Item: Public hearing, discussion, and possible action on a Conditional Use
Permit, site plan, for the Texas Avenue Baptist Church located at 3400 Texas
Avenue South. (01 -25)
Applicant: Rabon Metcalf, for Texas Avenue Baptist Church
Staff Recommendation: Staff recommends approval of the proposal.
Item Summary: Churches may be permitted as conditional uses in any district
upon approval from the Planning and Zoning Commission. The applicant is
requesting approval to expand their church facilities, in two phases, at the
existing site. The proposal is for expansion in two phases. In the first phase,
the new addition will be used as a fellowship hall and as additional classroom
space. Since the number of seats provided for worship will not be changing with
phase one, no additional parking is required. In phase two, a new worship center
is proposed, along with some additional classroom space. The new worship
center will seat more people than the existing space. Therefore, additional
parking is required, with landscaping to screen it in phase two.
The property is zoned C -1. Adjacent property to the south and west is zoned R -5
and is developed as multifamily. Property to the north is zoned C -1 and is
currently used for landscaping material sales.
Comprehensive Plan Considerations: The Land Use Plan shows this area as
Attached Residential and Institutional. The requested expansion complies with
the Comprehensive Plan.
Item Background: A conditional use permit was granted for this property in July
of 1990. The original proposal included future phases similar to the project
submitted at this time. The current proposal differs in the location of the phase 2
parking. The original proposal showed it along the frontage road. This project
shows it along the northern property line and interior to the site. Conditions in
the area have not changed significantly since the original permit was approved.
Staff Analysis: Section 14 of the Zoning Ordinance authorizes the existence of
conditional uses. The Commission may permit a conditional use subject to
appropriate conditions and safeguards, when after public notice and hearing the
Commission finds that:

1. "The proposed use meets all the minimum standards established in the
ordinance for the type of use proposed." Staff conducted a technical review

and found general compliance with development regulations with the
exception of the items listed below in the staff recommendation.
2. "That the proposed use meets the purposed and intent of the ordinance and
is in harmony with the development policies and goals and objectives as
embodied in the Comprehensive Plan for Development of the City. The
request is in compliance with the Comprehensive Plan.
3. "That the proposed use will not be detrimental to the health, welfare, and
safety of the surrounding neighborhood or its occupants, nor be substantially
or permanently injurious to neighboring property." The public hearing is an
opportunity for the Commission to measure the potential impact on
surrounding land uses.
The Commission may impose additional reasonable restrictions or conditions to
carry out the spirit and intent of the ordinance and to mitigate adverse effects of
the proposed use. These requirements may include, but are not limited to,
increased open space, loading and parking requirements, additional landscaping,
and additional improvements such as curbing, sidewalks and screening."
Unless the public hearing bring to light any new information indicating potential
negative impacts, Staff recommends approval with Staff Review Comments.
Commission Action Options: The Commission has final authority over the
Conditional Use Permit and associated site plan. The options regarding the use
permit are:
1. Approval as submitted;
2. Approval with conditions relating to specific site characteristics or with time
limitations;
3. Denial with specified reasons for denial;
4. Table; or,
5. Defer action to a specified date.

INFRASTRUCTURE AND FACILITIES
Water: Water service to the site is adequate for the proposed use.
Sewer: Sewer service to the site is adequate for the proposed use.
Streets: This property has adequate access from the SH6 service road
and from Deacon by way of two paved alleys.
Drainage: Project will be required to comply with the City's Drainage
Ordinance.
