Development Engineering
Item: Discussion and possible action on a preliminary plat for the Heritage
Townhomes (PP) located at 3500 Harvey Road (1- 500048).
Applicant: Carnes, Todd
Staff Recommendations: Staff recommends approval of the preliminary plat.
Item Summary:
• This property is located at the eastern corner of the intersection of Harvey
Road and Linda Lane. It is a 6.629 -acre tract with a proposed 54 lots on 6
different blocks.
• The applicant intends to build a gated subdivision with town homes on 5
private streets.
• It is zoned as PDD -H.
• The property is surrounded by A -O to the west, M -1 Planned Industrial to the
north, ETJ residential to the south and C -3 Planned Commercial to the far
east. A 6 -foot fence will surround the development on all sides and heavy
woods to the south will act as a buffer.
• The proposed lot sizes will exceed the minimum lot size required of a
townhouse. There will be a density of 8.9 units per acre compared to the R -3-
allowable 14.
• The final plat and site plan review is still pending.
Comprehensive Plan Considerations:
• The site is located in Sub -area 7C in the 30/60 Area Planning Study. The
30/60 Area Planning Study will be considered by Council on March 22. The
plan recommends higher density single - family use that are oriented inward
and not toward the highway. Professional uses are also supported as a part
of a mixed -use concept. The proposed layout of the property is in compliance
with the study recommendations.
• Harvey Road is classified as a major arterial and Linda Lane a future major
collector on the Thoroughfare Plan. The applicant is dedicating additional 10'
ROW necessary towards the future development of Linda Lane.
• There are no sidewalks proposed on this portion of Harvey Road per the
Sidewalk Master Plan.
Item Background:
• The Commission approved the rezoning to a PDD -H in December with full
access onto Harvey Road.
• At the December P &Z Meeting, Ed Hard, Transportation Planner, supported
the access onto Harvey Road and Linda Lane.
• Also, Development Engineering affirmed that a proper drainage review would
occur during the Site Plan and Development Permit review.
• The subject property was annexed into the City Limits in 1980. At that time,
the area bound by the former TI property and Highways 30, 60, and 158 was
annexed, along with the strip of land extending from Carter Creek east to
Highway 158 on the south side of Harvey Road, which includes the subject
property.
• Recently, the area between FM 60 and FM 30 was chosen for the future
Veterans Park, as well as a public /private venture for the development of an
office complex and a performing arts center.
Budgetary & Financial Summary: The applicant desires oversize participation
in the proposed 12" water line along Linda Lane. As the applicant furthers his
design, his engineer will develop a cost estimate itemizing the construction. The
City Engineer will determine the justification at that time. Then it will be
presented to the City Council for approval /disapproval.
Commission Action Options: The Commission has final authority over the
preliminary plat. The options regarding this item are:
■ Approval as submitted;
■ Denial;
■ Defer action only at applicant's request; or,
■ Table only at applicant's request.

INFRASTRUCTURE AND FACILITIES
Water: Water can be provided by an 8" water line required by the
developer's design, but proposed as a 12" line pending oversize
participation. This line will run along Linda Lane. New infrastructure will
be extended into the subdivision to serve the residential development
and connect to an existing 8" water line on the front of the property,
parallel to Harvey Road.
Sewer: An existing 15" sewer line that is parallel to Harvey Road along
the rear of the property will provide sanitary sewer service. New
infrastructure will be extended into the subdivision to serve the residential
development.
Streets: The existing Linda Lane will be extended as a major collector
per the Thoroughfare Plan in the future. Harvey Road is a mayor arterial.
Five private streets will be constructed within the subdivision.
Drainage: A drainage plan for the subdivision has to be submitted and
approved by Development Engineering.
Flood Plain: The tract is not in the flood plain.
Parkland Dedication: The applicant intends to pay fees in lieu of
parkland dedication.
