(01 -51) Applicant: Charles A. Ellison, PC Staff Recommendations: The recommendation is for approval. The Planning and Zoning Commission, as well as the City Council previously recommended approval on these zoning changes. The legal descriptions in the previous rezoning were incomplete, so this item is more one of housekeeping. Item Summary: The applicant originally requested the rezoning of the subject property February 19, 2001. The Planning and Zoning Commission approved the zone change on March 15, 2001 and Council approved it on April 12, 2001. Unfortunately, not all of the legal descriptions were included with the original application. The City of College Station Legal Department has advised staff and the applicant that the Ordinance could not be amended at staff level- -that the zone change would have to be revisited by the Planning and Zoning Commission as well as the City Council to include the legal descriptions. Budgetary & Financial Summary: An oversize participation request has been approved by the City Council for the waterline along proposed SH40. The Planning and Zoning Commission, as well as the City Council previously recommended approval on these zoning changes. The legal descriptions in the previous rezoning were incomplete, so this item is more one of housekeeping. Item Summary: The applicant originally requested the rezoning of the subject property February 19, 2001. The Planning and Zoning Commission approved the zone change on March 15, 2001 and Council approved it on April 12, 2001. Unfortunately, not all of the legal descriptions were included with the original application. The City of College Station Legal Department has advised staff and the applicant that the Ordinance could not be amended at staff level- -that the zone change would have to be revisited by the Planning and Zoning Commission as well as the City Council to include the legal descriptions. Budgetary & Financial Summary: An oversize participation request has been approved by the City Council for the waterline along proposed SH40.
