Lot 4B constitutes a new lot. Lot 4A and Lot 4B each need to meet the requirements of the Subdivision Regulations (e.g., lot size, frontage distance). Perhaps the effect intended could instead be reached through an easement. 3. Does the retained mineral surface use extend across Paint Trail? A drainage easement is necessary for watercourses where drainage must traverse from one property through the next such as along White's Creek, from the ROW to the river or creek, and (apparently) from Lot 5 through Lot 2.
