplete, staff will make a complete review of the next submittal. The following comments are to inform the applicant with issues that have already been identified. PLANNING 1. The site plan check list that was part of the application needs to be turned in for this to be a complete submittal. 2. A landscaping plan must be included with the site plan. 3. Please submit the plans on 24" x 36" sheets (minimum). 4. The scale must be a standard engineering scale. 5. Please clearly show the limits of lot 4 or sheet 2 of 3. 6. The shelter needs to meet the building setback requirements of a C-1 district. 7. Please identify the distance of the tower from the _ nearest R-2 zoning district boundary line. 8. Please identify the new Texas ROW line, call out the planned Texas ROW width, and, if there is a change in the distance of the tower from the centerline of Texas, please identify the new distance. 9. The following comments do not constitute a full review, but are to inform the applicant of issues that have already been identified. A full review will be made of the next submittal. FYI: Because a significant amount of information required of the site plan was shown on the Lease Survey, the Lease Survey was considered as part of the site plan. PLANNING 1. Please correct the address of cell tower. It is proposed for 2321 A Texas Avenue South. 2. Please include the applicant's (American Tower Corp.) name, address, and telephone number on the site plan. 3. Please include the developer/owner's (AT&T Fixed Wireless) address and telephone number on the site plan. 4. On the Lease Survey, please call out the ownership of the Discount Tire site and the zoning of the Brentwood Subdivision. 5. On the Lease Survey, please identify the existing ROW line and ROW width. 6. Please identify the distance from the tower to the closest point of the R-2 zoning district to the southeast. 7. There is a discrepancy between the cell tower/Texas Ave. centerline distances on the Lease Survey and the Site Plan. 8. There is a note on the Site Plan that the size and location of equipment pads may vary. To insure compliance with required setbacks, the locations must be approved by staff. 9. Please show the site's curb cut to the access easement. 10. Please show curb and gutter and pavement construction details. All paved areas outside of the fence will have to be curbed. 11. Please use current FEMA maps when determining floodplain and floodway locations. 12. No item on the site plan that has an arrow indicating a location is pointing to an item. The arrows point to nothing. 13. The Lease Survey shows some on-site utility easements without any utilities in them, and the site plan describes utilities but does not show utility easements. These items have to be shown together. 14. On the site plan, the north arrow is not pointing north, Texas Avenue is in the wrong location, buildings and building names are not coordinated, and some zoning districts and lot numbers are incorrectly identified. 15. The minimum drive aisle width to the fenced area is 20 feet. Anything less will have to be approved by the Project Review Committee. Every development requires the use of an irrigation system. Please add a note to the Enlarged Site Plan that irrigation will be approved prior to CO.
