Due to various circumstances we have been unable to complete the required work to obtain a certificate of
occupancy. There are three outstanding issues. All of these issues are in the area north of Horse Haven
Road. They include the retaining wall, sidewalk and streetlights. Enclosed is a sealed estimate for the
sidewalk and retaining wall. An amount of $15,000.00 has been allotted for the street lighting, which
equates to $3,000.00 per light pole.
We request permission to post a bond for a period of 90 days to guarantee completion of these items. We
ask that upon the completion of all building inspections a temporary certificate of occupancy be afforded to
us for the opening of the Academy store.
Within 30 days of the certificate of occupancy we will hydro mulch all areas, disturbed during construction
on and off site.

Mr. Burt Hermann called expressing concern about removing the existing gravel driveway,
etc. and restoring the frontage road curb just south of the new Academy Store entrance
road site. I Indicated I thought there was something in the Access permit that was Issued
to Academy addressing this issue. I checked the files & found that the permit did cover
this situation.

GENERAL SPECIAL PROVISIONS (Access Driveway Permit) :
1) Traffic Control plan is required per TMUTCD prior to start of construction work
In the SH 6 right-of-way.
2) Areas within ROW disturbed by construction shall be restored to equal or better
conditions than existing prior to construction.
3) Contractor shall be responsible for locating all utilities within the right-of-way
construction site. Contacts with local utility companies and utility locators are
required.
4) No undercut of existing frontage road asphalt pavement will be allowed.
5) Any lane closure will be allowed between 9:00 a.m. and 4:00 p.m. only.
6) After proposed street construction is completed, Contractor shall remove
existing driveway & pipe, restore frontage road curb section, and grade ditch
to existing riprap section (approx. 100').

1. The title block on sheet SP -1 and L -1.2 has been modified to show 10.49 acres.
2. Refer to pavement expansion joint detail on sheet SP-1 for typical pavement detail. Refer
to curb detail on sheet SP-1 for typical curb thickness. Refer to General Notes on sheet
SP-1 for paving notes regarding concrete thickness and reinforcing.
Engineering
1. Refer to revised sheets 4 & 5 for the note "PROP 6' CONC. SIDEWALK' and indicated
sidewalk on north side of Horse Haven Lane.

Currently, the Property is encumbered by that certain 1998 Development
Agreement which must be removed from the Property before Academy can purchase the

It has been brought to our attention that due to a significant difference in elevation between
the north right of way line and the proposed top of curb of Horse Haven Lane, it would be
impossible to build the 6-foot wide sidewalk and maintain reasonable earthen slopes within
the right of way.
The option that Academy would like to pursue is to place an amount of money equal to the
anticipated construction cost for the sidewalk in an escrow account. This money could then
be used at a later date when the property on the north side of the road is developed. We
believe that this option serves the best interest of all involved. It avoids the need to place
retaining walls in a public right of way and allows any future developer maximum flexibility
in designing and grading the property. The future developer would have the full site
available to match grades with the top of curb as opposed to just the 10 feet between the
right of way and the top of curb. Finally, the City would be assured that whenever this
property is developed, funds will already be available ,for the sidewalk in the escrow
account.

Dear Brock:
In regard to your letter of October 09, 2001 concerning a request for a variance from the
approved plans showing construction of a sidewalk on the north side of Horse Haven
Lane I offer the following response:
The City of College Station's desire is to have sidewalks on both sides of Horse Haven
Lane as required by our development regulations. Apparently TERRA overlooked the
grade differential in their initial design and needs to re-address and define what will be
required to install the sidewalk on the north side of the roadway with stable, maintainable
back slopes adjacent the property on the north. The City is agreeable with the sidewalk on
the north side of Horse Haven Lane being flush with the back of curb. The City is not
agreeable to your proposal to place funds in escrow for future construction.
