Item: Discussion, and possible action on a PRELIMINARY PLAT for the
EMERALD FOREST PHASE 11 SUBDIVISION consisting of 19.11 acres
located on the east side of Appomattox Drive south of Phase 10 and north of Bee
Creek. (1-500108)

Staff Recommendations: Staff recommends approval of the preliminary plat as
submitted.
Item Summary: This item is a preliminary plat of 19.11 acres containing 55
single family R-1A zoned lots (0.21 ac. avg.) and is a continuation of a 300 acre
residential development depicted by the Emerald Forest Master Development
Plan which was approved by the Planning and Zoning Commission on December
2, 1999.This tract is bounded on the east by a 19.21 acre reserve tract (zoned A-
O) which represents the remainder of the 300 acre parent tract covered by the
Master Development Plan. This reserve tract contains a 160' wide by 2600'+/-
utility corridor ( 9.88 acres) which is adjacent to the east boundary of Phase 11
and contains several high pressure petroleum product transmission lines as well
as overhead power lines.
This preliminary plat is in compliance with the Subdivision Regulations, the
Master Development Plan, and the Land Use Plan. It includes the continuation of
Spring Creek (minor collector) east of Appomattox to serve this phase of
development. This street is not shown on the City's Thoroughfare Plan. Parkland
dedication has been addressed in earlier phases.
Item Background: This area was annexed in 1977and initial development began
shortly thereafter. The majority of the 300 acres was developed in the 1980's.
Phase 10 was developed in 1994. A Master Development Plan was approved
December 02, 1999 and the 19.11 acre Phase 11 tract was rezoned from A-O to
R-1A on December 16, 1999. A preliminary plat submittal for Emerald Forest
Phase 11 was considered by the Planning and Zoning Commission on December
16, 1999 and denied by a 5 to 1 vote. In addition to the 19.11 acre residential
tract this submittal included a proposal for the developer to dedicate 13.4 acres
east of the 19.11 acre tract to the City for a bike path, linear park and buffer for
the Carter Creek Waste Water Treatment Plant. With this dedication the
developer was asking for a variance to having to build the bike path and
additional street and water infrastructure. The Commission denied the variance
and the preliminary plat. .
Budgetary & Financial Summary: The Developer is requesting oversized
participation for Spring Creek for the difference between a 28' street and a 39'
street.
Commission Action Options: The Commission has final authority over the
preliminary plat. The options regarding the plat are:
■ Approval with conditions;
■ Approval as submitted;
■ Denial;
■ Defer action only at applicant's request; or,
■ Table only at applicant's request.

INFRASTRUCTURE AND FACILITIES
Water: Adequate water capacity is available along the east side of this
tract. Service will be extended to and thru the property.
Sewer: Several existing sanitary sewer lines provide adequate capacity
for this development.
Streets: This development will include approximately 2400' of local
streets( 28' BC-BC) and a 680' minor collector street (39' BC-BC).
Off-site Easements: None
Drainage: Design will be required to comply with City requirements.
Flood Plain: There will be no development activity in the floodplain
which runs along the south property line.

Impact Fees: None
