Dear Mr. Wolff: The development of Lot 1, Horse Haven Estates, has been reviewed as "redevelopment, rezoning requests by the owners, or any change in use of the PROPERTY..." pursuant to the terms of the above referenced development agreement. Through this review and approval, the City of College Station did not find that the extension of Appomatox was needed at this time. The rezoning and development of Lot 1, Horse Haven Estates does not require the construction or extension of Appomatox Drive into the Horse Haven Estates Subdivision. (01-110) Applicant: Burt Hermann Staff Recommendations: Staff recommends approval. Item Summary: At the time of site planning for the project it was determined that an additional fire hydrant was needed on the interior of the property. The water line to the fire hydrant is required to be in a public utility easement. There are two ways to dedicate a public utility easement. One is to file a separate instrument easement at the courthouse. The other is to include the easement on a plat, which will be filed at the courthouse. Showing easements on a plat is the method that the City prefers, if it is possible. Then anyone looking at the plat has a clear idea of the layout of the property. The applicant agrees. The only change between this and the previously approved final plat is the addition of a public utility easement in the northeast corner of the lot. Item Background: This property has been in the City Limits for some time. A Master Development Plan for the property was approved by the Commission on December 7, 2000. On January 25, 2001 the property was rezoned by Council to PDD-B. A Preliminary Plat was approved by the Commission on February 15, 2001. The Final Plat is in compliance with the Subdivision Regulations, The Master Development Plan, the Preliminary Plat, and the rezoning. Comprehensive Plan Considerations: The Land Use Plan shows this area to be Mixed Use as does the recently adopted East Bypass Plan. Attachments: 1. Area map 2. Application 3. Brooks RE: Bert Herman Horse Haven E6tatm Subdivision Bond Carey, Tried to catch yon by phone this morning and you were on the line. I'm about to run oft to a meeting with an underwriter and wanted to be sure and get a nEessage to you prior to that. I looked at that bond form again this morning and it spedtfcally says "load owner" as principal. What I would like to do is talk to this underwriter in a few inmates about this deal and get a copy of the escrow papers showing the money being set aside for your benefit. With that, I can try to get them to write a bond for Bert Berman with just some real basic information that shouldn't take too tong. I believe you told me that the closing was Monday. HOWZVEX isn't this just like that BCS Development deal? Can Bert Herman use the bond from you to him to get platted? Let me know, I've already gotten it approved.
