Since the time of Development Permitting the architect added awnings over selected interior parking spaces, which in-turn came in conflict with our proposed 15' P.U.E. Therefore, we have relocated the proposed 8" water line to be primarily in the centerline or the parking lot driveway. The new 15' P.U.E. will be described by metes and bounds upon completion and filed for release of the current blanket basement that COCS currently has. The revisions made elevated the site in the middle approximately 0.60 feet and then slope to the original design grades along the perimeter of the site. This was done in order to obtain a more balanced earthwork volume. No drainage patterns were changed and the detention facility was left in its original state as approved. In that regard, the Bank has an issue with the current License Agreement for the electrical easement that runs under our property. We ran the electrical under our property at the request of the City when the upgrading of the Northgate utilities was going on, rather than the City having to go around us with the electrical. The License Agreement provides that the City has the right to enter upon our property and require us to remove any structure or improvements or alterations thereon (which would mean tear the Tradition down). We need to modify the License Agreement to delete this provision. Elsewhere in the License Agreement, we have agreed to bear the expense of relocating any public utilities, which would seem to be a sufficient remedy to the City if there should ever be any conflict with the City's easement. This is a very big issue with our lender as you might imagine. There is also concern about the revocability of the License Agreement under B. and C. Is there a way to limit these conditions of revocation? I will be in CS Tuesday and Wednesday and need to find a resolution to this issue quickly. Can you help me out here? Thanks. Previously I had informed you that our new ordinance required a 10' buffer with a 6 screening fence between Multi-Family & Multi-Family. Since that time it has been brought to my attention that this was a misprint. There are no fencing or screening requirements between Multi-Family &Multi-Family.
