Please f ind attached a permit issued to Mr. Gus Ellis (owner) for installing a new drive entrance. Mr Ellis gave this permit to us about two weeks ago. The parking lot infibnt is in good shape, marked and handicapped. The drive through for the immediate future would be pea gravel, or an approved grade and size. Of course the ramp on Hensel Drive would be concrete and constructed from your approved drawing for this type of installation. Our intention is to completely Macadam the parking lot and drive through in about six months. Thank you for your help in guiding us 'strangers' through the rigors of 'getting started' in a strange place. Moore 25025 I-45 N, Suite 430 Woodlands, TX 77380 RE: NOTICE OF NON - COMPLIANCE with Chapter 13, City of College Station Code of Ordinances Lot 15, Block 2, Gorzicki's Meadowland (Hensel Road at Texas Avenue) Mr. Davis Moore: It has come to our attention that construction on the above referenced site is being performed without a Development Permit. Chapter 13, Section 3 of the City of College Station Code of Ordinances requires a Development Permit prior to any development within the City of College Station. Appropriate action must be taken immediatetly to bring this site into compliance. The site plan is presently being reviewed. A Development Permit cannot be issued until a site plan is reviewed and approved. But, a partial Development Permit may be issued by satisfying the preliminary requirements for a full permit while the site plan is being reviewed. The remaining requirements necessary for a partial permit are as follows: an $100 application fee; a Grading Plan (showing proposed elevations on proposed pavement) (submitted and approved); and, an Erosion Control Plan (showing silt fence) (submitted and approved). A submittal is approved when return correspondence is received by the applicant that states `No Comments' or comments that require no action on part of the applicant. The requirements for a partial permit shall be submitted within five (5) working days of receipt of this notice. If action on your part cannot reasonably be taken immediately, no construction work will be permitted until the full site plan review has been completed over the full amount of time necessary. Failure to comply with this City Ordinance will result in enforcement action taken in accordance with Chapter 13, Section 7 of the Code of Ordinances. Texas Ave., College Station, Texas 77843 Dear Mr. Blesienz: On Match 22, 2001, 1 visually Insped the Dalin's Donuts lease space located of 100 S. Texas Ave. in College Station, for the possible disturbance of friable and non -liable asbestos- containing building materials (ACBM). At your request, the limited asbestos inspection involved sampling new 12' X 12' floor tilelmastic and sheetrock. The federal National Emission Standard for Hazardous Air Pollutants (NESHAP) 40 CFR Part 61, subpart M, and the Texas Aspestcs Health Protection Act and Rules (TAHPA) requires that prior to performing any renovation or demolition in a public or commercial building that the area(s) be inspected for the presence of asbestos - containing building materials. At the time of the inspection, the disturbance of any building materials had already taken place and with the majority of the construction involving installation of sheetrock walls, floor tile, painting and plumbing. The lease space consists of a concrete slab foundation, wood frame construction, sheetroc k, floor file and plywood. A total of six (6) samples of shestrock and floor tile1mastic were sampled and analyzed for asbestos content. All of these building materials were analyzed under Polarized Light Microscopy with Dispersion Staining (PLMtDS), EPA Method 40 CFR, Chapter 1, Part 783, Subpart F, App A. The PLM analysis are attached to this report. All of the suspect materials sampled were determined to be None Detected for asbestos content New building materials should be addressed to ensure that they do not contain asbestos. Manufactures labels or material safety data sheets (MSDS) should be reviewed and documented to ensure that any asbestos-containing building products are not used during future construction. Existing canopy and non- canopy trees on site can count toward the requirement if they are properly barricaded. Additional information is needed for the landscaping. What kind of trees are they? Canopy vs. Non - canopy? What is the circumference of the trunks, so that we can determine how many points they count for under our landscaping ordinance? For every inch of circumference the required barricade must be one foot away from the trunk. Ex. An 8 -in. tree would need to have barricading 8 feet away from the truck. The land cannot be disturbed within the barricade by any means, other than hand clearing, during construction. The barricades must be up before any construction begins on site. All proposed paving must meet current standards, including but not limited to, materials, design specs, width and curbing requirements. Curbing is required around all pavement sections as part of the zoning ordinance. Curbing is not a drainage issue. In rare instances, where curbing would be detrimental to the drainage of a site, variances may have been granted allowing segmented curbing, which would allow drainage and still function as a curb. As you stated in your comment, this exception does not apply to your site. We also need pavement and curbing specifications shown on the plan, which meet our paving and curbing requirements. The areas to be paved need to be shown to scale on the site plan showing that they are planned to meet our circulation aisle width of 20 feet. 12. Existing canopy and non - canopy trees on site can count toward the requirement if they are properly barricaded. Additional information is needed for the landscaping. What kind of trees are they? Canopy vs. Non - canopy? What is the circumference of the trunks, so that we can determine how many points they count for under our landscaping ordinance? For every inch of circumference the required barricade must be one foot away from the trunk. Ex. An 8 -in. tree would need to have barricading 8 feet away from the truck. The land cannot be disturbed within the barricade by any means, other than hand clearing, during construction. The barricades must be up before any construction begins on site. To reiterate, we also need to have the following: A site plan either redrawn to an engineer's scale (1:10, 20, 30 etc.) or with adequate dimensions to show the width of the drive through and new paved areas. We also need to know the type and size of the existing and new landscaping to verify that there are 500 points of landscaping on the site. Please see the enclosed excerpt from the landscape ordinance. We need pavement and curbing details. Since the pavement has already been poured we will need some verification from your contractor that it meets the enclosed specifications. If you wish to delete the curbing you will need to let us know so that you can get an application for a variance. If you wish to propose an alternate curb (like wheelstops) you will need to let us know so that your request can be forwarded to the appropriate board. The variance process would add about one month to the process while the alternate curb request would add about two weeks. You have to weigh this additional time with the cost of the required curb and let us know what you decide. A request for a variance or an alternate standard does not guarantee it will be approved. As I indicated staff would have difficulty supporting a variance or alternate standard in this case. I hope this helps clarify what you need to move your project forward. I had ten copies made for you and took them to you the next day. I asked the women in your office if I could see you for a moment to give the plans to you, and to see if you needed me to do anything. I was told you were in a meeting, and I said I would wait a few minutes_ I was then told someone else wanted to see me and it would only be a couple of minutes. That was repeated many times, ...just a couple of minutes... I waited 20 minutes and a uniformed man appeared and gave me a ticket ( #CE -2118) for doing ,,cork beyond scope of development permit. ire explained the drive had been put in when we had only a partial permit. (Contractor advises that drive was put in because he had to immediately fill and cover an excavation hole created to install a new 500 gallon grease trap which the City of College Station required ... and because City of College Station had advised us in writing that they did = have jurisdiction to driveway entrance on Henley Avenue, but that Texas A&M did. His long experience as a well respected mmm contractor in the ecity, led him to believe that not covering the excavated area could create an attractive nuisance and someone could drive through and be harmed and /or cause damage) 4he uniformed man told me I could go immediately to the Municipal Court and get information about the ticket he gave me. I went thPXe; waited in line for 45 minutes and was told it was not in the system.
