Ball Memorial Subdivision. The PRC held a meeting on Wednesday, February 7, 2001 to review the above - mentioned project. Ms. Veronica Morgan began the discussion by clarifying she was representing Frank Mihalopoulos and McDonald's for the variance. Ms. Morgan presented a map of the proposed McDonald's and Rock Prairie Shopping Center site. She stated that the existing tract across Rock Prairie is zoned AP and house several office professionals and the adjacent vacant tract is zoned C -2. She pointed out that the previously approved driveway included an access easement between lots 1, 2, 3 and 4 of L.O. Ball subdivision. She stated there was also a public access easement along the rear property line for all four lots. Ms. Morgan reviewed the history of the plat stating that the City of College Station had previously thought about cross - access easements and where they should be located, which was discussed at the time L.O. Ball Subdivision was platted. Ms. Morgan stated that they have looked at the driveways and at what kinds of conflicts they may encounter with the locations. Ms. Morgan went over the site layout her company submitted to the city and showed where they fit according to the driveway ordinance. Commissioner Floyd questioned Ms. Morgan about the public access at the rear of the property and what will happen to it. Ms. Morgan stated that nothing would happen to it. Commissioner Floyd also asked about the shopping center building that was shown in the public access easement. Ms. Morgan stated that building is shown conceptually and will be pulled off the public easement. Ms. Morgan stated that the most critical question was what could happen to the commercial tract across the street with a curb cut with AP use lot. There is currently no platted cross - access easement between lots 3 & 4. Ms. Morgan suggested the city talk to owner of lot 3 and requested the use of their driveway for lot 4 use. The ordinance does have requirements for opposite and adjacent driveway spacing along different types of thoroughfare. The lesser classification of thoroughfares the closer your driveways can be until you move up to a major arterial which is the Rock Prairie Road. Ms. Morgan continued by stating there could be a problem with the access being right across from Rock Prairie Road and with AP use typically having traffic patterns such as early morning, lunchtime and evening use. Ms. Morgan also discussed the possible problems with people sharing the center lane to turn in opposite directions. If they have the driveway across from the C -2 user, traffic patterns are going to be more similar between the two uses. With that in mind, they shifted the driveway closer to Longmire. Ms. Morgan stated that the adjacent spacing they have created does not meet the ordinance but in looking at the alternatives, they think that one will function. Graduate Engineer Vennochi began his discussion by describing the issues found with the development of the driveways. Engineer Vennochi stated that this section of Rock Prairie Road is classified as a major arterial on the Thoroughfare Plan. This part adjoining the property in question is the east end of the larger, and very important, east -west corridor connecting Wellborn Road and the East By -Pass. This section will become an even more important connector when the proposed SH 40 comes into being, which is going to parallel Wellborn Road. Hence, it will be connecting two freeways. Being a connector in this fashion will directly increase the flow of traffic. It will also be a function of the development of the area. Upon looking at, merely, a street map of the area, and not present or upcoming construction and present structures, one can see that Rock Prairie Road divides the developed area to the north from the comparatively undeveloped area to the south. Engineer Vennochi mentioned that the City of College Station is growing south. The future generated traffic in the area will use this east -west corridor. He emphasized that the ideal set up for a major arterial would be no access on to the road way except for major cross streets. Controlling access, i.e. curb cuts, to limit the deterioration of the traffic flow and the level of service is what we should pursue, as much as possible, in lieu of attaining the ideal cross - section for a major arterial. The ideal cross - section for a major arterial is shown in Section 9 of the Subdivision Regulations, with a raised median. If our Regulations were published before the original plat of this subdivision, we would be requiring the owner to dedicate additional R.O.W. to attain the ideal cross - section. Engineer Vennochi said that Rock Prairie Road is classified as a major arterial because the road already experiences 12,000 cars per day. It caught the attention of the past Transportation Planner, Edwin Hard, when reviewing the Kroger Signature Store. The future of the Rock Prairie and Longmire intersection will eventually include improvements as traffic increases. This might include a left turn storage lane and /or a raised or painted median. Ed Hard designed the single access on the original final plat to coincide with a proposed median opening and the existing curb opening across the street. To conclude, Engineer Vennochi stated that staff does not agree with this variance because it basically does not meet the driveway policy. To help provide sufficient access an easement was placed in the rear to service all of Lots 1 -6. Especially Lot 6, behind Lots 1 and 2, that was land locked. Commissioner Warren asked Mr. Vennochi about the ordinance revisions being developed and if he is aware of the revision related to the major intersections having any barring on C2 tract in the future. Senior Planner Kuenzel affirmed that the driveway ordinance is not included in those revisions. Commissioner Floyd counted the curb cuts there were and acknowledged that we already violated the ordinance with the current curb cuts. Commissioner Horlen asked if G2 would be entitled to the access to Rock Prairie if they develop commercial. Senior Planner Kuenzel stated that staff will work with PRC for a variance but initially the decision is up to the City Engineer. Commissioner Horlen asked if G 1 and G2 could share access on the property line. Senior Planner Kuenzel stated that historically they would not. Commissioner Warren motioned to deny the proposed variance. She felt that users would take the access from Longmire and that we need to diminish as many crossings as we can. Commissioner Horlen, disagreed, voicing concern that the city will eventually have an access on Rock Prairie with C2 and so the alignment with C2 is the safer alternative. Commissioner Floyd asked about the new driveway to the east being a right -in and right -out driveway (no left turns), so that there would not be any conflict going across Rock Prairie Road. This would guide patrons onto Longmire and those who want to go back to the west can go to the other access. Commissioner Warren agreed with Commissioner Floyd's recommendation and said it would be a compromise solution to allow entrance into the McDonald's and B1ockBuster and others can use the signal entrance at the back to make a left. Mr. Blatchley asked if Commissioner's Floyd recommendation would be for both curb cuts. Commissioner Floyd stated it would only be for the east entrance. Mr. Mihalopoulos and Ms. Morgan also agreed to the right in and right -out. Commissioner Horlen also agreed with the recommendation and made the motion to approve the variance to allow the access easement between lots 3 & 4 (with a right -in and right -out only), an access easement at the corner of lot 1 with full access, and eliminate the access between lots 2 & 3. Dear Mr. Pearson: The Department of Development Services of the City of College Station is concerned that the roadway as a subdivision improvement is built properly according to the construction plans. Our legal department perceives this as a violation of subdivision regulations. Therefore, it is necessary to petition to the Planning & Zoning Commission and not the Project Review Committee. We view this situation as a condition that has developed between the present owner, the previous owner and/or the developer. We consider the responsibility of the cost to be the concern of the developer. It is our position that the public access easement is a subdivision improvement that should be constructed by the developer. It is recommended that sufficient information be forwarded to us with variance request to the Planning & Zoning Commission to justify your position. Section V of the Subdivision Regulations should be referenced for guidance. The staff of the Department of Development Services does not recommend approval of this request for a variance to the subdivision requirement in regards to building necessary roadway structures. It is the City of College Station's policy that the first developer to build adjacent to a platted public street or alley is responsible for designing and constructing the alley or roadway. We view this situation as a condition that has developed between the present owner, the previous owner and/or the developer. We consider the responsibility of the cost to be the concern of the developer. It is our position that the public access easement is a subdivision improvement that should be constructed by the developer. It is recommended that sufficient information be forwarded to us with variance request to the Planning & Zoning Commission to justify your position. Section V of the Subdivision Regulations should be referenced for guidance. They asked staff if there had been discussions to install pedestrian signals. The felt the need for a traffic study in the area. Transportation Planner Hard said that the City is aware of the issue but this area has not been made a high priority. He did not know of any fatalities in this area but was aware of accidents between vehicles and pedestrians. Commissioner Maloney moved to approve the conditional use permit. Commissioner Parker seconded the motion, which passed 5 -0 -1; Commissioner Rife abstained from the discussion and vote. AGENDA ITEM NO. 9: Consideration of a Final Plat of the L.O. Ball Subdivision Phase II, approximately 27.5 acres located on the southwest corner of the Rock Prairie Road including the extension of Longmire Drive. (99 -208) Transportation Planner Hard presented the staff report and stated that the purpose of this plat is to subdivide 27.5 acres into nine C -2 Commercial Industrial lots. This final plat includes the extension of Longmire Drive as a major collector from Rock Prairie Road south to Birmingham Drive. it also includes dedication of right -of -way and construction of a right turn lane on the section of Rock Prairie from Longmire east to the west Frontage Road. He said that staff reviewed the final plat and found compliance with all of the subdivision regulations with one exception. Originally, staff had encouraged an access easement that would parallel Rock Prairie Road on the Kroger site east of Longmire to serve the existing bank site, and that there be an access easement to the west of Longmire to align with that future driveway. The access easement on the west side was to serve all of Lots 1 through 6 of Block 3. However, during preliminary discussions regarding the Kroger conceptual plan, it became apparent that the driveway nearest Rock Prairie Road would generate higher volumes than were anticipated. In light of this new information, staff is concerned that the original recommendation to require the access easement west of Longmire will add to the traffic congestion on Longmire if high traffic generators are built on Lots 1,2,3, and 6 of Block 3. If such uses are contemplated for these lots in the future, staff recommends that their access drives do not connect to tha portion of the access easement that will serve Lots 4 and 5. Th the ••= =I u l �Vl 11411W ..� �..v v- - - -- Mr. Frank Mihaulapolus, Rock Prairie Limited Partnemship representative, said that he was in favor of the requirements of the plat but expressed his concern with the access condition for Lots 1,2,3, and 6. He wanted assurance that these lots would not be limited to one opening. He was concerned with the wording of the condition. He said that the primary access for these lots would be to Rock Prairie Road but wanted means of secondary access to Longmire. Mr. Hard said that assurance of the location of the secondary access would be determined at the time of site plan consideration because there are not definite plans for what will be developed. Mr. Mihaulapolus was certain that the development would be oriented toward Rock Prairie Road. He also said that he was satisfied with the condition as stated with Staffs recommendation. Mr. Greg Taggart, Municipal Development Group, reiterated Mr. Nfihaulapolus' concern. P &Z Minutes March 4, 1999 Page 8 of 20 The Commissioners discussed the traffic on Rock Prairie Road and agreed that the problem was with congestion and safety. The Commission asked if Ms. Nemcik was comfortable with the request for alternate languate regarding the access condition. She indicated that the Commission's directives should be clear as to what exactly they expected Staff to do on a revised plat condition. Mr. Mihaulapolus stated that given the late hour and the difficulty in creating satisfactory alternate language, that he concedes to the original condition. Commissioner Rife moved to approve the final plat with staff recommendations. Commissioner Garner seconded the motion, which passed unopposed (6 -0). AGENDA ITEM NO. 10: Adjourn. Director of Development Services Callaway explained the reason for removing "Other Business" from the agendas. He said that the City's Legal Department told Staff allowing an agenda item such as "Other Business" may violate the Open Meetings Act. Chairman Massey asked if there could be an item for future items for agendas. Chairman Massey asked Mr. Callaway if "Other Business" could be replaced by an item allowing for future agenda items requested by the Commission. Mr. Benito Flores -Meath wanted to know how citizens could bring items to future P&Z Agendas. Assistant City Attorney Nemcik told the Commission that she would look into these issues and report back at the next meeting. Chairman Massey explained to the audience that the Commission is very interested in hearing from the public, but also want to conform with the open meetings act.
