SUBJECT: Subway signage on the corner of HWY 6 and University
I called Robert Rutledge on Thursday, March 22, 2001 and told him that by
adding the Subway sign to the side of the existing signage, he would almost be
doubling the area of the signage because of our "invisible rectangle" rule. He will
be calling back with the size of the existing signage so I can find out if he has
exceeded his allowable area. He informed me that the background color shown
on the sign is not correct, that the background is black, not brown. There are
only two colors on the existing signage, so the yellow of the Subway sign is
allowed. We also talked about the Overlay District, restrictions on signage in this
district, the process of getting a proposal approved by the PRC, and the
necessity of the proposed Subway attached signage to go before the PRC.

SUBJECT: SubwayRestaurant. proposal of putting attached Subway signage at
the rear and front facades of the building located 804 Earl Rudder Freeway
South (01-78)
The PRC held a meeting on Wednesday, April 18, 2001 to review the above - mentioned project.
Commissioner Mooney stated the sign has a backlit sign and the bright white SUB letters are
more of subdue ivory color and flush mounted against the building. Commissioner Floyd asked
about the overlay requirements for signage. Staff Planner Hitchcock stated that the one of the
colors have to match one of the predominate colors of the building. Commissioner Floyd asked
if signage is permitted on the building. Staff Planner Hitchcock stated that the ordinance states
2 attached and 1 detached signs is permitted. Hitchcock also mentioned there have been
questions in regards to a building having multiple tenants. Staff Planner Hitchcock spoke with
Senior Planner Kuenzel and she stated that the intention was for business purposes and it
occurred before there was multi -use convenience facility. Commissioner Warren questioned if
there has ever been a request for more than one sign in this overlay district before. Staff
Planner Hitchcock said none that she is aware of. Commissioner Floyd and Commissioner
Warren both did not agree with having multiple signs on the existing building. Commissioner
Warren suggested putting the sign on the door and having the big freestanding sign out front
would be sufficient. Mr. Rutledge stated the freestanding sign does not have much visibility.
Commissioner Floyd said once the median is built, it would be hard to see anyway. Staff
Planner Hitchcock interject by stating that the ordinance does say 2 signs are permitted and
right now there are not any other signs. Commissioner Floyd wants to keep the single tenant
look to it and was opposed to any signage on the building. Commissioner Mooney stated his
interpretations are to allow business to have the identification of signs. Commissioner Warren
motioned to table without prejudice to get clarification and request a legal interpretation.
Commissioner Floyd seconded it. The motion passed 2 -1.

SUBJECT: SubwayRestaurant.• the proposal of installing Subway signs at the rear
and front fagade of the building located at 804 Earl Rudder Freeway
South (01-78)
The PRC held a meeting on Wednesday, June 20, 2001 to review the above - mentioned
project. Mr. Keller stated from the meeting held in April, the original issue was trying
to set up a color scheme that would match what the ordinance states. The ordinance
states that the signs can only have three colors and one of those colors must match one
of the predominate color of the building. Also, at the last meeting in April, the
interpretation of the ordinance regarding the number of signs a business can have
became an issue; therefore it was referred to legal. Staff Planner Hitchcock mentioned
Legal would send out a memo stating they would answer specific questions, but would
not be attending these types of meetings. She continued by stating that according to the
ordinance, the Subway building was considered a shopping center. The definition of a
shopping center is 3 or more businesses. Shopping centers, excluding gas stations, are
allowed unlimited signs according to Legal. Legal has said that Subway is allowed to
have the number of attached signs they have requested, but PRC has the discretion of
the color scheme and placement of the signs.
Commissioner Happ questioned how many signs they could have. Staff Planner
Hitchcock stated it was unlimited and that the ordinance is less strict on attached
signage than it is on the freestanding sign. Commissioner Happ said, while serving on
ZBA, it was his understanding that businesses were allowed one freestanding and one
structure sign. Commissioner Floyd stated that was also his understanding and would
abstain from voting because he felt that was not the information given when this site
was approved by the Planning and Zoning Commission. Commissioner Happ
recommended using one single attached sign with the corporate colors. Mr. Keller
stated that they were trying to attract people coming from out of town and leaving
town. Commissioner Floyd asked how people were going to get to Subway once the
median was built. Mr. Rutledge replied that there was a connection between Cheddar's
and Exxon. Staff Planner Hitchcock stated that to comply with the ordinance, staff still
held the position of not restricting the number of attached signs. Commissioner Happ
asked if Subway owned the freestanding sign. Mr. Keller stated yes. Commissioner
Happ moved to approve the corporate standard sign for the front of building only and
the freestanding sign. Commissioner Harris seconded. Staff Planner Hitchcock
commented that the PRC had the power approve the colors. Commissioner Happ
commented that if the PRC did not have the authority to restrict the number of signs, he
moved to approve the corporate colors of the sign as long it remained in the sign
ordinance. Commissioner Harris seconded. Commissioner Floyd abstained from
voting. The vote passed 2 -0.
To clarify, Mr. Keller stated that they could have 2 attached signs —one in front and one
in back —and could stick to the original colors along with the freestanding sign. As far
as the size of the sign, the sign can not extend over a foot of the building edge
according to Staff Planner Hitchcock.
